property taxes from the Crockett Cogeneration Plant to County Service Area P-1/R-1
Advisory Committee, the Crockett Library, the Crockett-Valona Sanitary District, and the
Crockett Recreation Association for specified uses of benefit to Crockett.

Greetings:
The purpose of this letter is to alert you to several violations of County Ordinances and
Land Use Permits,and to request a rescindment to an existing Land Use Permit and
'severely restrict the property owners from future violations.
The property in question is located between 220 and 240 Bolla Avenue in Alamo. It is
Parcel#193-170-061. The property is owned by Round Hill Country,Club. In 1958 and
1959 Round Hill was granted two Land Use Permits, #235-58 and#409-59. The usage
reason was: "Establish a Country Club with 18 hole golf course;clubhouse,,swimming
pool,tennis courts,pro-shop and maintain facilities necessary to operate a club." .
When the permit(s)were granted it was determined that it would not negatively influence
the area.That was 38 years ago! Since then environmental restrictions have been
implemented in all aspects of property ownership but somehow Round Hill has escaped
this "time warp"and created a huge disposal site at the expense of their immediate
neighbors and the community in general.
Since 1993 repeated attempts to resolve the problem,written and verbal,have either been
ignored or answered with polite arrogance and false promises. In 1993 we complained to
the Code Enforcement department but no action was taken. Our latest attempt to enlist
Round Hill's cooperation was a letter to the Chairman of the Executive Committee on
March 19, 1997. See the attached. This letter requested an answer by the end of March.
One month later we received a letter stating they were looldng into a solution but would
requite more time to gain a complete understanding of the problem. Well . .our patience
is at an end.

Following are the ordinances violated by Round Hill Country Club:
4118-4,008 Permit Required
No person shall establish or maintain a refuse disposal site in this County without first
obtaining and holding a valid unrevoked permit therefore,as provided in this chapter.
470-4.004 Residential Property Nuisance
No person owning, leasing, renting,occupying or having charge or possession of
residential real property shall maintain or allow t he maintenance of such property in such a
manner that any of the following conditions exist thereon visible from a public street:
(This section has 6 conditions.Items (5) and(6) meet the violations to the code.)
(5) Construction and wood debris, including cuttings,for an unreasonable period
of time. (In this case its been about 7 years)
(6) Weeds over eighteen inches in height.
84-12.404 Uses - Requiring Land Use Permit
In the l-15 district the following uses are permitted on the issuance of a land use permit:
All the uses designed for the R-6 district in Section 84-4.404.
None of the uses listed is a refuse disposal site
88-4.402 (Junkyard) Permit Required
No person shall establish or maintain a junkyard in this county without first obtaining a
permit as provided in this chapter.
A junkyard is defined in 88-4.206 : " . any property used
(whether or not for profit or gain)for(1)etc.,etc., etc,or(2)the
storage or salvage of automobiles or other vehicles or machinery,
scrap metal, or other scrap materials, including salvaged
building materials."
In addition we would request the Board of Supervisors initiate the enforcement of County
Code Ordinance 88-4.2208 Nuisance - Abatement:
"Any violation of this chapter is declared to be a public nuisance. The district attorney,
when directed by the board ofsupervisors,shall commence the action or proceedings
necessary and convenient to abate the nuisance."
Also the unlawful property use perpetrated by Round Hill qualifies as a"Nuisance"under
California Civil Code 3479:
"Anything which is injurious to health,including,but not limited to,the illegal sale of
controlled substances,or is indecent or offensive to the senses,or an obstruction to the
free use of property, so as to interfere with the comfortable enjoyment of life
or property, or unlawfully abstracts the free passage or use, in the customary manner,
etc. , etc., . . 1s a nuisance."

We Have three requests:
(1) All County Code Ordinances violated by Round Hill be enforced.
(2) Round Hill be fined appropriately for their repeated offenses.
(3) The existing Land Use Permit be rescinded and any new permits be subject to the
approval of the community.
Your prompt attention to these requests will be greatly appreciated.

Dear David:
Since we moved to our Alamo residence in 1988,the Round Hill property located between
220 and 240 Bolla Avenue has been a progressively worsening disgrace to the
neighborhood.
We and our neighbors have complained to the President,Tom Murphy, as well as various
ground employees . . all to no avail. Our only mistake has been to let so much time pass
before we made another attempt to rid our neighborhood of this unsightly mess. The mess
consists of debris,trash and a "mountain"of dirt so high it can be seen for several blocks.
The property is so unkempt and trashy that people consider it a dump site,leaving bottles,
cans and even old tires in front of the gate(the gate,an old chain link,is also a disgrace).
Verbal promises were made by Tom Murphy and other employees to clean up the lot upon
the completion of the Club's construction. Obviously these promises were either forgotten
or made only to pacify.
We want,very much,to resolve this problem in a mutually satisfying manner. Could you
please look into this matter and respond to us by the end of this month.If we are not
contacted we will be forced to take other appropriate actions to rid ourselves of this
neighborhood nuisance.
