i V THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY,CALIFORNIA AS THE BOARD OF DIRECTORS,CALIFORNIA TRADEWINDS SUBDIVISION 7838 GEOLOGIC HAZARD ABATEMENT DISTRICT Adopted this Order on April 21, 1998,by the following vote: AYES: Supervisors Uilkema, Gerber, DeSaulnier, Canciamilla and Rogers NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 98/194 SUBJECT: Tabulating Ballots, Confirming Assessments for California.Tradewinds Subdivision 7838 Geologic Hazard Abatement District, and Ordering Levy and Collection Thereof. The Board of Directors of the California Tradewinds Subdivision 7838 Geologic Hazard Abatement District RESOLVES THAT: 1. On June 10, 1997, the Board of Supervisors adopted Resolution No. 971297, approving the formation of a geologic hazard abatement district (the "CHAD") for the California Tradewinds area and appointing itself to act as the Board of Directors of the GHAD. 2. In order to defray the costs and expenses of maintaining and operating the CHAD improvements, it is necessary to provide for a reliable source of CHAD funding. 3. Public Resources Code Sections 26654 et seq. authorize, after a noticed hearing, the levy and collection of an assessment upon benefited property within the GHAD to pay for maintenance and operation of GRAD improvements. Article XIII D of the California Constitution imposes additional requirements for the levy and collection of such an assessment. 4. On February 3, 1998, pursuant to both Public Resources Code Sections 26650 et seq. and Article XIII D of the California Constitution, the Board adopted a Resolution of Intent to Order an Assessment for California Tradewinds Subdivision 7838' Geologic Hazard Abatement District, and Setting a Public Hearing to Consider all Protests Against Said Assessment (Resolution No. 98143). 5. Resolution No. 98143 declares the Board's intention, consistent with the requirements of Article XIII D of the California Constitution, to order that the costs and expense of maintaining and operating the CHAD improvements shall be assessed against the property within the +CHAD. 6. Resolution No. 98/43 declares the Board's intention to assess against the property within the CHAD, for the 1998-1999 fiscal year and for subsequent years, all or a part of the amounts set forth in the Engineer's Report, attached to the Resolution as Exhibit B, and prepared pursuant to the provisions of both Public Resources Code Section 26651 and Article XIII D, Section 4 of the California Constitution. 7. Resolution No. 98143 states that the Board will conduct a public hearing (the "Hearing") on Tuesday, March 17, 1998 at 2:30 p.m. in Room 107 of the Beard of Supervisors' Chambers, 651 Pine Street, Martinez, California 94553. 8. On March 3, 1998,the Board changed the Hearing date to April 21, 1998 and directed the Public Works Director to mail the ballots to the record owners of each parcel upon which the assessment will be imposed. 9. Resolution No. 98/43 directs the Public Works Director to deliver all the Ballots received from record owners to the Board prior to the start of the Hearing. The Resolution states that the Board will then consider all protests against the proposed assessment and tabulate the Ballots. The Resolution states that in tabulating the Ballots, the Ballots shall be weighed according to the proportional financial obligation of the affected property. The Resolution states that the Board shall not impose the assessment if there is a majority protest. The Resolution states that if there is no majority protest,the Board will levy the assessment. Wherefore,the Board of Directors RESOLVES,FINDS,CERTIFIES and ORDERS THAT: 1. The Public Works Director and the Clerk of the Board provided notice of the Hearing as described above in accordance with Public Resources Code Section 26652 and Article XIII D, Section 4 of the California Constitution. 2. The Hearing was held before this Board on April 21, 1998 at 2:30 p.m. At the Hearing,the Board heard and considered any and all protests to the proposed assessment. At the Hearing, the Election Clerk delivered to the Board all the Ballots received from record owners of property within the CHAD. The Board tabulated the ballots and weighed them according to the proportional financial obligation of the affected property. The Board then closed the Hearing. 3. Based upon the tabulation of the Ballots,the Board finds that there is not;a majority protest. Therefore,the Board is authorized to levy the proposed assessment under Public Resources Code Section 26653 and Article XIII D, Section 4 of the California Constitution. 4. The Board hereby orders that the costs and expenses of maintaining and operating the CHAD improvements shall be assessed against the property within the CHAD.' 5. The Board further confirms the assessments,as set forth in the Engineer'sReport,and orders that the amount of the assessments against each parcel of property within the CHAD shall be as provided in the Engineer's Report. Resolution No. 98/ 194 M" d. The Board further orders that the amounts set forth in the Engineer's Report shall be assessed against property within the GHAD for the 1998-1999 fiscal year and for subsequent fiscal years. 7. The Board further orders that the assessments shall be levied and collected in the following manner: (a) The Clerk of the Board shall cause to be recorded a notice of assessment,as provided for in Section 3114 of the California Streets and Highways Code, whereupon the assessments shall attach as a lien upon the property,as provided in Section 3115 of the Streets and Highways Code. (b) Thereafter,the assessments shall be payable at the same time and in the same manner as general taxes on real property within the GHAD are payable. (c) All funds generated by the assessments, and all interest earned on the assessments, shall be segregated,and deposited in a separate account for the exclusive benefits of the GHAD, and shall not be deemed at any time to constitute funds credited to the County Treasury. Introduction. This Engineer's Report provides the,justification and rationale for the proposed assessment for the California Tradewinds Subdivision 7838 Geologic Hazard Abatement District("GHAD"). The Engineer's Report has been preparedby a registered professional engineer certified by the State of California and as such, it complies with the requirements of Section 4(b)of Article XUD of the California Constitution. The,39-acre California Tradewinds subdivision is located on the northeast and northwest corners of the intersection of Evora Road and.Driftwood Drive in the Bay Point area of Contra Costa County. The California Tradewinds subdivision will be subdivided into a 46-lot single-family residential development. Section 2. Special Benefits. Those parcels identified as Lot Nos. 1 through.46 inclusive on the neap attached as Exhibit 1 will receive a particular and distinct benefit in the farm of GHAD facilities and services which are over and above the general benefits received by the general public. Specifically, the GHAD will(a) evaluate the performance of the natural and excavated slopes, the surface drainage and ditches to prevent certain geologic hazards within the GRAD, and (b) may perform certain temporary and permanent mitigation, repairs and improvement measures to control geologic hazards within the GRAD. The special benefits are more fully set forth in the California Tradewinds Subdivision 7838 Plan of Control ("Plan of Control'), attached as Exhibit 2. There was a determination of the special benefit conferred on the entire district and each parcel. Such special benefit derived from the CHAD is proportionate to the entire costs of the GHAD, and the amount of the assessment is proportional to, and no greater titan,the reasonable cost of the special benefits conferred. The assessment does not exceed the reasonable cost of the proportional special benefit conferred. Section 3. Specially Benefited Parcels. The specialty benefited parcels are those parcels identified as Lot Nos. 1 through 46 inclusive on the map attached as Exhibit 1. Section 4. Total Assessment. The total assessment chargeable to all the specially-benefited parcels within the California Tradewinds Subdivision 7838 GHAD in each year is equal to the total cost of providing the GRAD services in the identified fiscal year. The total assessment to be levied on the GHAD is$7,360 in the 1398-1999 fiscal year. The total assessment is based on the projected budget, attached as exhibit A to Resolution No. 981 _, and approved by the Board on January 27, 1998. The amount shall be adjusted annually to reflect the percentage change in the Consumer Price Index(CPI) over the previous twelve month period. The projected expenses are: RESOLUTION NO. 98l General Manager/C.,,. logist ,200 Monitoring and minor maintenance $2,400 Four site visits @ 6 hours/visit C $100fhour Repair of facilities and follow-up observation. $2,600 Small repair and cleaning items ($2,01)0 total) and 6 hours of follow-up observation of repair and cleaning work @ $100 hour Reserve $480 Soil slump, erosion or blockage repair estimate 2-day repair every 10 years, $3,200 material and equipment, 2 days of labor @$5001day, 6 hours follow-up observation @ $1001hour Legal $500 2 hours @ $2501hour County staff services $180 2 hours @$90/hour TOTAL $7,360 A reserve is budgeted because the monitoring and maintenance costs do not include the repair of any large scale soil slumps, erosion or blockage. The occurrence of such events is rare. However, if such events occur, they are expected to coincide with periods of extremely high rainfall. Historic rainfall data conservatively indicate that such periods occur approximately once every 10 years. The actual cost to repair a soil stump, erosion or blockage depends on the magnitude of such events. The above reserve amount is based upon sail slumps, erosion or blockage of medium magnitude. The CHAD also has the power under the State of California Public Resources Code to raise bonds for the purpose of paying the costs of CHAD improvements, and to accept financial assistance, including loans, in order to accomplish any purpose of the CHAT) statute. Should the CHAR arrange such financing, each parcel will be assessed a proportionate amount to reimburse these financialsources Section 5. Assessment Per Parcel. Each parcel on which an assessment is levied will be assessed $160 per;year, plus an annual adjustment to reflect the change in CPI from the previous year. (The automatic CPI adjustment to the assessment is justified because it will correct the assessment to reflect changes in actual costs of operating the GHAD.) The assessment will be levied in perpetuity. RESOLUTION NO. 98/ Section 6. Methodology for Calculating the Assessment Per Parcel. The purpose of the California Tradewinds Subdivision 7838 CHAD is to finance mitigation, abatement and control measures in the event that certain geologic hazards occur and to take the measures described in the Plan of Control to prevent those geologic hazards. The basic costs of performing these services are for Geologist/General Manager, support service,and slope stabilization, erasion protection and repairs. There are 46 residential parcels in the CHAD,which will be benefitedby the GRAD. As detailed in the Plan of Control,the GHAD will utilize specific geotechnical and biotechncial techniques to mitigate landslide and erosion hazards and also will engage in ongoing maintenance and monitoring activities. All the components of the CHAD system will be maintained and monitored with similar intensity;thus,each parcel in the GRAD will receive approximately the same benefits from the GH:AD. Accordingly,the total annual assessment on the CHAD will be evenly divided among all 46 residential parcels in the CHAD. Section 7. Engineer's Report. This assessment Report contains all of the items included in engineer's reports prepared by the Contra Costa County Department of Public Works. The Assessment Report,therefore,constitutes an engineer's report. The Engineer's Report specifically sets forth the yearly estimated budget, the total assessment that will be chargeable to the entire GHAT), the proposed estimated assessments to be levied each year against each parcel of property, and a description of the method used in formulating the estimated assessment. A copy of the Engineer's Report is also available for inspection at the office of the Contra Costa County Department of Public Works, 255 Glacier Drive, Martinez, California 94553. The Board of Supervisors will conduct a Public Heating on March 17, 1998, at 2:00 p.m. in Room 147 of the Board of Supervisors' Chambers, 651 Pine Street, Martinez, California 94553, to tabulate Ballots and to hear any protests on the proposed assessment.
