The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street or highway no longer required
for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets
and Highways Code, commencing with Section 8330, et. seq. A description of the portion to be
vacated is described in Exhibit"A"and shown on Exhibit"B" attached hereto and is located in the
North Richmond area.
This vacation request is based on the fact that the street or highway has been superseded
by relocation (S. & H. Code Section 8330).
This vacation request is part of a larger project for which an EIR was prepared and
approved by the Board. The project has been determined to conform to the County's General
Plan.

This Board declares that the hereinabove described proposed vacation area is HEREBY
ORDERED VACATED subject to any reservation and exception described in attached Exhibit
"A". From and after the date this Resolution is recorded, the portion vacated no longer
constitutes a public highway.
The Real Property Division is ORDERED to record a certified copy of this Resolution in
the office of the County Recorder.

A portion of Brookside Drive formerly known as road number 17 as shown on the "Map of the San
Pablo Rancho, Accompanying and forming a part of the Final Report of the Referees in Partition
dated September 1, 1893" filed March 1, 1894 in the Recorder's office, Contra Costa County,
California described as follows:
Commencing at the southwest corner of the parcel of land granted to Henry J. Kelman recorded
October 30, 1990 in Book16215 of Official Records at page 550 said point being on the
northeasterly right of way line of Brookside Drive; thence along said right of way line north
66007'26" west 60.00 feet to the Point of Beginning; thence from said Point of Beginning; leaving
said right of way line south 23°47'53"west 30.71 feet to a non-tangent curve, concave to the south,
a radial to said curve bears north 3045'07" east; thence westerly along said curve having a radius
of 526.00 feet, through a central angle of 2°45'35" an arc distance of 25.34 feet; thence non-
tangent to said curve north 66007'26"west 14.68 feet; thence north 0°38'18" east 43.53 feet to the
northerly right of way line of said Brookside Drive; thence along said right of way line south
66007'26" east 55.38 feet to the Point of Beginning.
Containing an area of 1760 square feet of land more or less.
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets and
Highways Code, the easement and right at any time, or from time to time, to construct, enlarge,
maintain, operate, replace, remove and renew those existing and in place utilities, as of the date
of recording this instrument, in, upon, over and across any highway or part thereof proposed to be
vacated, including access to protect the property from all hazards, in, upon, and over the area
herein before described to be vacated.
Bearings are based on the California Coordinate System Zone III (CCS 27).
