Certify that the Tassajara Meadows Final Environmental Impact Report is adequate and complete, and has been prepared in compliance with State and County CEQA Guidelines and that the Board considered the contents of the report prior to making a decision on this project as recommended by the Zoning Administrator. 2 . Accept the following recommendations of the County Planning Commission as pertains to the site of approximately 45 acres : A. Approve the General Plan Amendment (File #GP95-0009) to redesignate the site from Agricultural Lands to Single Family Residential - High Density and Public Semi-Public. Direct staff to include the approved General Plan Amendment in the next consolidated General Plan Amendment adoption. B. Approve the rezoning of this site from Heavy Agricultural, A-3 to Planned Unit District, P-1; approve Preliminary Development Plan (County File #RZ953036) to allow up. to 195 single family residential units and a seven-acre park/school site with conditions attached to the April 8, 1997 staff report; waive reading; and set a .date for adoption. Adopt the Findings and Statement of Overriding Considerations including the January 27, 1997 letter from Environmental Science Associates, the EIR preparers, to the Community Development Department concluding that the EIR adequately analyzes the potential impacts of the revised project, which were attached to the staff report to the Board dated April 8, 1997 with the modifications described below. 4 . Modify the Commission' s recommendation to the preliminary development plan conditions of approval to include the additional conditions in Exhibit I in order to assure conformance with General Plan policies. 5 . Adopt the Mitigation Monitoring Program. 6 . Direct staff to post a Notice of Determination with the County Clerk. OR Option B - San Ramon Valley Regional Planning Commission recommendation. Approve Option A above (including Items #1 - 6) , but with the following modifications: 1 . If the dedication of parkland is not consummated (e.g. , park/school site is used exclusively as a school site) , then appropriate fees should be required. 2 . The project shall comply with the Tri-Valley Regional Fee requirements, if adopted by the Board of Supervisors at time of issuance of building permits . 3 . The general plan amendment should be structured such that a larger public/semi-public site would still be compatible with the adopted General Plan Amendment . 4 . The project shall be compatible with preservation of Lawrence Road in its existing location, subject to the review of the Town of Danville and review and approval of the Zoning Administrator. (The SRVRPC also reinforced the County Planning Commission' s position that the park/school site should be initially offered for use as a school site as opposed to an exclusive park site. ) BACKGROUND The Board initially heard the recommendations of both the County Planning Commission and San Ramon Valley Regional Planning Commission on this project at the Board' s April 8, 1997 meeting. After taking testimony, the Board continued the hearing to this date . RECOMMENDED MODIFICATION TO CEQA FINDINGS At the last hearing, the East Bay Municipal Utility District expressed concern about proposed findings that had been prepared relative to this project ' s compliance with the California Environmental Quality Act (CEQA) . Following the last meeting, there has been additional discussions among the interested parties . Staff is recommending that the CEQA -2- The Meadows Kaufman & Broad(A) findings be modified to include the amended language identified below: Section 1: Findings Concerning Significant Impacts C. ALTERNATIVE SITE PLAN MAP Attached is an alternative (118-Ac School") site plan dated April 8, 1997 submitted by the applicant on the project . • The site plan is similar to the one recommended by the two Planning Commissions . The primary change is to expand the park/school site to 8 acres, as had been suggested (but not required) by both Commissions. This has been accomplished by removing a tier of residential lots immediately south of the school . 0 The applicant recovered some but not all of the lots lost to the expanded park/school site elsewhere in the project . The number of lots is now reduced from 195 lots to 192 lots . The reconfiguration has been accomplished with a reduction in the curvilinear form from the previous site plan and a "tighter" lotting pattern. • The alternative site plan does not provide for the off-street path connector between Street A and and Court G recommended by the Commissions . • In staff ' s judgement, the modifications do not introduce any new significant impacts that have not already been adequately addressed in the Environmental Impact Report prepared for this project . Maximum Number of Residential Lots - This project shall not exceed X192 residential lots. c : \wpdoc\meadows2 .bo RD\ -4- V ADDENDUM TO ITEM D.8 May 6, 1997 This is the time noticed by the Clerk of the Board of Supervisors for the continued hearing on the recommendation of the Contra Costa County Planning Commission on the request by Kaufinan & Broad of Northern California (Applicant), and Sid Corrie and Tom Gentry (Owners) for approval of the proposed amendment to the County General Plan for Tassajara Meadows (aka The Meadows Project) (County File #GP 0009-95) and adoption in the next consolidated General Plan Amendment; for approval for rezoning (County File #RZ 3036-95) from Heavy Agricultural A-3 to Planned Unit District P-1; and the Preliminary Development Plan to allow for 195 single family residential units and a seven acre park/school site; Danville/Blackhawk area. Dennis Barry, Community Development Department, presented the staff s recommendations and modifications to the previous plans. He noted the seven (7) acre park/school site has been increased to eight (8) acres, which reduced the project from 195 to 192 planned units and thus modified the plan. Further, he stated that the East Bay Municipal Utility District (EBMUD) representatives and the applicants agreed to modify the findings language with regard to water issues (Page 3, Section 1). Mr. Barry further stated that the County Planning Commission recommended there be an off-street path connector added between Street A and Court G, and that the applicant disagrees with this addition on the theory that the path connectors can become attractive nuisances. Heather Ballenger, Public Works Department, presented modifications to the conditions of approval as suggested by the Public Works' staff. The following persons presented testimony: John Bayless, applicant, Kaufinan & Broad of Northern California; Greg Miller, Civil Engineer for the applicants, Carlson, Barbee & Gibson, Inc.; Bill Fallah, Esq., Attorney for Kaufinan & Broad of Northern California; Wayne Tooker, 1641 Lawrence Road, Danville; Jim Blickenstaff, Sierra Club, 2410 Talavera, San Ramon,; Linda Lemon, Save Our Diablo Creeks, 572 Zenith Ridge, Danville; Nancy Beaton, 1631 Lawrence Road, Danville; Lettie Siu, 1465 Lawrence Road, Danville; Tom McDaniel, 1253 Lawrence Road, Danville. John Bayless, applicant, Kaufinan & Broad of Northern California spoke in rebuttal: Greg Miller, Civil engineer for the applicants, spoke in rebuttal. All persons desiring to speak having been heard, the Board discussed the issues. Supervisor Canciamilla moved that the public hearing be closed, and that the Board adopt recommendation Option A with the revised conditions as stated today, that the modified CEQA condition contained on Page 3 also be adopted, that the alternative site plan on page 4, (reducing the number of units and 1 providing for the 8 acre park/school site) be adopted, and instructed that as a condition, the payment of $40,000 be made towards the affordable housing study. Supervisor Rogers seconded the motion and commented on the positive role that the San Ramon Valley Planning Commission has taken in the Tassajara area development. Supervisor Uilkema remarked that concern for appropriate infrastructure in the area had been met with this development. Chairman DeSaulnier advised that he felt the mitigation for the proposed park/school site made this project worthy of support. IT IS BY THE BOARD ORDERED that the public hearing is CLOSED; Option A of staffs recommendations is APPROVED including: Tassajara Meadows' Final Environmental Impact Report is CERTIFIED as adequate and complete; Resolution No. 97\222, determining to amend the County General Plan (County File #GP 0009-95) is ADOPTED, to be included in the next consolidated General Plan Amendment; Rezoning application (County File #RZ 3036-95) is APPROVED; Ordinance 97-9 is INTRODUCED, giving effect to the rezoning, Reading is WAIVED, and May 13, 1997, is SET for adoption of same; the Preliminary Development Plan is APPROVED, with the Findings and Conditions (See attached Exhibit I ); the Mitigation Monitoring Program is ADOPTED; and staff is DIRECTED to post a Notice of Determination with the County Clerk. 2 A. Rezoning 1. The change proposed will substantially comply with the general plan. 2. The uses authorized or proposed in the land use district are compatible within the district and to uses authorized in adjacent districts. 3. Community need has been demonstrated for the use proposed, but this does not require demonstration of future financial success. (Ref§26.2.1806 of the County Code) B. Planned Unit(P-1)District Project(Adoption of P-1 Zoning and Approval of a Preliminary Development Plan) 1. The applicant intends to start construction within two and one-half years from the effective date of the zoning change and plan approval. 2. This development shall conform to the requirements of Title 8,Title 9 and Title 10 of the Ordinance Code. Any exceptions therefrom must be specifically listed in the conditions of approval. Conditions of approval are based on the Preliminary Development Plan dated April 8, 1997. 6. Applicant shall submit improvement plans, prepared by a registered civil engineer,to Public Works and pay appropriate fees in accordance with County Ordinance and these conditions of approval. -2- The Meadows Preliminary Development Plan Conditions ojApproval Road Improvements(Frontage): 7. Applicant shall construct curb (face of curb shall be 32.3 meters [7106-feet] from the northern most existing curb), at least a 18 meter ("6-foot) meandering sidewalk, necessary longitudinal and transverse drainage, street lighting, border landscaping and irrigation, new pavement, widening of existing pavement, and necessary pavement transitions along the frontage of Camino Tassajara. A 9.1 meter (`30-foot)wide median island (including landscaping and irrigation or textured concrete) shall be provided, conforming with existing improvements west of the project and transitioning easterly to an 11.6 meter ("38-foot) wide median island prior to reaching the Oak Gate Drive/relocated Lawrence Road (Jasmine Way) intersection. The 11.6 meter (-38-foot) width shall be continued eastward to the future school/park site entrance. The median island curb (north side) shall be constructed 10.4 meters ("34-feet) from the northern most existing curb. Transitions shall be designed for a 88.5 km/h ("55-mph) design speed. (EIR Mitigation Measure D.3) 8. If installation of all or any portion of the median island (including surface treatment and/or landscaping and irrigation facilities) is not feasible at this time, as approved by Public Works, the applicant shall pay an in-lieu cash deposit to the Road Improvement Trust Fund (No. 819200-0800). 9. A sketch plan shall be submitted for review to the Public Works Department,Engineering Services Division, showing all required frontage improvements along Camino Tassajara prior to starting work on the improvement plans. The sketch alignment plan shall be to scale and show off-site transitions,as necessary,curb lines, lane striping details and cross- sections. The sketch plan shall extend a minimum of 76.0 meters(-250-feet)beyond the limits of the proposed work The sketch alignment plan shall also include adequate information to show that adequate sight distance has been provided. The design speed for Camino Tassajara shall be 88.5 km/h(-55-mph). 10. Applicant shall install a traffic signal at the intersection of Camino Tassajara/relocated Lawrence Road(Jasmine Way)/Oak Gate Road. The signal shall be interconnected to the proposed signal to the west at Mansfield•Drive and/or the signal to the east at the future school/park entrance or Shadow Creek Drive(whichever is constructed first), if one or both of those signals have been constructed prior to the filing of the first Final Map for this project. If the signal to the west at Mansfield Drive and/or the signal to the east at the future school/park entrance or Shadow Creek Drive(whichever is constructed first)have not been constructed prior to the filing of the first Final Map for this project,the applicant shall provide necessary conduit and pull boxes along that portion of the project frontage in the direction of the unconstructed signal or the entire project frontage, if both signals have not been constructed, to allow the signal(s)to be interconnected in the future. -3- File#RZ953036 Kaufman&Broad-Applicant&Owner The applicant may enter into a reimbursement agreement with the County for up to 50%of the total cost of installing the signal at the intersection of Camino Tassajara and relocated Lawrence Road(Jasmine Way)/Oak Gate Road from previous and future development in the area that have been and/or will be conditioned to contribute to the construction of this signal. Road Improvements(On-Site): 11. Applicant shall construct the on-site road system to County public road standards or other alternative standards subject to the review and approval of the Public Works Department. (EIR Mitigation Measures D.3, D.4) 12. Applicant shall install safety related improvements including intersection controls, traffic signs and striping, as necessary, subject to the review and approval of the Public Works Department, Transportation Engineering Division (EIR Mitigation Measure D.7). 13. Applicant shall construct emergency vehicle accesses between "E" Court and relocated Lawrence Road (Jasmine Way) and "H" Court and remaining Lawrence Road, south of Jasmine Way, subject to the review of Public Works and the Fire District and the review and approval of the Zoning Administrator. (EIR Mitigation Measure D.5) 14. All roadways and intersections within the subdivision shall comply with Ordinance Code sight distance requirements and Caltrans stopping sight distance standards. Revisions to the site plan to conform to this requirement shall be submitted to Public Works for review and to the Zoning Administrator for review and approval. The following design speeds shall be utilized for stopping sight distance determination: * Residential Streets -48.3 km/h("30-mph) * Relocated Lawrence Road (Jasmine Way)-64.4 km/h(`40-mph) * Camino Tassajara- 88.5 km/h("55-mph) (EIR Mitigation Measure D.6) 15. Applicant shall submit a sketch plan to ensure the feasibility of extending "A" Street and "C" Street to the east. Applicant shall design the pavement structural section for relocated Lawrence Road (Jasmine Way) to accommodate the short term effects of construction vehicles from this project or traffic from ultimate development in the area, whichever is greater, subject to the review of Public Works. ( EIR Mitigation Measure D.1a) 17. Applicant shall install border and medianisland landscaping and irrigation along relocated Lawrence Road (Jasmine Way). Remaining 1.2wrence Road (south of J smin .Way) 18. Applicant shall reconstruct the remaining section of Lawrence Road, south of Jasmine Way, in conformance with the typical section shown on the Preliminary Development Plan dated April 8, 1997. (EIR Mitigation Measure D.3) 19. Applicant shall construct a 6.1 meter(-20-foot)radius curb return on the southeast corner of the Jasmine Way/Lawrence Road intersection. 20. Applicant shall install border landscaping and irrigation along the east side of Lawrence Road, subject to the review of the Public Works Department and the review and approval of the Zoning Administrator. 21. Applicant shall furnish necessary rights of way, rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, public and private road and drainage improvements. 23. Relinquish abutter's rights of access along the frontage of Camino Tassajara, relocated Lawrence Road (Jasmine Way)between Camino Tassajara and the remaining portion of Lawrence Road, excluding the two fronting lots and the emergency vehicle access at the end of"E" Court, the east side of the remaining portion of Lawrence Road between Jasmine Way and the southern property line, excluding the emergency vehicle access at the end of"H" Court, and the north side of"A" Street, between relocated Lawrence Road (Jasmine Way) and the east property line. Notification of Fnture Through Street 25. Applicant shall install signage at the east end of"A" Street and "C" Street to inform prospective property owners that these streets may be extended in the future. 26. Applicant shall provide deed notification for those parcels that abut or front on "A" Street and "C" Street to inform prospective property owners that these streets may be extended to the east in the future. AOR Reimbursements: 27. The applicant, prior to constructing any public road improvements, may contact the Public Works Department to determine the extent of any eligible credits or reimbursements against the area of benefit fee. Road 1Dedicatinnso 28. Applicant shall convey to the County, by Offer of Dedication, the right of way necessary for a width of 41.5 meters ("136-feet) along the frontage of Camino Tassajara. This right of way width incorporates a basic road right of way width of 39.0 meters (-128-feet) which is planned for this corridor, as well as an additional 2.5 meters (`8-feet) of parkway area behind the face of curb. 29. Applicant shall convey to the County, by Offer of Dedication, the right of way for all on- site public roadways as shown on the Preliminary Development Plan dated April 8, 1997. Street Ligbb 30. Street lights shall be installed and the property annexed to County Service Area L-100, or alternative entity that is acceptable to the Public Works Department, for maintenance of the street lighting. The final number and location of the lights shall be determined by the -6- The Meadows Preliminary Development Plan Conditions of Approval Public Works Department, Engineering Services Division. Application for annexation to C.S.A. L-100 Lighting District shall be submitted prior to filing of the first Final Map. Landscaping- 31. andc apin31. Prior to filing the first Final Map, the applicant shall apply to the Public Works Department for annexation to the County Landscaping District AD 1979-3 (LL-2)L-100, or alternative entity that is acceptable to the Public Works Department, for the future maintenance of landscaping and irrigation facilities in median islands, parkways and other areas ("open space" is specifically excluded). 32. Permanent landscaping and automatic irrigation facilities shall be installed within the parkway and median areas, and interim landscaping features shall be installed within the future road areas, if any. All work shall be done in accordance with the guidelines and standards of the County. Funding of, and maintenance of, the new plantings shall be guaranteed by the developer until the plants have been established and until funds are available through a landscaping district. The plants shall be maintained for 90 days after installation. 33. Prior to filing the first Final Map,two sets of landscape and irrigation plans and cost esti- mates, prepared by a licensed landscape architect,shall be submitted to the Special District Section of the Public Works Department for review and recommendation prior to submittal to the Zoning Administrator for review and approval. Plan submittal shall include plan review and inspection fees. Types and size of plant and irrigation materials within the public right of way shall be designed using standards provided by the Grounds Service Manager of the General Services Department. All landscaping and irrigation facilities shall be maintained by the applicant until funds become available for their maintenance by the County after final inspection is cleared. Pedestrian Facilities: 34. Applicant shall provide pedestrian/bicycle access connections to relocated Lawrence Road (Jasmine Way)from the end of`B" Court and"F" Court and to the remaining portion of Lawrence Road from the end of"H" Court. A pedestrian/bicycle access connection to the open space area along the west property line shall be provided from the end of"D"Court. 35. All public pedestrian facilities and access ways shall be designed in accordance with Title 24(Handicap access)and the Americans"with Disabilities Act. This shall include all sidewalks,paths,trails, driveway depressions,as well as handicap ramps. -7- File#RZ953036 Kaufman&Broad-Applicant&Owner Transit: 36. Applicant shall provide for future transit by constructing a bus turnout on Camino Tassajara at an appropriate location. The location of the turnout shall be subject to the review and approval of the appropriate transit authority. Sufficient monies shall be deposited, as determined by the transit authority,for a bus stop shelter,bicycle racks,and bicycle lockers to be installed by the authority once regular transit service to the area begins. The deposit of monies for the bus stop facilities shall be made prior to the filing of the first Final Map. (EIR Mitigation Measure D.3) Parking: 37. Parking shall be prohibited and "No Parking" signs installed along both sides of relocated Lawrence Road(Jasmine Way),the east side of the remaining portion of Lawrence Road and the north side of"A" Street between relocated Lawrence Road(Jasmine Way)and the east property line, subject to the review and approval of the Public Works Department. Utilities/Undernroundina: 38. The determination of the extent to which utility distribution facilities should be installed underground, including any existing overhead distribution facilities along the frontage of Camino Tassajara shall be deferred to the Final Development Plan and Vesting Tentative Map stage of the project. The applicant shall work with Public Works in determining where underground utilities will be located along Camino Tassajara in the vicinity of the school/park site frontage. Construction: 39. Applicant's haul route shall be via Crow Canyon Road and Camino Tassajara from the Crow Canyon RoadBlackhawk Road intersection to the project site. Applicant shall not use Camino Tassajara to the east of the project site or Sycamore Valley Road/Camino Tassajara west of Crow Canyon Road. (EIR Mitigation Measure D.Ib) Sound Walls: 40. A sound wall shall be constructed adjacent to, but outside of, the right of way along Camino Tassajara west of the Camino Tassajara/relocated Lawrence Road (Jasmine Way) intersection. The sound wall shall be constructed of a solid masonry type material and shall be designed to be airtight and attenuate the noise from the road based upon the traffic levels at general plan build out and upon the ultimate width and alignment of the road. Design of the sound wall shall be submitted to the Town of Danville for review and -8- The Meadows Preliminary Development Plan Conditions of Approval is subject to the review and approval of the Zoning Administrator. The reviews will address design features of the wall, including height and construction materials, to insure that the wall compliments existing sound walls along Camino Tassajara and that-the wall does not create any visual impacts. The construction of the sound wall shall be bonded with the project road improvements. Prior to filing of the first Final Map, the applicant shall identify the entity (including a funding source) that will be responsible for the long- term maintenance of the sound wall. (EIR Mitigation Measure F.3) Drainage imnrnvemenhu 41. Division 914 of the Ordinance Code requires that all storm waters entering or originating within the subject property shall be conveyed, without diversion and within an adequate storm drainage facility, to a natural watercourse having definable bed and banks, or to an existing adequate public storm drainage facility which conveys the storm waters to a natural watercourse. 42. The nearest public drainage facility is being constructed along the old Lawrence Road alignment. Applicant shall verify its adequacy prior to discharging run-off. (EIR Mitigation Measure I.4a) 43. Storm drainage facilities required by Division 914 shall be designed and constructed in accordance with specifications outlined in Division 914 and in compliance with design standards of the Public Works Department. (EIR Mitigation Measures I.4a, I.5e) 44. Storm drainage originating on the property and conveyed in a concentrated manner shall be prevented from draining across the sidewalk(s) and driveway(s). 45. The applicant shall install within a dedicated drainage easement any portion of the drainage system which conveys run-off from public streets. 46. Prior to filing the first Final Map, applicant shall submit a drainage study, subject to the review and approval of the Contra Costa County Flood Control &Water Conservation District(CCCFC&WCD), which includes analysis of existing, interim and ultimate drainage conditions and facilities and the feasibility of the plan to provide necessary drainage mitigation. The study shall address any potential detention basin(s), basin locations, basin size(s) and performance criteria and the impact from existing drainage facilities as well as implemented drainage mitigation on drainage facilities and watercourses downstream of the project and at the County line. The report shall also address levee stability, embankment protection, draw-down effect and liquefaction concerns related to any on-site detention basin. (EIR Mitigation Measure I.4b) -9- File#RZ953036 Kaufman&Broad-Applicant&Owner 47. Applicant shall reduce post-development flows to predicted pre-development flow levels at the County line. The project shall under no circumstances result in a peak flow rate in Alamo Creek at the County line greater than the flow restriction of 132.3 cubic meters per second (4670 cfs), when considering ultimate development of the watershed. This flow limit was agreed upon by Alameda and Contra Costa Counties. The applicant shall mitigate this project's increase in peak flow rates within Alamo Creek by implementing one of the following measures: A. Constructing an on-site detention basin at the down gradient end of the project site to reduce post-development flows to predicted pre-development flow levels at the downstream project boundary and at the County line. The preliminary design of the basin shall be based on results from hydrology modeling which utilizes the CCCFC&WCD model or other hydrology modeling which meets the approval of CCCFC&WCD, OR, B. Prior to filing the first Final Map, obtain agreements and coordinate with other developments within the Alamo Creek watershed to increase the size and capacity of off-site detention basin(s), as necessary, to reduce this project's post- development flows to predicted pre-development flow levels at the County line. All off-site drainage mitigation in conjunction with any other development within the Alamo Creek watershed shall be subject to the review of the CCCFC&WCD and review and approval of the Public Works Department. OR, C. Project storm water shall drain to the southern end of the project and discharge into the Lawrence Road drainage system that runs south down Lawrence Road and discharges into Alamo Creek. Increased storm water run-off from this project and other development in the Lawrence Road area that will be served by this drainage system will be mitigated by detention facilities downstream of the Lawrence Road area. Applicant shall form a benefit assessment district or annex into an existing benefit assessment district to collect revenue for this projects fair share cost of maintaining the downstream storm water detention facilities. (EIR Mitigation Measure 1.2a) -10- The Meadows Preliminary Development Plan CondWons oJApproval 48. Prior to the issuance of a Grading Permit(s), applicant shall obtain all drainage related permits (County Drainage Permit, Fish and Game Permit, Army Corps Permit, Regional Water Quality Control Board Permit), as required. 49. Applicant shall retain a licensed geotechnical engineer to perform a study which analyzes slope stability, allowable creek velocity, and erosion potential for Alamo Creek, downstream of the project, where peak runoff and runoff volume has increased due to the project. 50. If an on-site detention basin is constructed, the applicant will be required to comply with the following. If an on-site basin is not constructed, this condition of approval shall be waived. A. Prior to filing the first Final Map, applicant shall submit a revised site plan which provides for an on-site detention basin of adequate volume. Access and maintenance roads shall also be shown. The revised site plan shall be subject to the review of Public Works and the review and approval of the Zoning Administrator. B. Design of the detention basin shall be submitted to the Alameda County Flood Control District for review and comment and to the CCCFC&WCD for review and approval. (EIR Mitigation Measure I.2b) C. The detention basin shall be somewhat oversized, subject to CCCFC&WCD review, to ensure that the initial accumulation of sediment will not reduce the storage capacity of the basin required for the design storm. (EIR Mitigation Measure I.2c) D. The basin design shall incorporate features to avoid long-ponding stagnant water that could become a source of odors, mosquitoes and a hazard to public health. (EIR Mitigation Measure I.2d) E. Develop and implement a detention basin/drainage facility maintenance plan including a secure and perpetual funding source and maintenance entity for regular basin maintenance to clear sediment, trash and other pollutants. The basin must comply with CCCFC&WCD standards for operation and maintenance. CCCFC&WCD does not maintain basins which are less than 18,500 cubic meters ("15 acre-feet) in size. (EIR Mitigation Measure I.2e) -11- File#RZ953036 Kaufman&Broad-Applicant&Owner F. Basin design shall include installation of fencing and signing around the entire basin site and around inlet and outlet structures and the installation of a trash rack(s) to prevent access to the structure(s). (EIR Mitigation Measure I.3) G. The detention basin shall comply with CCCFC&WCD detention basin guidelines to include provisions for a perimeter service road with access from a public roadway and two feet of freeboard between the maximum 100 year water surface elevation and the lowest point along the top of bank. H. If a dual use is proposed within the storm drain infrastructure, it must be compatible with the primary use of flood control and meet the approval of CCCFC&WCD. If dual use is proposed, there must be a license agreement for said dual use signed prior to filing of the Final Map. NPDF 4. 51. Applicant shall comply with all rules, regulations and procedures of the National Pollutant Discharge Elimination Systems. 52. Applicant shall obtain a General Construction Activity Storm Water Permit. A Notice of Intent for this permit shall be submitted to the State Water Resources Control Board and a copy of the Notice provided to Building Inspection prior to the issuance of a Grading Permit. A storm water pollution prevention plan(SWPPP) and monitoring program shall be required with this permit. As part of the SWPPP,the applicant shall include prescribed procedures aimed at reducing the potential for significant impacts on water quality caused by a chemical spill,require safe collection and disposal of hazardous substances generated during construction activities,and include an emergency response program to ensure quick and safe cleanup of accidental spills. The plan should identify areas where refueling and vehicle maintenance activities are allowed(these should be permitted only where full containment of spills is provided). Any hazardous materials to be stored on-site are to be stored only in fully contained areas. Storage areas are to be shown on a map of the project site. Measures to control access,prevent spills and protect stored materials overnight and on weekends must also be described. (EIR Mitigation Measure I.1) 53. Prior to filing the first Final Map, applicant shall develop a comprehensive storm water quality plan for the reduction or elimination of storm water pollutants applying the following performance standard: implementation of the project will not degrade water quality in Alamo Creek such that beneficial uses identified by the Regional Water Quality Control Board would be impaired or precluded. This plan and project design shall incorporate some or all of the following long-term Best Management Practices (BMP's) -12- The Meadows Preliminary Development Plan Conditions of Approval in accordance with the Contra Costa County Clean Water Program for the site's storm water drainage. Wetlands/biofilter, if a detention basin is constructed on-site. Shallow roadside swales. Curb may be eliminated and sidewalk separated, subject to the review of Public Works. - Use of pavers for driveways and household walkways. This will reduce the amount of directly connected impervious surface area. - Filtering inlets. - Street sweeping. Street sweeping shall occur at least once a year between September 1 and October 15. Verification shall be submitted to the Contra Costa County Clean Water Program. - Annual public education. - Other alternatives as approved by the Public Works Department 54. Development and implementation of BMP's for this project may require the modification of the project site plan and/or the provision of additional road right of way beyond that which is required by these conditions of approval and/or the elimination of lots. 55. Applicant shall submit a storm water quality maintenance and monitoring plan applying the following performance standards: implementation of the project will not degrade water quality in Alamo Creek such that beneficial uses identified by the Regional Water Quality Control Board would be impaired or precluded. This plan shall demonstrate a secure and perpetual funding source and maintenance entity that shall be responsible for maintenance of clean water/private drainage facilities. The plan shall also include a schedule of monitoring and reporting to ensure the long-term effectiveness of the facilities and identify the entity responsible for performance and oversight of the monitoring and reporting program. (EIR Mitigation Measure 1.5c) 56. The storm water quality plan and maintenance and monitoring plan shall be subject to the review of Public Works and the review and approval of the Zoning Administrator. (EIR Mitigation Measures I.5a, b, d, e, CUM.I.1) pops: 57. Applicant shall pay all fees that are in effect as of the date that the Planned Unit District zoning becomes effective. For purposes of determining the applicant's development rights under Section 66498.1 of the Government Code, that date shall constitute the vesting date for the subdivision. Nothing in this condition authorizes the extension of the applicant's vesting rights under Section 66498.1 of the Government Code beyond the period of time authorized in the Subdivision Map Act. -13- File#RZ953036 Kaufman&Broad-Applicant&Owner 58. Applicant shall comply with the requirements of the Bridge/Thoroughfare Fee Ordinance for the South County Area of Benefit as adopted by the Board of Supervisors. 59. Prior to the issuance of Building Permits, applicant shall pay the appropriate fee, if adopted, for mitigation of impacts, as a result of development east of this project in the Tassajara Valley area, at the Crow Canyon RoadBlackhawk Road/Camino Tassajara intersection or as identified in the approved TVPOA project and which will have a direct benefit to the Tassajara Meadows project. The County Public Works Department is requiring that all first check submittals and accompanying calculations including subdivision grading plans, improvement plans, hydrology and hydraulic maps, final maps, parcel maps, right of way plat maps and descriptions will be in metric units. Exceptions may be permitted by the Public Works Department, Engineering Services Division, based upon evidence of substantial hardship. Fee Contribution for Affordable Housing Study 62. Prior to filing a final map, the applicant shall contribute $40,000 to the County Community Development Department for study of affordable housing issues and possible responses affecting Contra Costa County. Compliance with General Plan Growth Management Performance Standards 63. Any approval of a final development plan and/or vesting tentative map for this project shall provide for compliance with the following Growth Management Performance Standards from the General Plan. C. Fire Protection - The applicant shall demonstrate that all of the proposed development is located within one and one-half miles of a fire station, or that development within the project that is located more than one and one-half miles from a fire station shall be required to provide automatic fire sprinkler systems. D. Public Protection (sheriff Station Area)-If determined by the Zoning Administrator to be needed at the time of the filing of the first final map, the applicant shall be required to provide funding for a proportional share of the Sheriff facility standard of 155 square feet of station area per 1,000 new residents. E. Parks and Recreation - The applicant shall be minimally required to provide either lands and/or capital, funding, or combination of the two for a proportional share of the parks and recreation standard of 3 acres of neighborhood parks per 1,000 new residents. Deed Notification to Future Owners 64. Deed Notification-of Nearby Agricultural Activity-The following requirement is intended to assure conformance to Policy#8-an of the Conservation Element concerning notification to owners of nearby agricultural practices. Improper notification of the Board of Supervisors meeting which included Tassajara Meadows on the agenda We were not given written notification of the May 6 3PM meeting and this is an ongoing problem with the county and the developers. It is unseemly that the Board tolerates such negligence in light of the matters that will be discussed. 2. Risk of pollution and erosion from the drainage of Tassajara Meadows through Alamo Creek Alamo Creek cuts through the center of our three acre parcel of land. As the creek winds down the valley its channel becomes deeper and the banks become steeper. It is a haven for native plants and a sanctuary for many wild animals. Since Tassajara Meadows drains through Alamo Creek,the influx of water will seriously damage our fragile creek banks and even the foundation of our home which sits 40 feet from the bank. Pollutants will harm wildlife including some endangered species such as the red-wing blackbird and kit fox which reside in the area surrounding the creek. 3. Lack of emergency escape routes In the case of a wild fire,flood or any other natural disaster,residents on Lawrence Road have no emergency escape routes. Everyone will have to make his or her way out through Tassajara Meadows. .This could create a huge disaster, since all residents of Lawrence Road will have to wait for the residents of Tassajara Meadows to evacuate first. If a major fire is raging up the valley;many Lawrence Road residents could be killed while a huge bottleneck of over 200 households forms at Camino Tassajara. 4. Traffic The infrastructure to handle the increased traffic,pollution,and noise will not be in place. We and our neighbors request detailed answers to the concerns listed above. We love our homes and the quaint neighborhood on Lawrence Road. It is a special place. We must retain it. It will stand as a reminder to future generations of what made Contra Costa special in the beginning when there were native creeks,plants,and wildlife in abundance; before the valley becomes a maze of cookiecutter homes;before we savagely destroyed nature. This is a signircantchange in the proposed project land use compared to that documented in the Final E.M. This change in land use will have sign!flcant impacts on traffic volumes, traffic operation., safety, access and internal circulation. Since none of these impacts were addressed in the context of the proposed park/school site, the Final EIR did not address nor mitigate these impacts. As a registered Traffic Engineer, I am very familiar with traffic and safety issues related to school sites. The rnaximum capacity of a public school is typically 600 students. Within the San Ramon Valley (SRV) Unified School District,existing enrollment at individual school site varies from 300 to 800 students. The SRV School District currently offers limited school bus service to those who pay an annual fee. Currently, about 35 of the 18,000 students in the SRV School District use the school bus service. It is reasonable to assume that the SRV School District will provide similarly limited school bus service to the proposed school site. Relatively few students will access the school site by public transit. Therefore, the vast majority(90 to 95%) of the students will be dropped off and picked up by parents/adults who drive. The proposed school will generate roughly 890 vehicle trips(450 enter, 400 exit)just before school(7:30-8:30 am) and roughly 650 vehicle trips (300 enter, 350 exit)just after school (2:00-3:00 pm.). Hence, the volume of peak hour traffic generated by the school site alone is several times that generated by the 230 homes combined. (According to the Final )✓M 230 homes will generate 200 trips in the A.M.peak hour and 150 trips in the PM peak hour.) These peak hour traffic generation estimates already account for vehicle trips made by employees and visitors. The large volume of vehicles entering and exiting the proposed school site will result in traffic congestion, vehicle queuing,vehicular conflicts acid safety hazards. Some of the students who walk or bike to the proposed school site will be required to cross Camino Tassajara. Camino Tassajara is currently a two-lane road and will ultimately be widened to a six-lane arterial street. The crossing of six travel lanes will be a safety hazards for pedestrians(and especially for juveniles) even at signalized intersections. Other potential problems at the school site are overflow parking onto neighboring residential streets during special events. We reside at 1631 Lawrence Rd., and have many concerns with the growth that is being allowed to develop in this area. 1. Alamo Creek runs through our property, and we have serious concerns that the added water run off from the future development up stream, could cause damage to our property, and the environment. 2. County Statute 914-4.004 states analysis of water flow should take place before any urban run off takes place. As of this date, no one to our knowledge has reviewed Alamo Creek and its effects on our property, and the other property owners on Lawrence Rd. 3. We are also concerned that any change in the realignment of Lawrence Rd., would have an adverse effect in the traffic patterns that now exist. Will the new homeowners be informed by the developer, that in order to service Lawrence Rd. residence, there will be numerous Commercial Vehicles that would be required to travel through their development, such as propane trucks, feed supplies, horse trailers, etc.? This does not seem to be a safe plan considering that there will be children playing in the streets. We feel it is imperative that Lawrence Rd. stays open to Tassajara in order to service the needs of the existing residence. We hope the Board of Supervisors will look at all aspects of this project and all future projects with regards to it effect on the local environment. As existing property owners on Lawrence Rd., we want to go on record as to these concerns. We also feel that by scheduling these meetings at 3:00 p.m. in the afternoon, on a week day, that your are hoping the residence will not be able to voice their concerns. The development of 350 homes currently under construction along Lawrence Road and the 190 homes proposed on Tassajara Meadows will greatly impact water quantity and quality. The impervious surface run-off will prevent recharge ground water thus affecting well water quantity. Urban run-off inadequately treated will affect well water quality. It is documented in the Wendt EIR and TVPOA DEIR that the water at the South end of Lawrence Road is of drinking water quality. This project must show proper mitigations for water quality to keep the water in Alamo Creek as clean if not cleaner than it is now. This EIR does not show that. Conditions of Approval#43-45 and 48 are vague and non-specific. Mitigations are required now so that the public can review the proposal. COA are not mitigations and are not subject to the same scrutiny by the public and performance standards. Condition of Approval#49 is vague. If scenario A with on-site detention basin is used,then a hydrology study must be done on Mr. Don Beaton and Mr. Wayne Tooker's properties at the end of Lawrence Road. Hydrology studies by an independent hydrologist of the property owners' choice must be required of the applicant and paid for by the applicant as the impact of this project remains significant to cause creek bank instability and erosion with the real possibility of damaging Mr. Tooker's home. County Ordinance 914-4 and 914-6 has not been met by this EIR. If scenario B with off-site TVPOA detention basin is used, then the water quality and quantity issues along West Branch of Alamo Creek must be addressed as it will significantly impact Simpson Lake and Wildlife Reserve which is located on my property. An independent hydrology study of the creek bank and levee stability must be made and paid for by the applicant as Simpson Lake will be greatly damaged by this project and the cumulative impact of Wendt Project and TVPOA. Scenario B implies that this lead agency is growth inducing as the detention basin on TVPOA does not now exist and TVPOA has not yet been approved. Scenario C assumes Town of Danville has properly mitigated for the significant and cumulative impact on Mr. Beaton and Mr. Tooker's properties--Town of Danville'has not. If applicant chooses Scenario C,the impact of this project will jeopardize Alamo Creek bank stability and create a health and safety hazard for Mr. Tooker and his family. Page 1 of 2 Save Our Danville Creeks Condition of Approval#52 on-site detention basin must be required and is not an option for the applicant . Other developments in the surrounding areas --Blackhawk, Shadow Creek, and Bettencourt were required to have on-site detention basins. Detention basins are a necessity ,they are not optional. All mitigations must be on-site and if not on-site, then the applicant must fully explain why on-site mitigations are not possible. This EIR does not meet this CEQA requirement. No mitigations are provided for post-construction water quality thus violating the Clean Water Act-- no detention basin, no grassy swales, no biofilter--to assure clean water flowing into Alamo Creek. See attached newspaper article documenting urban pollutants impacting creek water. For the record, this;A;Vviolated the Better Government Ordinance by limiting the public access to information on this project for the February 11, 1997 meeting when the project was on the agenda before the Planning Commissioners. As a resident on Lawrence Road, I will state that I was not notified of this meeting or the previous Board of Supervisors meeting regarding this project.. A sound wall shall be constructed adjacent to, but outside of, the right of way along Camino Tassajara west of the Camino Tassajara/relocated.Lawrence Road (Jasmine Way) intersection. The sound wall shall be constructed of a solid masonry type material and shall be designed to be airtight and attenuate the noise from the road based upon the traffic levels at general plan build out and upon the ultimate width and alignment of the road. Design of the sound wail shall be submitted to the Town of Danville for review and is subject to the review and approval of the Zoning Administrator. The reviews will address design features of the wall, including height and construction materials, to insure that the wall compliments existing sound walls along Camino Tassajara and that the wall does not create any visual impacts. The construction of the sound wall shall be bonded with the project road improvements. Prior to filing of the first Final Map, the applicant shall identify the entity (including a funding source) that will be responsible for the long- term maintenance of the sound wall, (EIR Mitigation Measure F.3) Drainage Imnrovpmpntc� 43, Division 914 of the Ordinance Code requires that all storm waters entering or originating within the subject property shall be conveyed, without diversion and within an adequate storm drainage facility, to a natural watercourse having definable bed and banks, or to an existing adequate public storm drainage facility which conveys the storm waters to a natural watercourse. 44. The study shall address any potential detention basin(s), basin locations, basin size(s) and performance criteria and the impact from existing drainage facilities as well as implemented drainage mitigation on drainage facilities and watercourses downstream of the project and at the County line. The report shall also address levee stability, embankment protection, draw-down effect and liquefaction concerns related to any on-site detention basin. (EIR Mitigation Measure I.4b) 49. Applicant shall reduce post-development flows to predicted pre-development flow levels at the County line. The project shall under no circumstances result in a peak flow rate in Alamo Creek at the County line greater than the flow restriction of 132.3 cubic meters per second (4670 efs), when considering ultimate development of the watershed. This flow limit was agreed upon by Alameda and Contra Costa Counties. The applicant shall mitigate this project's increase in peak flow rates within Alamo Creek by implementing one of the following measures: A. Constructing an on-site detention basin at the down gradient end of the project site to reduce post-development flows to predicted pre-development flow levels at the downstream project boundary and at the County line. The preliminary design of the basin shall be based on results from hydrology modeling which utilizes the CCCFC&WCD model or other hydrology modeling which meets the approval of CCCFC&WCD, OR, B. Prior to filing the first Final Map, obtain agreements and coordinate with other developments within.the Alamo Creek watershed to increase the size and capacity of off-site detention basin(s), as necessary, to reduce this project's post- development flows to predicted pre-development flow levels at the County line. Increased storm water run-off from this project and other development in the Lawrence Road area that will be served by this drainage system will be mitigated by detention facilities downstream of the Lawrence Road area. Applicant shall form a benefit assessment district or annex into an existing benefit assessment district to collect revenue for this projects fair share cost of maintaining the downstream storm water detention facilities. Prior to the issuance of a Grading Permit(s), applicant shall obtain all drainage related permits (County Drainage Permit, Fish and Game Permit, Army Corps Permit, Regional Water Quality Control Board Permit), as required. 51.
