SUBJECT: APPROVE THE SIXTH AMENDMENT FOR O'BRIEN-KREITZBERG INC.
MERRITHEW MEMORIAL HOSPITAL REPLACEMENT PROJECT (WHS80B)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
I . RECOMMENDATION
1 . APPROVE the Sixth Amendment of the Consulting Services
Agreement with O'Brien-Kreitzberg Inc. and AUTHORIZE the
County Administrator or his designee to execute the
Amendment .

2 . AUTHORIZE the County Administrator or his designee to issue
written authorizations for extra work, provided that the
cumulative total extra cost for all such authorizations shall
not exceed $25, 000 . 00 .
II . FINANCIAL IMPACT
This Amendment increases the Project Manager' s payment limit by up
to $842 , 000 for services required for extended project and
management services, extended estimating required for the fourth
and fifth floor changes, other owner requested changes and code
mandated structural changes, and computer hardware/software
expenses . Funds in the capital account established for the
project are sufficient to cover the amount encumbered by this
Amendment from bond proceeds specified to the project .

III . BACKGROUND
At the time the County negotiated its contract with O'Brien
Kreitzberg (OK) , the project was scheduled for completion in January
1997 . During the later stages of design, the Federal court issued
an injunction stopping design and construction procurement . This
injunction resulted in an eight month delay to the project . The
construction began on April 3 , 1995 with a contract completion date
of July 31, 1996 . Since the start of construction, the completion
has been extended to September 30, due to a combination of code
mandated structural changes resulting from the Northridge earthquake
and the addition of two - psych wards on the fourth floor and the
build out of the unfinished area on the fifth floor. These delays
have extended OK' s period of services by ten months . In addition to
this 10 month extended period for the core staff, OK added a second
estimator in order to estimate and negotiate the state mandated $ . 6
million structural change, other state OSHPD fire marshal required
changes and various owner requested changes (primarily the $3 . 8
million fourth and fifth floor change) . This increased estimating
effort lead to more aggressive negotiations with the contractor
which resulted in reduced change order costs . The fourth and fifth
change alone was negotiated for about $1 million below the
preliminary proposal . The hardware and software purchased with
project funds is owned by the County and will be turned over
for County use when the project is complete.
With this amendment, OK will continue to exceed the County' s MBE/WBE
goals of 50-o and 100-. respectively. OK currently forecasts it will
complete the project with approximately 10a MBE and llo WBE
subconsultant participation.
