DATE: JUNE 10, 1997
SUBJECT: ORDINANCE MODIFICATION RELATING TO THE TITLE AND POWERS OF ACTING
ZONING ADMINISTRATORS
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS
1. Find that the adoption of the Ordinance is exempt from the provisions of CEQA
pursuant to the CEQA Guidelines, Section 15061(b)(3) as there is no possibility that
this activity could have a significant adverse effect on the environment.
2. Introduce the Ordinance, waive the reading and FIX June 17, 1997 for adoption.
FISCAL IMPACT
None.
BACKGROUND/REASONS FOR RECOMMENDATIONS
The proposed Ordinance would make two revisions to the Code provisions relating to
Zoning Administrators. The title of "Acting Zoning Administrator" would be changed to
"Deputy Zoning Administrator" which better reflects the duties of the designation, and the
Zoning Administrator would be given the flexibility to assign Deputy Zoning Administrators
based on geographic area or expertise.

OF ACTING ZONING ADMINISTRATORS

The existing Code allows the Zoning Administrator to designate an "Acting Zoning
Administrator" who has all of the powers of the Zoning Administrator. The Director of
Community Development who is the Zoning Administrator has designated certain
Community Development Department staff as "Acting Zoning Administrators". The County
Ordinance Code does not allow the Zoning Administrator to restrict or limit the powers of
an Acting Zoning Administrator. This ordinance would provide the administrative flexibility
to assign or restrict staff based on their geographic or subject matter expertise, or other
individual circumstances.
Staff has reviewed the proposed ordinance and determined that it is exempt from the
California Environmental Quality Act because it can be seen with certainty that there is no
possibility that this activity could have a significant adverse environmental effect.
