I. RECOMMENDED ACTION:
APPROVE Project, and
DETERMINE that the project is a California Environmental Quality Act Class 1c
Categorical Exemption, and
DIRECT the Director of Community Development to file a Notice of
Determination with the County Clerk, and
DIRECT the Public Works Director to arrange for payment of the $25.00
handling fee to the County Clerk.
APPROVE the Plans and Specifications for the Project and
ADVERTISE for bids to be received on Tuesday, July 8, 1997 at 2:00 p.m.
DIRECT the Clerk of the Board to publish the Notice to Contractors in .
accordance with Section 22037 of the Publi ntract Code.

II. FINANCIAL IMPACT:
The estimated project cost is $70,000, funded by Local Road Funds (60%) and
FEMA (40%).
III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project includes wire mesh gabion wall, pavement repair and hydroseeding.
It is needed to repair a slide in the creek embankment that has undermined the
roadway.
The Public Works Director has filed with the Board of Supervisors the Plans and
Specifications for the project.
The general prevailing rates of wages, which shall be the minimum rates paid on
this project, have been filed with the Clerk of the Board and copies will be made
available to any interested party upon request.,
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of design and construction
and may jeopardize funding. If the project is not approved for advertising, it will
not be constructed.

Project Description, Common Name (if any) and Location: Bear Creek Road Slide, County File #CP
-97-28: The purpose of the project is to repair a slide in the creek embankment that has undermined the roadway. To
stabilize the bank on the south side and to minimize erosion, improvements wil include excavating and replacing material
with gabions and/or ungrouted rock slope protection. Installing drainage facilities or other ancillary features(i.e.drainage
inlets, etc.) may be necessary. There are 35 California Bay and 10 Coast Live Oak trees within the construction limits that
could be impacted. They vary in size from approximately 4"-12"diameter breat height(dbh) . However, of those trees only
12 California Bay, ranging in size from 4" - 10" dbh, and 1 Coast Live Oak approximately 12" dbh may be trimmed or
removed. Only two of the trees identified for removal are on the south bank,.and only one is visible from the roadway. The
additional trees anticipated for trimming or removal are located on the north bank where the temporary access road will be
constructed. Vegetation is very dense in that area, and the bank on that side is at a much lower elevation than the roadway,
making it difficult for motorists to notice removal of the trees. Considering the density of the vegetation in this area, removal
of the small number of trees would not be considered removal of a scenic resource. Any trees removed will be replaced with
native species at a ratio to be determined by the California Department of Fish and Game. All replacement trees will be
planted within the project limits. Upon completion of the project,the slope and any exposed areas will be seeded with a
mixture of native grasses and wildflowers. In addition,the roadway shoulder will be replaced as well as a small amount of
wire fencing.Project location: The proposed project is located approximately one mile south of Alhambra Valley
Road in central Contra Costa County.

provide copies for each member of the Board of the respective environmental impact report, notice of negative
declaration, or the notice of exemption, along with any comments received during the review period. They
must review and consider these items before approving the project. If they do not physically have the
documents, they cannot consider them.
In the case of projects which are exempt from CEQA, the Board Order should concur in the determination that
the project is categorically exempt, and direct the filing of the Notice of Exemption.
PLEASE NOTIFY US, WITHIN 2 DAYS OF THE BOARD HEARING ON THIS PROJECT, WHAT ACTION THE
BOARD TOOK SO THAT WE CAN INITIATE THE FILING OF THE NOTICE OF EXEMPTION OR NOTICE OF
DETERMINATION WITH THE COUNTY CLERK. THE FILING OF THESE NOTICES STARTS THE STATUTE OF

The project will not have a significant effect on the environment. The recommendation is based
on the following:
The proposed project consists of the minor alteration of an existing facility that will restore the structural
integrity to the roadway. The repairs will not involve an expansion of use beyond that previously
existing. No removal of a scenic resource will occur as a result of the project.

GENERAL CONSIDERATIONS:
1. Location: The proposed project is approximately one mile south of Alhambra Valley Road
in central Contra Costa County (Figures 1 & 2).
2. Project Description: The purpose of the project is to repair a slide in the creek embankment that
has undermined the roadway. To stabilize the bank on the south side and to minimize erosion,
improvements will include excavating and replacing material with gabions and/or ungrouted rock
slope protection. Installing drainage facilities or other ancillary features (i.e. drainage inlets, etc.)
may be necessary. There are 35 California Bay and 10 Coast Live Oak trees (varying in size from
approximately 4" - 12" diameter breast height (dbh)) within the construction limits that could be
impacted. However, of those trees only 12 California Bay, ranging in size from 4" - 10" dbh, and
1 Coast Live Oak approximately 12" dbh may be trimmed or removed. Only two of the trees
identified for removal are on the south bank, and only one is visible from the roadway. The
additional trees anticipated for trimming or removal are located on the north bank where the
temporary access road will be constructed. Vegetation is very dense in that area, and the bank on .
that side is at a much lower elevation than the roadway, making it difficult for motorists to notice
removal of the trees. Considering the density of the vegetation in this area, removal of the small

SUBJECT: MANDATORY REFERRAL FOR GENERAL PLAN CONFORMANCE
We have reviewed the attached project, CP# 97-28, Bear Creek Road Slide Repair to determine if
mandatory referral for General Plan Conformance, as required by Section 65402 of the Government Code,
is necessary.
I recommend the project needs no further mandatory referral clearance from County staff subject to the
following actions:
(✓) This project has been determined to be exempt from 65402 review.
( ) This project has been determined to be exempt from 65402 review in accordance with the
Board of Supervisors Resolution 81/522 because the project involves a road alignment
project of a minor nature.
( ) Community Development staff makes the following attached recommendation which should be
incorporated into the staff report on this matter.
The project needs mandatory referral and we request Community Development staff to process this project
in the following manner:
( ) 65402 review is required. Community Development staff should carry this matter before the
appropriate Planning Commission. The map of the project site and description is attached.
( ) 65402 review must be withheld until completion of an Environmental Impact Report on this
project.
( ) Other procedures.

Creek Road Slide Repair. In conformance with Contra Costa County Guidelines for implementing the California
Environmental Quality Act of 1970 (CEQA), it has been determined that your project will not have a significant
effect on the environment. Your project falls within the following category:
W AN ENVIRONMENTAL IMPACT REPORT (EIR) IS NOT REQUIRED.

( ) The CEQA requirements are accommodated by the EIR previously prepared for
