Recommended Action: 1. RESCIND the hearing scheduled by the Board on April 21, 1998. 2. FIX a Public Hearing for May 19, 1998 at 2:00 p.m. in room 107 of the Board of Supervisor's Chambers, 651 Pine Street, Martinez, California to certify the tabulation of the ballots submitted for the proposed assessment, and levy the proposed assessment. II. FinaUcialImpact: There will be no financial impact on the County General Fund. All costs will be covered with revenue from the Countywide Street Light District, CSA L-100. Bosom for R_Necommodationsand ac ground: On March 3, 1998 the Board adopted the resolution accepting the Engineer's Report directing the mailing of ballets and fixed April 21, 1998 as the date for a public hearing to consider levying an assessment on parcel to receive street lighting services. Several of the parcel owners that were mailed ballots live outside the area causing some confusion with respect to the balloting procedure. Additional time is therefore needed for staff to coordinate the return of ballots for all of the affected property owners. Two weeks prior to the original scheduled Public Hearing,the property owners future assessment concerns prompted a re-evaluation of the Engineer's Report submitted with Resolution 98/93. The results of the re- evaluation necessitated the need to rescind the Resolution and to submit a revised Engineer's Report. IV. Q2nstqu=ces of Ntgative Action: The project will not be in compliance with the Condition of Approval for LUP 2100-96, and an alternative means to finance public right of way street lighting would have to be found.
