SUBJECT: INQUIRY INTO THE AUTHORITY OF THE BOARD OF SUPERVISORS
REGARDING OIL COMPANY GASOLINE ZONE PRICE FIXING
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. DIRECT the County Counsel to report to the Board of Supervisors on June 10,
1997, regarding what legal authority and/or responsibility the Board of
Supervisors has regarding gasoline companies' zone price fixing in Contra
Costa County. This report should include information about any other public
agency that has jurisdiction and authority to regulate in this area.
2. REQUEST the District Attorney to report to the Board of Supervisors on June
10, 1997, regarding what legal authority and/or responsibility the Board of
Supervisors has regarding gasoline companies' zone price fixing in Contra
Costa County. This report should include information about any other public
agency that has jurisdiction and authority to regulate in this area.
3. INVITE oil company representatives to attend the Board of Supervisors
meeting when these reports are presented so the Board of Supervisors and
the citizens we represent have an opportunity to receive additional information
on this concern.
4. DIRECT the County Administrator to notify the major oil companies doing
business in Contra Costa County when this item will be heard by the Board of
Supervisors so they have an opportunity to be present for the discussion and
can provide their input.

BACKGROUND:
Recent newspaper reports indicate that citizens residing in the San Francisco Bay
Area region pay more money for gasoline than do residents in other regions in
California because of the economic demographics of the area. It is appropriate to
ascertain what authority, if any, our Board may have in seeking to bring gasoline
prices into parity with other regions.
It is also appropriate and fair to invite oil company representatives to meet with us
when these reports are available so that an accurate dialogue takes place as the
Board of Supervisors deliberates its options in addressing this concern.
