HomeMy WebLinkAboutMINUTES - 04281998 - D2 . 4 TH.L+" BOARD OF SLTERV'ISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April-28, 1998 by the following vote: AYES: SUPERVISORS UILKEMA, GERBER, DESAULNIER, OANOIAMILLA, ROGERS NOES: 'SONE ABSENT: NONE ABSTAIN: NONE Resolution No. 981 215 Subject: Amend to Resolution 981195 (Amending Itemized Professional and Service Rate Charges for Contra Costa County Health Services Effective March, 1, 1998) [item D.11 04114198) to adopt the Hazardous Materials portion of the fees which were deferred by the Board of Supervisors on April 14, 1998. At the April 14, 1998 Board of Supervisors meeting, the above referenced item was agendized for passage. Mr. John Wolfe, Contra Costa Taxpayers Association spoke at this meeting stating that there was apparent dissatisfaction from one of his constituents on CCCHSD procedures for setting Hazardous Materials fees and would ask that passage on the Hazardous Materials portion of this resolution be delayed until all concerned had a chance to sit down and discuss this issue. 4n Wednesday April 22, 1998 Mr. Lew Pascalli,Jr.,Deputy Director of the Hazardous Materials Department net with John Wolfe, and Jack Freethy,owner of El Cerrito Lumber Company for discussion of fee setting. Mr. Pasealli stated.that CCCHSD has worked very diligently to have the fee schedules revamped to allocate a higher percentage of fees to the upper',end of bigger businesses resulting in approximately 48%of the businesses receiving smaller fees in the next billing cycle. Agreement was reached on the proposed resolution with CCCHSD's commitment to work with the Lumberman's Association to see if there is any way to document the small risk that lumber mills have in relation to other businesses having similar inventories. Mr. Wolfe stated that he would indicate at next weeks Board of Supervisors meeting that CCCHSD has met and agreement was reached on the matter. Fee structure for businesses required to submit a"Hazardous Material Business Plan" under Federal Sara Title III Program and the California Hazardous Materials Release Response and Inventory Program(AB 2185). In summing the total pounds of hazardous material at a given facility as part of the fee determination, the pounds of liquid CO2 shall be multiplied by 10% and that amount used in the calculation of the aggregate pounds for the site. (A) Quantity at any one time during the reporting year equal to, or greater than, a total weight of 500 pounds or a total volume of 55 gallons, or 200 cubic feet at standard temperature and pressure for compressed gas. Partial Year QwnersbiD - New Own r Aerator: A Business Plan is required from a new owner/operator from the start of the business activity to December 31. An annual AB2185 fee will be computed on the inventory of hazardous material listed in the Business Plan then prorated by the number of months',covered by the Business Plan. Discontinuance or Bale of Bgsiness: Upon discontinuance or sale of a business, the owner/operator is required to file a Business Plan for the period between the ending date of the preceding business plan to the month in which the business activity ceased or the business was sold. The annual AB2185 fee will be computed on the inventory of hazardous material listed in the Business Plan then prorated by the number of months covered by the Business Plan. The fees shall be non-transferrable, non-refundable and set on a facility bads. Failure to respond to inquiries relating to compliance with these resolutions, 25% of fee. 2. Late filing of business plans, beyond a 30-day notice of violation, 50%n of fee. 3. Failure to pay the fee within terms of the invoice, 25% of fee.
