DIRECT the Director of Community Development to file a Notice of Exemption with the County Clerk. DIRECT the Chief Engineer to arrange for payment of the$25.00 handling fee to the County Clerk for filing of the Notice of Exemption. APPROVE the Plans and Specifications for the Project and ADVERTISE for bids to be received on Tuesday, July 15, 1997, at 2:00 p.m. DIRECT the Clerk of the Board to publish the Notice to Contractors in accordance with Section 22037 of the Public Contract Code. FINANCIAL IMPACT: The estimated project cost is $90,000, funded by County NPDES funds (100%). The District has applied for FEMA funds. The request is being processed. III. REASONS FOR RECOMMENDATION/BACKGROUND: The project includes bank excavation, rock slope protection and hydroseeding. It is needed to repair storm damage to the levee and restore protection to adjacent agricultural lands and the new Los Vaqueros Pipeline. The Chief Engineer has filed with the Board of Supervisors the Plans and Specifications for the project. The general prevailing rates of wages, which shall be the minium rates paid on this project, have been filed with the Clerk of the Board and copies will be made available to any interested party upon request. IV. CONSEQUENCES OF NEGATIVE ACTION: Delay in approving the project will result in a delay of construction and may jeopardize funding. The larger fill areas require RSP and will be backfilled with compacted soil to rebuild the slope. Upon completion of the project, the soil in the backfilled areas will be hydroseeded with a seed mix, approved by the Department of Fish& Game, and appropriate to the area. Project location: The proposed project is located on Kellogg Creek east of Bixler Road in the east county area near Discovery Bay. I recommend the project needs no further mandatory referral clearance from County staff subject to the following actions: ( ✓) This project has been determined to be exempt from 65402 review. ( ) This project has been determined to be exempt from 65402 review in accordance with the Board of Supervisors Resolution 81/522 because the project involves a road alignment project of a minor nature. ( ) Community Development staff makes the following attached recommendation which should be incorporated into the staff report on this matter. The project needs mandatory referral and we request Community Development staff to process this project in the following manner: ( ) 65402 review is required.
