DATE: April 16 , 1997 SUBJECT: Appeal to the Board of Supervisors by Elizabeth Casey Sawyer to request suspension of the enforcement of Abandoned Vehicle Abatement Ord. 95-2 SPECIFIC REQUESTS) OR RECOMMENDATION(S) B BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: Authorize the Sheriff to proceed with enforcement of County Ordinance 95-2 requiring the removal of the inoperable vehicles and parts thereof from private property, located at 1265 Juanita Dr., Walnut Creek. The Sheriff requests the Board deny the appeal and direct the Sheriff to proceed with the abatement action as scheduled. II. BACKGROUND INFORMATION: The abatement action was started on September'2, 1996, with a site inspection where 3 vehicles were identified for abatement action. On September 21, 1996, Ms. Sawyer requested an Appeal Hearing to be held on this abatement action before the Zoning Commissioner. Ms. Sawyer initially requested one (1) vehicle, a 1984 Chevrolet Celebrity, Station Wagon, Lic.# 1 KWL527, be permitted to remain on the parcel and be repaired at some later time. She was willing to dispose of the VW bus and the Toyota Corona, grey, which are beyond repair. Ms. Sawyer sent a representative to the November 18, 1996, Zoning Commission hearing and she changed the position stating that they were long standing taxpayers and they wanted time to repair all three (3) vehicles. The Zoning Commission hearing was rescheduled twice and no representative appeared at either of these rescheduled times. Their failure to appear on January 27, 1997, resulted in the Appeal Hearing being held in Sawyer's absence. The Zoning Commissioner ruled that Sawyer had until February 10, 1997, to get the three vehicles operable and call for an inspection, or to remove the three (3) vehicles from the property. On February 5, 1997,Mrs. Elizabeth Casey Sawyer requested an Appeal from the decision of the Zoning Administrator on the proposed abatement of abandoned vehicles. III. A substantial accumulation of miscellaneous nondescript material and debris on and about the premises of the Casey property. 2. The storage of a travel trailer which lacks the required screening for obstruction of public viewing. 3. The storage of abandoned otherwise nonoperating vehicles requiring abatement. The harboring of materials which may allow for vermin generation. County departments have been involved in seeking resolution of the aforementioned areas of concern for the last 15 months. To date no suitable plan has been articulated and implemented. However, given that next course of action will be the pursuit of involuntary abatement, the county seeks to allow the property owner the maximum allowance of time for mitigation of these problem areas before seeking a more adversarial posture. (Abandoned Vehicle Abatement Ordinance Amendments- Administration and Enforcement) The Contra Costa County Board of Supervisors ordains as follows (omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code): SECTION I. SUMMARY. This ordinance amends County Ordinance Code Division 430 to designate the Sheriff to administer and enforce the provisions of the Abandoned Vehicle Ordinance, and to clarify the provisions on entry onto private property. SECTION 11. Section 430-4.014 Is added to the County Ordinance Code, to define the term "enforcement officer' to read: 430-4.014 Enforcement Officer. "Enforcement Officer'refers to the Sheriff as the official responsible for administering and enforcing the provisions of this division. (Ord. 95- _L§2.) SECTION 111. Chapter 430-6 of the County Ordinance Code is amended, to designate the Sheriff as the County official responsible for administering the provisions of Division 430, Abandoned Vehicle Ordinance, and to delete all references to the Director of Building Inspection, to read: CHAPTER 430.6 ADMINISTRATION AND ENFORCEMENT 430-6.002 Enforcement Authority. The Sheriff is designated the enforcement officer for this division.The Sheriff and his regularly salaried full-time employees shall be responsible fortnforcing and administering this division pursuant to Vehicle Code Section 22663. In the enforcement of this division, such employees and other persons duly authorized by the Sheriff may enter upon private or public property to examine a vehicle or parts thereof, obtain information as to the identity of a vehicle and to remove or cause the removal of an abandoned vehicle. (Orris. 95- 3, 86-58 §3, 77-112.) 430-6.004 Abatement The enforcement officer may have abandoned vehicles abated and/or removed In accordance with the procedure prescribed in this division. (Ords. 95- L_§3, 86-56 §3, 77-112.) 430-6.006 Notice of Intention. (a)Notice. The enforcement officer shall mail a ten- day notice of intention to abate and remove an abandoned vehicle as a public nuisance, by registered or certified mail, to the owner of the land, anyone known to be in possession of the land and the owner of the vehicle, unless the vehicle is In such condition that identification numbers are not available to determine ownership, or unless the property owner and the vehicle owner have signed releases authorizing removal and waiving further Interest In the vehicle or parts thereof. i (b)* Contents. The notice shall contain an estimate of the cost of abatement (including administrative and removal costs) and a statement that this cost may be levied as a special assessment on the landowners land (parcel). It shall contain a statement of the possessor, property and vehicle owners hearing rights and notice to the property owner that he or she may appear In person at a hearing or may submit a sworn written statement denying responsibility for the presence of the vehicle on his or her land, with reasons for such denial, in lieu of appearing. .(Ords. 95-=§3, 66-58 §3, 77-112.) 430-6.008 Inoperable non4owable Vehicles. (a)This chapters notice of intention Is not required for removal of a vehicle or part thereof which Is inoperable due to the absence of a motor, transmission or wheels and incapable of being towed, and is valued at less than two hundred dollars by a person specified in Vehicle Code Section 22855; provided, that the property owner has signed a release authorizing removal and waiving further interest in the vehicle or pert thereof. Prior to final disposition under Vehicle Code Section 22662 of such a low valued vehicle or part for which evidence of registration was recovered,the enforcement officer shall provide notice to the registered and legal owners of intent to dispose of the vehicle or part, and If the vehicle or part is not claimed and removed within twelve days after the notice is mailed from a location specified in Vehicle Code Section 22662,final disposition may proceed. The County, the enforcement officer or any contractor thereof shall not be liable for damage caused to a vehicle or part thereof by removal pursuant to this section. (b) This section applies only to inoperable vehicles located upon a parcel that Is: (1) zoned for agricultural use: or(2) not improved with a residential structure containing one or more dwelling units. (Ords. 95-=§3, 86-58 §3, 84.64 §2: Vehicle Code §22661.) SECTION IV. Chapter 430-8 of the County Ordinance Code is amended to delete all references to the Director of Building Inspection and to substitute to substitute Chapter 430-8 hearings and appeals. CHAPTER 430-8 HEARINGS AND APPEALS 430-8.002 Hearing Requests. (a) Request. Within ten days after the mailing date of the notice of intention to abate and remove,the vehicle owner,landowner or possessor of property may request the zoning administrator for a public hearing on the question of abatements and removal and the estimated cost thereof. (b) Discharge. if, within this ten day period, the landowner submits a sworn written statement denying responsibility for the presence of the vehicle on his land with his reasons for such denial, said statement shall be construed as a request for a hearing which does not require his presence. (c) Notioe. The zoning administrator shall immediately notify the enforcement officer of any such requests or disclaimer. (Orris. 95-=§4, 86-58 §3, 77-112.) 1 j 430-8.004 No Hearing. K no disclaimer or request for hearing Is received within the ten day period,the enforcement officer or any person he or she authorizes shall abate and remove the vehicle or parts thereof. Thereafter, the costs of abatement shall be collected pursuant to Chapter 43D-12. (Orris. 95-_Z_§4, 86-58 §3, 77-112.) 430-8.006 Hearing Notice. When a hearing is requested,the zoning administrator shall mail notice of the hearing at least ten days before the hearing date, to the enforcement officer,the landowner,any known possessor of the parcel,and to the vehicle owner unless the vehicle Is In such condition that identification numbers are not available to determine ownership. (Ords. 95-.L_§4, 86-58 §3, 77-112.) 430-8.008 Hearings. All hearings under this division shall be held before the zoning administrator who shall receive all evidence he or she deems material, Including the condition of the vehicle or parts thereof, the circumstances of its abandonment and location and the estimated cost of the abatement. The zoning administrator shall not be limited by the technical rules of evidence. The landowner may appear In person or present a sworn written statement, in time for consideration at the hearing, denying responsibility for the presence of the vehicle on his or her land with reasons for such denial. (Ords. 95-_2.._§4, 186-58 §3, 77-112.) 430-8.010 Decisions. (a) The zoning administrator may impose such conditions and take such other action as he or she deems appropriate under the circumstances to carry out the purpose of this division. He or she may delay the time for removal of the vehicle or parts thereof, It in his or her opinion, the circumstances justify It. At the conclusion of the public hearing, the zoning administrator may find that there Is an abandoned vehicle and order it abated and/or removed as a public nuisance and disposed of as hereinafter provided and determine the cost of abatement to be charged against the landowner. The order requiring removal shall include a description of the abandoned vehicle and the correct identification number and license number of the vehicle If available. (b) If it is determined at the hearing that the vehicle was placed on the land without the consent of the landowner and that he or she has not subsequently acquiesced In its presence,the zoning administrator shall not assess the cost of abatement(administration and removal) against the property upon which the vehicle Is located or otherwise attempt to collect such costs from such.landowner. (Orris. 95-=§4, 86-58 S3, 77-112.) 430-8.012 Notice of Decision. If an interested party makes a written presentation to the zoning administrator but does not appear, he or she shall be notified in writing of the decision. (Ords. 95. 4, 86-58 §3, 77-112.) 430.8.014 Appeals. (a) The enforcement officer, the landowner, any known possessor of the parcel or the vehicle owner may appeal the zoning administrator's decision by filing a written notice of appeal within ten calendar days after his or her decision. The zoning administrator shall promptly transmit the proceedings to the Board +, of Supervisors. (b) The Board's clerk shall promptly give written notice of the time and place of the hearing to the appellant and those persons specified in Section 430-6.006(a). (c) The Board shall promptly hear such appeal, and may affirm, amend, or reverse the order, or take other action it deems appropriate. It shall not be limited by the technical rules of evidence. (Ords. 95-_2_§4, 86-58 §3, 77-112.) SECTION V. Section 430-10.004 of the County Ordinance Code is amended to delete the reference to the "Director of Building Inspection" and to substitute "enforcement officer." to read: 430-10.004 Notify D.M.V. Within five days after removal of an abandoned vehicle, the enforcement officer shall so notify the Department of Motor Vehicles, identifying the vehicle or parts, and send it any evidence of registration available including registration certificates, certificates of title and license plates. (Ords. 95-=§5, 86-58 63, 77-112: Vehicle Code §22661). SECTION VI. Section 430-10.006 of the County Ordinance Code is amended to delete the reference to the "Director of Building Inspection" and to substitute "enforcement officer", to read: 430-10.006 Cost Record. The enforcement officer shall prepare an Itemized written account of his or her expenses Incurred to abate the nuisance where it is proposed to collect costs pursuant to Chapter 430-12. Until such report is completed, no abatement costs (including administration)will be placed as a special assessment against the parcel of land. (Ords. 95-=§7, 86-58 §3, 77-112.) SECTION VII. Section 430-12.004 of the County Ordinance Code Is amended to delete the reference to the "Director of Building Inspection" to "enforcement officer," to read: 430-12.004 Notice of Assessment. Dear Contra Costa County Board of Supervisors: I am writing this regarding a matter that will appear on the April 22 agenda. This concerns my property. I asked for more time to attempt to fix the cars, or get rid of them if my one grandson's thought they were not worth anything. I have also been trying to clean up my property, even though it has been slow, especially with the cold, rainy weather. I will acknowledge this. But more time was denied me, no doubt because of the troublemaking renter who lives next door to me. I want the Board to know that the homeowner of the property at 1255 Juanita Dr. , Janette Buchman, had no idea that her tenants were causing the problems they have. She was appalled to learn that "Mike" Prodromos Stephanos circulated a petition against me. As she said, "If people had a problem, why don't they talk about it first?" She does NOT condone anything her tenant has done! As she suggested, it sounds like a personal vendetta against us. Mr. Stephanos has lied about many things, probably to many people. He can be charming, pleasant and nice. But so was Ted Bundy -- a serial killer. I have come to know the tenant next door as a master manipulator and liar. He has been threatening, menacing, and harassing of my daughter and myself. As a Deputy in the Sheriff 's Department said, it is probably because we have no man around who can sand up to him. ' We have been forced to seek a restraining order against him. He claims that my property is the reason why Janette's house won't sell. According to Janette (the homeowner) , there are structural problems with the foundation that need repair. Additionally, people are frightened by the possible health problems of living next to a high voltage transmission tower carrying high voltage lines next to the house. Whether there are problems with electrical magnetic fields, especially in young children remains to be seen. Mr. Stephanos even told my daughter in March, 1996, that the house was slipping off its foundation, which is not true, according to Janette, the homeowner. Some of the other lies Mr. Stephanos has told: - There has been a survey of the property?. According to the homeowner, no survey has taken place. - He first rented the property in September, 1995 . Not true! According to Janette, he first rented the property in August, 19951 He may have still been moving in in September, but he was living there in August, 1995. - That he intends to purchase the house. As Janette said, "Why hasn't he made an offer to me?" It was news to her. She doesn't think they are interested in it. He tried to tell me that my daughter was the hostile one in an exchange that took place between them, when in fact, I was behind the trailer listening, and he was the hostile one. Mr. Stephanos has had plenty of county contact within the Sheriff 's Department, the Building Inspection Department, etc. He has plenty of time on his hands to call, and go over to Martinez. He has used county resources to wage a personal attack on my daughter and myself. I have never received all the letters that are in the file in the Building Inspection Department. If they were so important, then I think they all should be sent certified mail with return receipt. And the same is true for the Sheriff 's Department. There have been incidents that we receive other people's mail, and don't always get ours. I realize I keep too much. Please realize it is a "problem" that many of us elderly people who grew up in the .Depression and had nothing, or very little. I am trying to take care of the problem with the help of my daughter but we both have health problems that limit our energy and stamina. I will not go into our different health problems since I understand this letter becomes public record. I don't think it is everyone's business. My daughter has shared this information verbally with Mr. John Gregory, Mr: Mike Eisenberg and Mr. Larry Hogan. They are aware of our disabilities. Due to my disabilities, I have not been able to take care of things like I used to. But that I have made an effort, and will continue to do so, should indicate to the Board that I am trying to cooperate with the county. I feel as though I am being discriminated against by Contra Costa County. I have given photos to Supervisors Gayle Uilkema and Mark DeSaulnier of visible automobiles etc. within a one mile radius of my home. All of these have been sitting there for nine months or more. My purpose in presenting these photos is not to get other people in trouble, but to show the unequal enforcement of the ordinances. In fact, two of the signers on the petition circulated by Mr. Stephanos had a car on the public street for over 10 months. The Sheriff 's Department would have to drive right pass it, and they never did anything to it, even though it was never moved off the public street. Mr. Stephanos has repeatedly illegally trespassed onto my property, including taking pictures of my property on my property. He also has illegally run a food brokerage business from his home without the proper business license until 7/23/96. Nor has he ever secured the proper permit necessary even though when he came in for his business license he was told he needed to check with the Community Development Department. Being in the food brokerage business, I could see where he would be concerned about vector control. My daughter has consistently baited our ivy with rat poison. However, there are plenty of junipers in the neighborhood where wood rats make their nests, including some junipers and ivy at 1255 Juanita Drive. In addition, the neighbor across the street at 1276 Juanita only recently removed large, massive piles of wood, tree trimmings, etc. that has been sitting there for the past 6 to 7 months. The neighbors on the other side of me have large piles of wood, etc. in their backyard on the hill behind the granny unit that was built. Additionally, they used to have chickens but I haven't heard them lately, so they may no longer have them. It is sad for me, this matter has gotten this far. I realize Mr. Stephanos has a friend in the fire department, and he obviously not only knows how to successfully manipulate the system, but has done so for a personal vendetta. In addition, he has the time and energy to do it. How wonderful it would be to be young and healthy again. I certainly would use my youthful energy to help people instead of what he has done. I would offer to help an elderly neighbor. I have been a hard working taxpayer and property owner in Contra Costa County for over 50 years. My husband died leaving me with four young children (the youngest was only 5 months old) to raise on my own. I never was on welfare. I have always worked hard and continue to try to, given my disabilities. I am dismayed and distressed that I never received all the letters purportedly sent by the county agencies; that the county is taking an adversarial position; and the fact of my age, disabilities and limited resources have not been taken into account by the county. Depending on the Board's action on 4/22 , 1 may seek legal action against Contra Costa County. I don't want to do this, but at this point in time, I feel like you have left me with no alternatives.
