TO: BOARD OF SUPERVISORS FROM: FINANCE COMMITTEE DATE: April 28, '1998 SUBJECT: RECOMMENDED POLICIES AND PROCEDURES FOR ALLOCATION OF 1998/1999 KELLER CANYON MITIGATION FUNDS SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION.(S, . 1. Eased upon the reduction in available funds due to past re-negotiations of mitigation fees and allocations to the City of Pittsburg, revise the grant process so as to eliminate the division of grant applications into the separate categories of Open Space, Transportation, and Community Assistance. As a result of the elimination of these three separate categories, the need for separate review cycles by the Finance Committee, the Internal Operations committee, the Transportation committee and the East Bay Regional Parr District Liaison Committee will also be eliminated. 2. Establish a Community Advisory Panel, comprised of District V individuals, agencies and organizations to act as the preliminary review body for all grant applications. Authorize District V Supervisor to immediately initiate advertising and recruitment for members of the Community Advisory Panel. Further, authorize the District V office to interview candidates and recommend appointment to the Panel by the Board of Supervisors. 3. Direct that once the preliminary review is completed by the Community Advisory Panel, their recommendations be forwarded to the Finance Committee. 4. The Finance Committee will then hold hearings for grant applications and submit final recommendations to the Board of Supervisors. DEPUTY 6. First priority for funding shall be to those agencies and/or individuals which can demonstrate a direct nexus of the benefits of their proposal to the host communities. Following their identification, the balance of funds shall be recommended based upon their ability to serve the other communities within District V. Funds provided shall be supplemental and shall not be used to supplant either County or other funding. 6. Direct the Community Development Department to designate a staff person to work with District V staff to develop new written procedures, revised grant applications, and a time line for the.1998/1999 funding cycle. BACKQRQUNDIREAS5M.a) -OR RECO MENDATQMS): On several occasions in 1997 {July 8, October 30 and December 1), the Finance Committee reviewed funding allocations for the 1997/98 Fiscal Year, as well as discussed the policies and procedures for the allocation of mitigation funds derived from the Keller Canyon Landfill, On December 16, 1997 the Finance committee provided a report and recommendations on the Keller Canyon Mitigation Fund. At that time, the Board of Supervisors authorized the District V Supervisor to conduct a review of the current procedure for the allocation of Keller funds, and to prepare recommendations to be presented to the Finance Committee for the 1998-1999 Fiscal Year. The recommendations indicated above result from that review, and are intended to streamline the allocation process by eliminating multiple review of grant allocations. This will in turn reduce the number of times recommendations on grant allocations are brought before the Board of Supervisors, and decrease the time line of the grant process itself. The recommendations are also intended to require a more concise demonstration of the nexus of the grant proposal to the mitigation of the effects of the Keller Canyon landfill. On April 20, the Finance Committee approved the six recommendations above, after review of the attached condition of the Keller Canyon Landfill land use permit. .8 Mitigation Fee. The Landfill operator shall pay to the County of Contra Costa a fee, the amount of which may be set by the Board of Supervisors by a Board Order from time to time, which amount shall not be less than $3.00 per ton and shall not be more than $4.00 per ton, on solid waste received at the Landfill. The fee shall be used as directed by the Board In its sole discretion: 1! to mitigate general impacts of the Landfill-generated traffic on the County's road system, 2? to mitigate the general impacts of the Landfill on open space, existing and proposed recreational facilities, and agriculture, or 3? to mitigate any general impacts of the Landfill upon the surrounding community. Conditions 35.1 and 35.2 of Land Use Permit 2020389 are hereby stayed In their operation as long as Condition 35.8 remains In full force and operation. Should Condition 35.8 for any portion of It) for any reason be set aside or stayed in its operation, then Conditions 35.1 and 35.2 shall be in full force and operation. This Condition was added by Amendment 7 to Land Use Permit 2020-89 which the Board of Supervisors approved on November 1, 1994.
