1 BOARD OF SUPERVISORS Contra Supervisor Donna Gerber Costa [ urly DAM. Authorize Supervisor Donna Gerber to develop a proposal for an Agricultural Preservation Agreement and an amendment to the Urban Limit Line with the Town of Danville and the City of San Ramon in order to maintain the agricultural character and General Plan designation for the Tassejara Valley area of District Ill. 2. Direct the Community Development Department(in consultation with County Counsel to work with Supervisor Gerber to develop an MOU which can be Considered for approval by the cities and the Board of Supervisors within Thirty days. Background: At the 1998 Board reorganization, most Board members acknowledged that urban limit lines and agricultural and open space preservation would be a significant priority in land use planning for the upcoming year. Since growth concerns, land use needs, and other related issues vary in individual supervisorial district, it is incumbent upon each Board member to assess what those issues are and what the individual, possible solutions are to address them. The County and the Board of Supervisors have previously entered into preservation agreements whereby cities and the County agree to set aside land which would not be urbanized in order to maintain the agricultural and open space nature of the area. Section 82-1.024 of the Code provides as follows: "To the extent feasible, the County shall enter into preservation agreements with cities in the county designated to preserve certain land in the county for agriculture and open space, wetlands, or parks." In addition, Section 82-1.018, Changes to the Urban Limit Litre, lists findings that make it possible for the Board to change the Urban Limit Line by a 415 vote. The following finding is listed: © "(3) A majority of the cities that are part to a preservation agreement and the County have approveda change to the urban limit line affecting all or any portion of the land covered by the preservation agreement." By authorizing Supervisor Gerber to enter into discussions with the affected cities, the ground work required for such a preservation agreementcan be done and then a proposal' can be returned to the Board for consideration. ADDENDUM Item SD.2 May 19, 1998 On this date, the Beard of Supervisors considered a request from iSupervisor Gerber for authorization to develop a proposal for an AgriculturalPreservation Agreement in the Tassajara Valley area of District 111, and an amendment to the Urban Limit Line with the Town of Danville and the City of San Ramon. Supervisor Canciamilla clarified that the request was for development of a proposal and that no actions on the matter would be taken at that time. The impact of this auto-oriented suburban sprawl development on minorities and others who can't afford cars is described in Deliberate Disadvan- tage,a report recently prepared by the Applied Research Center of Oakland for the Levi Strauss Foundation: "Transportation patterns have changed dramatically in the Bevy Area as housing development and job growth have moved from the urban care to urban fringes and suburbs. The existing transportation infrastructure has proved inadequate for both car owners and those reliant on public transit. During the last forty years,nearly two out of every three new jabs have been in the suburbs of metropolitan areas,and most are not accessible by public transportation. Despite growth in the number of people in the suburbs,the majority of people of chlor in the region(71%)remain concentrated in the central cities. nue to racial discrimination,high housing costs (rental and purchase), and the lack: of affordable/low income housing units,people of color who might take advantage of the large member of entry-level positions in the suburbs are unable to move closer to these sources of employment. In Los Angeles Title VI was suc- cessfully used in a lawsuit brought by the NAACP Legal Defense and Education Fund and others charging the Los Angeles Metropolitan Transportation Authority with violating the civil rights of transit-dependent passengers--- mostly inner-city racial minorities -- by spending lavishly on.new rail systems patronized by a small minority of lamely affluent white suburbanites at the expense of the bus system. Now MTA bus fares will be frozen for two years,the monthly passes will be retained and reduced,and more than 162 buses will be added to the fleet under a consent decree approved by the federal judge in October, 1996. It is outrageous that any government agency might consider approval of development at a site that is functionally accessible only by modes of transportation so dangerous that they require seat belts,air bags or crash helmets. Four times as many Americans have been killed in motor vehicle accidents as were killed in all our nation's wars from the Revolution through the present day. Development that serves only those who drive is a primary reason for the fact that one-fourth to one- third of all California motorists are forced to drive without valid licenses or insurance. A compelling argument in support of increased funding for public transit has been the added cost of compliance with the Americans With Disabilities Act. As an unfunded mandate we identify it as a newly-added burden responsible for recent fare increases and reductions in regular fixed-route bus service. But ADA should not be considered in just this negative context. For those confined to wheel- chairs it has opened up vast new opportunities for access in spite of the service -reductions necessitated by its cost—opportunities that were previously available only to able-bodied people. The ADA is an excellent precedent on which to build an argument for federally-mandated land use and transportation funding policies that will expand this concept of equal access as a civil right to include all Americans who cannot, should not or choose not to drive cars. Auto-oriented sprawl development has been a disaster not only for our public transit systems but for the economy of our cities. They're like leaky buckets. Efforts to revitalize them with urban renewal and redevelopment subsidies are doomed to failure as long as development on remote open space and agricultural land is allowed to continue. Environmentalists and public transit advocates must look to ADA for the precedent that will empower government to restrict new gmwth to sites that can be served by public transit in a cost-effective manner. Like those disabled persons who chained their wheelchairs to subway trains and blocked the buses, all who depend on public transit must see themselves as being deprived of access by an elitist planning process that puts privilege before public needs. The recently published Projections 1998 by ABAG indicates, in projections to the year 2020, that job growth in the San Ramon and Tri-Valley area will be one of the strongest growth areas. The Council is concerned that reducing housing development in this area will affect the Job-housing balance. Demands on transportation systems become stronger as housing is located further away from jobs, and other impacts may result. This study should be completed within the next few months. We would ask the Board of Supervisors to defer any action on the request until the results of the study are available and analyzed. Contra Costa County, as well as many cities within the county, stresses the Importance of comprehensive planning for larger parcels of land prior to considering urban development. The resulting large-scale plans necessarily predict substantial new development, which triggers community opposition and backlash. Such has been the case with the Tassajara area. At the same time, a large number of smaller projects are routinely approved withoutheavy criticism, even though they may represent as much total new development. This process is greatly unfair to property owners who agree to "work with the jurisdiction" on comprehensive planning. The large parcels and property owners are penalized for attempting to provide quality planning for the future of the county. This issue should be addressed. The Contra Costa Council Is concerned as to the issue of equity. Land owners have been working with the county for many years to arrive at an urban plan which would be property planned and an asset to the county. Now the county is considering a request from Supervisor Gerber that would place land in a preserve, This issue requires thorough research and consideration. The Contra Costa Council respectfully requests the Board of Supervisors, prior to acting on the request, establish an open public process whereby all the issues could be properly and adequately addressed prior to taking any action. The Contra Costa Council asks to be included in this process. The Contra Costa Council intends to have the matter carefully considered by our various task farces prior to developing a formal Council position. We look forward to having the opportunity to work with Contra Costa County on any proposal related to the development of an agricultural preserve agreement and amendment to the Urban Limit Line. The development of the two'projects would have severe negative effects on our al Y ready overburdened county. Traffic congestion, which is now intolerable, would become impossible to deaf with. Our roads are now inadequate for what they are being asked to do, without making matters much, much worse by the addition of ninety thousand more car taps per day. Aside from the increased congestion on our roads, the quality of the air we breath will be threatened even more than it is now. There are other considerations. New schools will require use of our already stressed educational budget. Wildlife species will be threatened if not wiped out. Prime agricultural land will be lost forever. There is no existing water supply that will handle 11,000 new housing units. And finally, open space will be last. This is space that there is precious little of as it is and could never be replaced once it is gone. The bottom line is that we loose too much and it would cost way too much to provide developers the opportunity to make money and to move thousands of more people into an area that is already over populated. If the Board of Supervisors feels that there is a real need to develop new housing for new people, then it need to focus on ways of doing this that do not have the devastating negative consequences that these two developments would surely create. My opposition for the development is not only because of serious congestion and decline of peace and tranquility,but building more commercial space will have a disasterous affect on the existing commercial since on Camino Tassajara. The Safeway Shopping Center still has vacancies after it's approximately 7 years of existence. The Blackhawk Plaza Blackhawk Medical Dental Building,Blackhawk Plaza Circle Buildings,still have vacancies atter their A to 12 years of existence. Our small commercial building at the corner of Camino Tassajara and Blackhawk whicb we built to house our own Dental Office, with space for 3 additional tenants was only just leased after 2 years of vacancy. We have only been able to keep the building by depleting our personal savings. The taxes,bonds and assessments are so high,I am very=skeptical that the tenants will be able to afford to stay in business. Allowing more commercial space to be built when there is already so much that has been sitting unoccupied for years, creating more competition for the customers dollars when there are all ready too few to go around to sustain the existing merchants will cause the demise of the local existing commercial properties. Los Angeles County in its greed for development dollars and lack of foresight caused€Ire demise of Marry of its strip shopping centers hence demise of surrounding neighborhoods. Driving through Sepulveda,Van Nuys,North Hills,to name a few,you see abandoned store fronts covered with Graffiti and debris. Los Angeles allowed far too marry strip centers to be built than consumers dollars Could support. trent and taxes where high,as in Danville/Tassajara. Shopkeepers could not keep up With the rent,Property owners could not keep up with the payments. It took 20 to 25 years to collapse, But we are on the same tract. Vallejo is another perfect example of more commercial space than the econofny could support. In 1986,Vallejo began converting all its agricultural land into commercial shopping areas. Business thrived for about.5 years,but as they continued to overbuild and all the merchants were Sharing the same amount of consumer dollars,shopkeepers could not stay in business, Vallejo Corners,a once thriving shopping center very similar to Safeway, has been in and out of bankruptcy for the last 5 years. Allowing more commercial space to be built when there is already so much that has been sitting unoccupied for years, creating more competition for the customers dollars when there are all ready too few to go around to sustain the existing merchants will cause the demise of the local existing commercial properties. Los Angeles County in its greed for development dollars and lack of foresight caused the deutise of Many of its strip shopping centers hence demise of surrounding neighborhoods. Driving through Sepulveda, Van Nuys,North Hills,to name a few, you see abandoned store fronts covered with Graffiti acrd debris. Los Angeles allowed far too many strip centers to be built than consumers dollars Could support. Rent and taxes where high,as in Danville/Tassajara. Shopkeepers could not keep up With the rent.Property owners could not keep up with the payments. It took 20 to 25 years to collapse, But we are on the sane tract. Vallejo is another perfect example of more commercial space than the economy could support. In 1986,Vallejo began converting,all its agricultural land into conunercial shopping,areas. Business thrived for about 5 years,but as they continued to overbuild and all the merchants were Sharing the same amount of consumer dollars,shopkeepers could not stay in business. Vallejo Corners,a once thriving shopping center very similar to Safeway,has been in and out of bankruptcy for the last 5 years. it is nearly Elft%vacant with graffiti and debris surround the vacant Store fronts, Can we allow this to happen to Danville? Prior to changing policies created by that process, the Board of Supervisors should review those policies to see if change is warranted. Other interested parties should have a role in this process. The area in question is targeted primarily for housing. The recently published Projections 1998 by ABAG indicates, in projections to the year 2020, that job growth in the San Ramon and Tri-Valley area will be one of the strongest growth areas. The Council is concerned that reducing housing development in this area will affect the job-housing balance. Demands on transportation systems become stronger as housing is located further away from jobs, and other impacts may result. Page Two Letter- 5/15198, Supervisor Jim Rogers Re: Agricultural Agreement/Urban Limit Line Currently the Contra Costa Economic Partnership, an organization in which Contra Costa County participates, is conducting a study on these issues. This study should be completed within the next few months. We would ask the Board of Supervisors to defer any action on the request until the results of the study are available and analyzed. Contra Costa County, as well as many cities within the county, stresses the importance of comprehensive planning for larger parcels of land prior to considering urban development. The resulting large-scale plans necessarily predict substantial new development, which triggers community opposition and backlash. Such has been the case with the Tassajara area. At the same time, a large number of smaller projects are routinely approved without heavy criticism, even though they may represent as much total new development. This process is greatly unfair to property owners who agree to 'work with the jurisdiction" on comprehensive planning. The large parcels and property owners are penalized for attempting to provide quality planning for the future of the county. This issue should be addressed. The Contra Costa Council is concerned as to the issue of equity. Land owners have been working with the county for many years to arrive at an urban plan which would be properly planned and an asset to the county. Now the county is considering a request from Supervisor Gerber that would place land in a preserve. This issue requires thorough research and consideration. The Contra Costa Council respectfully requests the Board of Supervisors, prior to acting on the request, establish an open public process whereby all the issues could be properly and adequately addressed prior to taking any action. The Contra Costa Council asks to be included in this process. The Contra Costa Council intends to have the matter carefully considered by our various task forces prior to developing a formal Council position. We look forward to having the opportunity to work with Contra Costa County on any proposal related to the development of an agricultural preserve agreement and amendment to the Urban Limit Line.
