Find that the adoption of the Ordinance is exempt from the provisions of CEQA pursuant to the CEQA Guidelines, Section 15061(b)(3) as there is no possibility that this activity could have a significant adverse effect on the environment. 2. Introduce the Ordinance, waive the reading and FIX June 17, 1997 for adoption. FISCAL IMPACT None. BACKGROUND/REASONS FOR RECOMMENDATIONS The proposed Ordinance would make two revisions to the Code provisions relating to Zoning Administrators. The title of "Acting Zoning Administrator" would be changed to "Deputy Zoning Administrator" which better reflects the duties of the designation, and the Zoning Administrator would be given the flexibility to assign Deputy Zoning Administrators based on geographic area or expertise. The Director of Community Development who is the Zoning Administrator has designated certain Community Development Department staff as "Acting Zoning Administrators". The County Ordinance Code does not allow the Zoning Administrator to restrict or limit the powers of an Acting Zoning Administrator. This ordinance would provide the administrative flexibility to assign or restrict staff based on their geographic or subject matter expertise, or other individual circumstances. Staff has reviewed the proposed ordinance and determined that it is exempt from the California Environmental Quality Act because it can be seen with certainty that there is no possibility that this activity could have a significant adverse environmental effect. CEK/:aw J:\groups\cdadpool\audrey\zoningck.bo a , ORDINANCE NO. 97- (ZONING ADMINISTRATOR) The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code) : SECTION I . SUMMARY. This ordinance amends Article 26-2 . 12 to allow the zoning administrator to appoint deputy zoning administrators for various regions of the unincorporated area and to hear specified or all of the matters covered by Contra Costa County Ord. Code § 26-2 . 1204 . SECTION II . Article 26-2 . 12 of the County Ordinance Code is amended to read: ARTICLE 26-2 . 12 ZONING ADMINISTRATOR 26-2 . 1202 Zoning Administrator - Designation. The community development director is designated as the zoning administrator, except that the director may appoint in writing one or more deputy zoning administrators, and may assign to each deputy zoning administrator one or more of the zoning administrator' s powers and duties set forth in section 26-2 . 1204 . The director may further assign deputy zoning adminstrators to act on matters within limited or specified geographical areas, including special districts, school districts and within the geographical boundaries of agencies and authorities governed by the Board of Supervisors . (Ords . 97- 2 , ) (Ord. 1975 : prior code § 2201 . 50 : Ord. 917) . ORDINANCE NO. 97 - 1 a i • 26-2 . 1204 Zoning administrator and deputy zoning adminis- trators - Powers and duties. Unless otherwise provided by this code, the zoning administrator and deputy zoning administrators, consistent with the scope of and to the extent specified by the community development director in their appointment, shall (1) Hear and decide all applications for variance permits, including off-street parking and loading requirements, highway setback requirements and sign requirements . Further, the zoning administrator shall review and decide all site, development, elevations, off-street parking and loading and landscaping plans and drawings, and plans and drawings for location, size and design of signs . Where matters covered by this paragraph are requested with the filing of a tentative minor subdivision map, the entire application shall be considered by the division charged with reviewing the map; (2) Hear and decide all requests for conditional use permits (also referred to as land use permits) ; (3) Be part of the advisory agency for the purpose of passing on minor subdivision and tentative maps as specified in Title 9 of this code; (4) Hear and decide all applications or requests for proposed entitlements estimated to generate less than one hundred peak hour trips; (5) Hear and make recommendations regarding proposed development agreements when such agreements are processed separately from the development project applications; and ORDINANCE NO. 97 - 2 a i • (6) Hear and act on such other matters as specifically assigned by ordinance or board resolution or order. The zoning administrator or deputy zoning administrator may on his or her own motion without prior notice or hearing refer any of the matters covered by Section 26- 2 . 1204 to the planning commission for hearing, consideration and initial decision. (Ords . 97- § 2 ; 77-33 § 9) . SECTION III . Effective Date . This ordinance becomes effective 30 days after passage, and within 15 days after passage shall be published once with the names of supervisors, voting for and against it in the , a newspaper published in this County.
