SUBJECT: BUCHANAN FIELD AIRPORT - LEASE BETWEEN CONTRA COSTA COUNTY AND
MEDIPLANE, INC.
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I. Recommended Actiton:
APPROVE and AUTHORIZE the Public Works Director to EXECUTE, on behalf of the County, a
ground lease between County, as Landlord, and Mediplane, Inc., as Tenant, for premises at the Buchanan
Field Airport, under terms and conditions more particularly described in the lease.
II. Financial lm(I act:
The lease provides that the tenant will pay a minimum rent of$575.00 per month,or a percentage of its gross
receipts, whichever is greater. Said rent will be deposited into the Airport Enterprise Fund.

III. Reasons for Recommendations and Background:
Mediplane, Inc. is a medical air transport business that will provide a beneficialservice to the community.
The tenant will complete all site improvements at the Airport, and will pay the County minimum rent versus
a percentage of the tenant's gross receipts, in exchange for a five-year lease term.
IV. ConsegMences of Negative ction:
The lease with Mediplane, Inc. will not be executed, and minimum rents will not be deposited into the
Airport Enterprise Fund.

Iii. Reasons for Recommendations and Background:
The Robert T. Mann and Audrey R. Mann Trust owns a commercial shopping center on the
southwesterly comer of the intersection of Center Avenue and Pacheco Boulevard in Pacheco. A
condition of a land use permit issued by the County Zoning Administrator in August, 1997, was that
the Manns would enter into a license agreement with the Flood Control District. The above-
referenced License Agreement would have allowed the Manns to use a portion of District property
for temporary parking for deliveries and supplies and removal of garbage; in exchange, the Manns
would pay a minimal annual fee of $500 and indemnify the District against any loss or damage
which might occur as a result of their use of the property. With the understanding that agreement
had been reached and that signed documents were being returned to the District, the License
Agreement was submitted to the Board for its approval. However, the Manns have failed to return
the signed License Agreement, despite numerous requests from Flood Control staff, and problems
continue with unauthorized access and use of the District's service road. The Manns are currently
not in compliance with the conditions of the land use permit, and the matter has been referred to
the County Zoning Administrator for revocation proceedings.
IV. Consequences of Negative Action:
If the Board fads to rescind its approval of the subject License Agreement, the Flood Control
District will be limited in its ability to negotiate with the Manns at some point in the future to prevent
unauthorized use of District property.
