MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: May 19, 1997 SUBJECT: Approve and Authorize the Chair to Execute Program Supplement No.110 for the Installation of Flash Beacons at Four Locations: Byron Highway, Livorna Road, Arlington Avenue, and various locations in Orinda. Project No.: _o662-684118 SPECIFIC REQUESTS) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION I. Recommended Action: APPROVE and AUTHORIZE the Chair of the Board of Supervisors to execute Program Supplement No. 110 which provides $72,170 in Hazard Elimination & Safety (HES) funds to install four Flash Beacons at these particular locations: Byron Highway, Livorna Road, Arlington Avenue, and various locations in Orinda. II. Financial Impact: The supplement provides Federal reimbursement for 90% of the County's costs for this project. Local funds will provide the remaining 10% of the funding for this project. There is no impact to the County's General Fund. III. Reasons for Recommendations and Background: On June 21, 1977 the Board approved County/State Master Agreement No. 04-5928 for the funding of Federal Aid Projects. On May 24, 1994, Contra Costa County qualified for Federal funds to pay for the work specified. IV. Consequences of Negative Action: If this program supplement is not approved, the County will have to absorb the entire cost of the preliminary engineering, construction engineering, and con ction of this project. Number: 04-069494 FOR FEDERAL-AID PROJECTS NO. 04-5928 This Program Supplement is hereby incorporated into the Local Agency-State Agreement for Federal Aid which was entered into between the Local Agency and the State on 06/21/77- and is subject to all the terms and conditions thereof . All maintenance, involving the physical condition and the operation of the improvements, referred to in Article VI MAINTENANCE of the aforementioned Master Agreement will be performed by the Local Agency at regular intervals or as required for efficient operation of the completed improvements. ' 2 . The Local Agency will reimburse the State for their share of costs for work requested to be performed by the State. 3 . The Local Agency agrees the payment of Federal funds will be limited to the amc,'�unts approved by the Federal Highway ighway Administration inNthe Federal-Aid Project Agreement {PR-2) /Detail Estimate.-imate.- or its mr-14ification (PR-2A) or the FNM-76, and accepts any increases in Ta�.xchange Funds, State Matching funds, and\or 'Local Agency Fund's as shown on the Finance or Bid Letter or its modification as prepared by the Office of Local Programs. 4. The Local Agency/ will advertise, award and administer this project in accordance with the. current Local Program Procedures or the new Local Programs .Manual, when issued. 5 . In executing this Program Supplemental Agreement, Local Agency hereby reaffirms the "Nondiscrimination Assurances" contained in the aforementioned Master Agreement for Federal-Aid Program. 6 . Whenever the local agency uses a consultant on a cost plus basis, the local agency is required to submit a post audit report cover- ing the allowability of cost payments for each individual consul- tafit or sub-contractor incurring over $25, 000 on the project . The audit report must state the applicable cost principles utili- zed by the auditor in determining allowable costs as referenced in CFR 49, part 18, Subpart C - 22, Allowable Costs . Page 2 of 2
