COMMISSION REGARDING A PROPOSAL BY ' TOSCO CORPORATION (APPLICANT &
OWNER) TO REZONE LAND (R2 953029) IN THE NORTH CONCORD AREA FOR THE
EASTERN PORTIONS OF TRACTS #1 AND #7 FROM HEAVY INDUSTRIAL (H-•I) TO
GENERAL AGRICULTURAL (A-2) ANIS THIS NORTHERN 19 ACRES OF TRACT #6 FROM
LIGHT INDUSTRIAL (L--I) TO HEAVY INDUSTRIAL (H-I)
SPECIFIC REQUESTS) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMERMTIQHS.
1. Adopt a Negative Declaration on this proposal for purposes of
compliance with the California Environmental Quality Act.
2. Rezone the land (RZ 9530329) in the North Concord area for the
eastern portions of Tracts #1 and #7 from Heavy Industrial (H-
I) to General Agricultural (A-2) and the northern 19 acres of
Tract #6 from Light Industrial (L-I) to Heavy Industrial (H--
I) .
3 . Introduce the ordinance giving effect to the rezoning
decision; waive reading and set date for adoption.

None. All processing costs to be paid for by the Applicant.

The Tosco Clean Fuels Project was approved by the County Planning
Commission on November 29, 1994. By the approval included
modifications to existing equipment and installation of new units
to accommodate processing of reformulated gasoline as required by
the Federal Clean Air Act. During the processing of the
application, it was determined that portion of the property
designated open Space on the County General Plan were zoned Heavy
Industrial.. Condition of Approval #46 of the Tosco Clean Fuels
Permit required Tosco to make application to bring the zoning into
conformance with the General Plan. Additionally, Tosco has
requested the norther 19 acres of Tract 6 located north of Arnold
Industrial Highway and east of Solaino Avenue be rezoned from L-I
(Light Industrial) to H-I (Heavy Industrial) .
The rezoning application was heard by the County Planning
commission on November 15, 1997. The staff recommendation
supported the applicant's submitted request. After completing
testimony, the Commission unanimously voted to recommend that the
areas identified be rezoned as recommended by staff '.
A denial of action is not advised for the eastern portions of Tract
1 and 7 from Heavy Industrial to General Agriculture. That action
could Dave a zoning/general plan non conformity for the. site.
ADDENDUM TO ITEM D.13
APRIL 14, 1998
On March 10, 1998, the Board of Supervisors continued to
this date the hearing on the recommendation of the Contra Costa
County Planning Commission on the request of Tosco Corporation
(Applicant and Owner) to rezone land on the eastern portions of
Tract 1 and 7, from H-I (Heavy Industrial) to A-2 (General
Agricultural) , and for the northern 19 acres of Tract 6 located
north of Arnold Industrial Highway and east of Solana Avenue from
L-I (Light Industrial) to H-I (Heavy Industrial) , County File RZ
95-3429) , North Concord area.
Dennis Barry presented the staff report on the matter.
No one appearing to present testimony, the public hearing
was closed.
On recommendation of Supervisor DeSaulnier, IT IS BY THE
BOARD ORDERED that recommendation 1 is APPROVED, and the request
of Tosco Corporation (Applicant and Owner to rezone land on the
eastern portions of Tract 1 and 7 from H-I to A-2 (General
Agricultural) is APPROVED and Ordinance 98-19, giving effect to
the rezoning, is INTRODUCED, reading waived, and May 5, 1998, is
set for the adoption of same; and the request of Tosco
Corporation for the rezoning of northern 19 acres of Tract 6
located north of Arnold industrial Highway and east of Solano
Avenue from L-I (Light Industrial) to H-I (Heavy Industrial) is
DENIED without prejudice, North Concord area.
