RECOMMENDATION:
ADOPT a position in SUPPORT of SB 2188 by Senator [Mane Watson.
BACKGROUND:
On February 10, 1998, the Board amended its 1998 Legislative Program to add,
among other items, the following:
two Seek elimination of State pass-on of sanctions for failure to
meet two-parent work participation rate on the basis that it
will not be possible to achieve the high Federal rate within
the established time limits because half of California's two-
parent families on aid are refugees or persons with special
needs."
Senator Watson has introduced SB 2188 which, as introduced, does the following:
Provides that no penalty can be imposed on a county for failure to reach the
two-parent work participation requirement outlined in Federal law.
Since SB 2188 is consistent with an element of the Board's adopted 1998 Legislative
Program, it is recommended that the Board indicate its support for SB 2188.

An act to amend Section 10544 of the Welfare and
Institutions Code, relating to CalWORKs.
LECISLATNE COUNSEL'S DIGEST
SB 2188, as introduced,Watson. CalWORKs: performance
outcomes: sanctions.
Existing law provides for the California Work Opportunity
and Responsibility to Kids (CalWORKs) program, under
which each county provides cash assistance and other benefits
to qualified low-income families. Each county .is required to
pay a share of the cost of both aid grant and administrative
costs for the CalWORKs program.
Under existing law, the program is funded in part through
federal Temporary Assistance for Needy Families (TANF)
block grant fiords. TANF black grant provisions contain work
participation rate requirements which must be met by states
receiving these federal funds, including work participation
rates for 2-parent families.
Existing law requires the State Department of Social
Services to develop and implement a system of performance
outcomes to monitor the success of the CalWORKs program.
Existing law provides that if the state does not achieve the
outcomes required by federal law and as a result is subject to
fiscal penalty, the penalty shall be shared equally by the state
and the counties, unless there were circumstances beyond the
control of the county, in which case complete or partial relief
may be provided.

This bill would provide that no penalty shall be imposed
upon a county for failure to meet the federal 2-parent work
participation rate.

The people of the State of Ca forn a do enact as follows-
1 SECTION 1. Section 10544 of the Welfare and
2 Institutions Code is amended to read:
3 10544. (a) If the department finds that a county is
4 experiencing significantly worsened outcomes, it shall
5 report this finding to the Chairs of the Senate Committee
6 on Budget and Fiscal Review, the Assembly Committee
7 on Budget, the Senate Committee on Health and Human
8 Services, and the Assembly Committee on Human
9 Services.
10 (b) If the state does not achieve the outcomes
11 required by federal law and,as a result,is subject to a fiscal
12 penalty, the penalty shall be shared equally by the state
13 and the counties after exhaustion of all availablefederal
14 administrative remedies. The total amount of the
15 counties' share of the penalty shall be unposed on those
16 counties that failed to meet the federal requirements in
17 an amount equal to the total share of the county's caseload
18 multiplied by the percentage of the county's share of
19 caseload to the total caseload of the counties that failed to
20 meet the federal requirements.
21 (c) Notwithstanding subdivision (fir), .no penalty.shafll
22 be.imposed upon a county for failure to meet the federal
23 two-parent work participation rate described in Section
24 407(a) (2) of the federal Social Security Act (42' U.S.0
25 Sec. 607(a) (2)).
26 (d) A county may be provided relief, in whole or in
27 part, from a penalty imposed pursuant to subdivision (b)
28 if the department determines that there were
29 circumstances beyond the control of the county. If a
30 county is granted relief, that portion of the total,penalty
31 shall not be imposed on the other counties that failed to
32 meet the federal requirements.
