May 4, 1998 Page 2 Ili. Reasons for Recommendations and Background: Caltrans is replacing the 1929 Span of the Carquinez Bridge as a part of Regional Measure One (RMI). The new span will be constructed westerly of the existing 1929 span. When the State built the adjacent 1959 Span it entered into an agreement with the County dated September 27,1955. The Bridge Relocation Project will require the relocation of the existing on and off ramps for the community of Crockett as well as modifications of local streets. This requires the modification of the original freeway agreement to allow Caltrans to work within County rights of way to accomplish the Project. The County will agree to assume maintenance of the improvements constructed on the local roads when the project is complete. Caltrans, when it made the decision to immediately replace the 1929 span rather than retrofit it for seismic integrity, embarked on an environmental process that has involved significant community involvement. This process resulted in the replacement of the Crockett Interchange; upgrade of the Wanda Way access; establishment of a community based liaison and information office; and construction of the Cummings Skyway extension, as well as the identification of numerous other mitigation measures that will occur with the Bridge construction. If. Financlai trnnact: All costs for the construction of the Bridge Relocation Project are from regional Measure One which is bridge toll based. The cost of the Cummings Skyway Extension is split between County and RM1 with the County's share derived from development mitigation. IV. F"E'WAY AGREEMENT THIS AGREEMENT, made and entered into on this day of , 19 ,by and between the STATE OF CALIFORNIA, acting by and through the Department of Transportation(herein referred to as"STATE"), and the County of Contra Costa(herein referred to as"COUNTY') , , WITNESSETH; WHEREAS,the highway described above has been declared to be a freeway by Resolutions of the California Transportation Commission on October 30, 1947, December 16, 1953, and October 19, 1955; and WHEREAS, STATE and COUNTY have entered into a Freeway Agreement dated September 27, 1955, relating to that portion of State Highway Routes 80 and 4(formerly known as Routes 14 and 106)between the north Town Limits of Hercules and the Carquinez Bridge;and WHEREAS, the City of Hercules subsequently annexed certain areas including portions of such freeway covered by said Freeway Agreement with the COUNTY dated September 27, 1955; and WHEREAS, a revised plan map for such freeway has been prepared showing the proposed plan of the STATE as it affects roads of the COUNTY; and WHEREAS, it is the mutual desire of the parties hereto to enter into a new Freeway Agreement in accordance with the revised plan of said freeway NOW, THEREFORE, IT IS AGREED. 1. This Agreement supersedes that portion of said Freeway Agreement dated September 27, 1955 between California Street and the Carquinez.Bridge. 2. COUNTY agrees and consents to the closing of COUNTY roads, relocation of COUNTY roads, construction of frontage roads and other local roads, and other construction affecting COUNTY roads, all as shown on said plan map attached hereto marked Exhibit A and made a part hereof by this reference. 3. STATE shall, in the construction of the freeway and at STATE's expense, make such changes affecting COUNTY roads in accordance with the plan map attached hereto marked Exhibit A, except that at Cummings Skyway, the construction cost shall be borne by both COUNTY and STATE as provided for in the Cooperative Agreement dated March 30, 1998 with COUNTY specifying construction participation. 4. STATE agrees to acquire all necessary right of way as may be required for construction, reconstruction, or alteration of COUNTY roads, frontage roads, and other local 1 roads, and COUNTY hereby authorizes STATE to acquire on its behalf all such necessary right of way, except that the cost of right of way required to construct Cummings Skyway shall be borne by COUNTY. S. It is understood between the parties that the right of way may be acquired in sections or units, and that both as to the acquisition of right of way and the construction of the freeway projects, the obligations of STATE hereunder shall be carried out at such time and for such unit or units of the projects as funds are budgeted and made lawfully available for such expenditures. 6. COUNTY will accept control and maintenance over each of the relocated or reconstructed COUNTY roads, frontage roads, and other STATE constructed local roads on receipt of written notice to COUNTY from STATE that the work thereon has been completed, except for any portion which is adopted by STATE as a part of the freeway proper. COUNTY will accept title to the portions of such roads lying outside the freeway limits upon relinquishment by STATE. 7. This Agreement may be modified at any time by the mutual consent'of the parties hereto, as may become necessary for the best accomplishment,through STATE and COUNTY cooperation, of the whole freeway project for the benefit of the people of the STATE and COUNTY. IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by their respective duly authorized officers.
