BACKGROUND: With the significant number of hospital closures in Contra Costa County and across the state, it has become increasingly important for local governments to monitor the impacts of the resulting reduction in services. Contra Costa County has experienced a number of problems related to the closure or downgrade of hospital emergency departments and AB 1924 would facilitate the gathering of information useful for tracking the quality of services. LEGISLATIVE COUNSEL'S DIGEST AE 1924, as amended, Aroner. Emergency and urgent care: reports. Under existing law, the State Department of Health Services is responsible for the licensure and regulation of health facilities, including hospitals, and clinics. Violation of the law regulating health facilities is a crime. By changing the definition of a crime, the bill would impose a state-mandated local program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement. This bill would provide that no reimbursement is required by this act for a specified reason. Vote: majority. Appropriation: no. Fiscal committee: ne yes. State-mandated local program: ee yes. The people of the State of California do enact as follows: 1 SECTION 1. Article 2.25 (commencing with Section 2 1272) is added to Chapter 2 of Division 2 of the Health and 3 Safety Code, to read: 4 5 Article 2.25. Community Health Planning 6 Commissions 7 1242. A clinic, subject to Chapter 1 (commencing 10 with Section 1200), and a hospital, subject to this chapter, 11 shall submit annually to the state department and the 12 county health department, for the purpose of 13 determining if a region has an adequate supply of 14 emergency and urgent care, all of the following 15 information. 16 (a) Emergency room staffing. 17 (b) Average waiting periods for care at clinics and 18 emergency rooms. 19 (c) The number of staffed intensive care unit beds and 20 acute care beds. 21 (d) Admission rates from clinics and emergency, 22 rooms. 23 (e) Readmission rates of those released from care. 24 (f) The number of patients per nurses. 25 (g) The ratio of registered nurses to licensed 26 vocational nurses. 98 -3— .AB 1924 1 (h) The number of beds for which funds have been 2 budgeted. 3 1272.1. (a) The state department and the 4 Department of Corporations shall prepare a report on 5 hospital overcrowding and emergency room diversion 6 and submit it to the Legislature on or before April 1, 1999. 7 The report shall include, but not be limited to, all of the 8 following: 9 (1) The type of data that is currently collected by 10 federal, state, and local agencies. It (2) The type of data omissions that exist at federal, 12 state, and local agencies. 13 (3) The processes in place to regulate and manage 14 hospital overcrowding and emergency room diversions. 15 (4) The agencies that have authority for setting 16 standards and regulations for emergency diversions. 17 (b) The report shall recommend strategies to deal 18 with future overcrowding; and emergency room 19 diversions. 20 SEC. 2.
