SUBJECT: RESOLUTION NO. 4005 AUTHORIZING THE EXECUTION OF A GRANT OF EASEMENT
TO PACIFIC GAS AND ELECTRIC COMPANY FOR UNDERGROUND FACILITIES ALONG
HOUSING AUTHORITY OWNED PROPERTY ON CHESTER DRIVE IN PITTSBURG, CA
SPECIFIC REQUEST(S) OR RECOMMENDATION(S)& BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION:
ADOPT Board Resolution No. 4005 AUTHORIZING the Executive Director of the Housing Authority of
the County of Contra Costa to execute a Grant of Easement to Pacific Gas and Electric Company(PG&E)for pole
line and underground facilities services on Housing Authority property on Chester Drive in Pittsburg, CA.
II. FINANCIAL IMPACT: None.
III. REASONS FOR RECOMMENDATION/BACKGROUND
Pursuant to a Board Order approved on June 25 1996,the Housing Authority sold a portion of its property
on Chester Drive to the Columbia Park Manor for the development of a HUD Section 202 Senior Housing
development. In order for PG&E to provide electrical underground services to the Columbia Park Manor Senior
Apartments, it will be necessary to extend those services through property on Chester Drive still owned by the
Housing Authority. The facilities will be installed within a 20 foot easement along the northeastern edge of the
Housing Authority property. The Grant of Easement will provide PG&E with the right to maintain their facilities
in the easement and will provide conditions necessary to assure that safety and operational requirements for PG&E
are met.
IV. CONSEQUENCES OF NEGATIVE ACTION
Should the Board of Commissioners elect not to authorize the Executive Director to execute the Grant of
Easement to PG&E, Columbia Park Manor and PG&E would have to reroute the utilities at a substantially greater
cost to the project. This would make it unfeasible to complete this much needed affordable senior housing under
the current funding.

AUTHORIZING THE EXECUTIVE DIRECTOR OF THE HOUSING AUTHORITY TO EXECUTE A
GRANT OF EASEMENT TO PACIFIC GAS AND ELECTRIC COMPANY FOR UNDERGROUND
FACILITIES ON HOUSING AUTHORITY OWNED PROPERTY ON CHESTER DRIVE IN
PITTSBURG,CA
WHEREAS,the Housing Authority of the County of Contra Costa(hereinafter referred to as "Housing
Authority"), a public body, corporate and politic, has been working with Columbia Park Manor, Inc.
to develop lower income senior housing; and
WHEREAS,the Housing Authority sold a portion of its property on Chester Drive in Pittsburg, CA to Columbia
Park Manor,Inc. for the development of a HUD Section 202 senior housing complex, Columbia Park
Manor Senior Apartments; and
WHEREAS,Pacific Gas and Electric Company, a California Corporation,proposes to construct, install , inspect,
maintain,replace, remove and use underground facilities along northeastern edge of the Housing
Authority property to access the Columbia Park Manor site; and
WHEREAS,in order to proceed with the undergrounding of these electrical facilities a Grant of Easement from the
Housing Authority of the County of Contra Costa to Pacific Gas and Electric Company is required.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. That the Board of Commissioners of the Housing Authority of the County of Contra Costa hereby
authorizes the Executive Director of the Housing Authority to execute a Grant of Easement to Pacific Gas and
Electric Company on the land rights where the underground facilities project is to be installed, as shown on Exhibit
A attached hereto and made a part hereof.
2. That this resolution shall take effect immediately.

Commissioners:

EASEMENT
THE HOUSING AUTHORITY OF THE COUNTY OF CONTRA COSTA, a public body of the State
of California,
hereinafter called first party, hereby grants to PACIFIC GAS AND ELECTRIC
COMPANY, a California corporation, hereinafter called second party, an easement and
right of way to construct, reconstruct, install, inspect, maintain, replace, remove, add to,
and repair, at any time and from time to time, poles, aerial wires, cables, electrical
conductors with associated crossarms, braces, transformers, anchors, guy wires and cables,
(pole line easement); and such underground conduits, pipes, manholes, service boxes,
wires, cables, and electrical conductors; aboveground marker posts, risers, and service
pedestals; underground and aboveground switches, fuses, terminals, and transformers with
associated concrete pads; and fixtures and appurtenances necessary to any and all thereof
(underground easement), as second party deems necessary; together with the right of ingress
thereto and egress therefrom; in, on, over, under, across and along-that certain real property
located in the City of Pittsburg , County of Contra Costa ,
State of California, described as follows:

Exhibit "A", attached hereto and made a part hereof, lying within
PARCEL "B" as shown upon Parcel Map M.S. 676-95 filed for record in
Book 169 of Parcel Maps at page 26, Contra Costa County Records.
The legal description herein, or the map attached hereto, defining the location of this utility
distribution easement, was prepared by Pacific Gas and Electric Company pursuant to
Section 8730(c) of the Business and Professions Code.

Second party shall also have the right to trim, cut down, and clear away or otherwise control
any trees or brush on said strip of land, as hereinbefore set forth, whenever considered
necessary for the complete enjoyment of the rights hereby granted.
First party shall not erect or construct any building or other structure or drill or operate any
well under or within lo feet of the centerline of second party's electrical conductors or
within said strip of land.
The provisions hereof shall inure to the benefit of and bind the successors and assigns of the
respective parties hereto.
