Unfortunately, a prior Board concurred, and, now, the property appears as the 'donut hole' in the County ULL map. • A Notice of Preparation (NOP) of a draft EIR was published on April 19, 1991 by the County Community Development Department; responses were received. However, the applicant never provided funds to pay for the preparation of the EIR. • After receiving no communication from the applicant for a period of two and a half years, staff, on February 18, 1994, requested confirmation from the applicant that he intended to pursue the application. One to two months later, staff confirmed with a phone call that the applicant had received the letter and that he would submit a response. • On July 20, 1995 staff called the applicant again, for the same reason, indicating that he would need to submit a letter and provide a good faith deposit for continued work. Staff mailed a confirmation letter the same day. • Having received no written response from the applicant, the Community Development Department scheduled the Vesting Subdivision Map #7584 for a public hearing on October 24, 1995 before the Contra Costa Planning Commission. The staff recommended denial due to inactivity on the application. • The applicant informed the County Planning Commission he would immediately proceed on his application and provide funding for the EIR. The commission did not approve the staff recommendation for denial; instead it directed expeditious processing of the application. Again, the applicant failed to proceed. • The aforementioned article in the Contra Costa Times states the owner is not proceeding on his application and that he, instead, is trying to sell his property for a youth camp. If that doesn't happen, the article states, "Boex said he would pursue housing once again". I urge you to direct the Community Development Department to immediately schedule this application for denial before the County Planning Commission on the following grounds: • The applicant has stalled on the application for over six years. • The application has not complied with CEQA; the 1991 NOP is so old that it lacks validity. No EIR has been produced on this project. • The applicant has not honored the commitments he made to the Planning Commission or County staff. • According to a County staff memo, the vesting tentative map does not comply with the County General Plan in effect at the time of submittal, and this project can not be approved in any case. Greenbelt Alliance appreciates staff's efforts to move this issue along and 'requests that the Board acts to finally bring it to a close. Contra Costa County has a long history of support for additional youth ranch facilities. The county agrees with the long held belief that fresh air and hard work provide an important stabilizing influence to youths who are otherwise undergoing negative demands and stresses on their lives. At the present time, the county has a residential subdivision application in process and must retain its neutrality on this application in accordance with due process requirements. However, should Mr. Boex wish to pursue sale of his property to the state or other public agency for establishment of a youth ranch, the Board of Supervisors can be expected to support his effort. You have provided a careful understanding of steps in the Community Development review process for subdivision#7584. There is a difference for us between the county's statutory responsibilities for the application process and other alternatives generated by newspaper articles. The County is bound to follow due process requirements and achieve resolution of this project in a timely manner while preserving the rights of all concerned. The County is bound to be independent in its judgment and to take action based on findings supported by substantial evidence. Should Mr. Boex choose to pursue sale of the property to the state or other public agency for establishment of a youth ranch, the board will support his request. However, the County must be careful not to have its regulatory power confused with any political intent. Our project review and recommendations must remain entirely independent of other options taking place, even if they are initiated by Mr. Boex. Staff is currently reviewing and preparing all older files for completion of process, including the subject application. The Community Development Department will endeavor to keep you informed of the hearing date.
