Uilkema, Chair —� Supervisor Joe Canciarnilla Costa DATE: April 22, 1997 Wuqy SUBJECT: REPORT FROM WATER COMMITTEE ON CONSULTANT CONTRACTS FOR PHASE III BALDWIN SHIP CHANNEL/MARINE PIPELINE LINK AND SOUTHAMPTON SHOAL PROJECTS SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. AUTHORIZE the Director of the Community Development Department to execute a County contract with Mike Cheney (Maritime Engineering Consultant), for up to $30,000 for 1997. 2. AUTHORIZE $15,000 of Water Agency funds to be added to the County contract with Mike Cheney to cover project duties requested by the County. (10,000 was added to this contract in 1996) 3. AUTHORIZE the Director of the Community Development Department to execute a County contract with E. Del Smith (Lobbyist) for $20,000 for 1997. FISCAL IMPACT The $20,000 associated with E. Del Smith's contract, and $20,000 of Mike Cheney's contract are paid by the Ship Channel Users (the project beneficiaries, or ship channel users are Exxon, Tosco, and Wickland oil industries). Up to $15,000 for Mike Cheney's contract can be paid by the County Water Agency, to subsidize the very important additional project engineering component Mr. Cheney provides for the County. REASONS FOR RECOMMENDATION The third phase of the San Francisco-to-Stockton Ship Channel (Baldwin) Project and Marine Pipeline Link is underway. Much work has been done by the County (local sponsor) and the Corp of Engineers (Lead Agency) on this project to date. A combined Environmental Impact Statement/Report is being prepared and will be out later this year. Both ship channel dredging and pipeline transportation alternatives are being considered. There are a number of issues outstanding with inclusion of the newer, pipeline alternative which are being addressed at both the local and federal levels. A number of issues remain to be worked out prior to construction of this project in 1998. In early 1996 and 1997 the Ship Channel users once again determined the need for continuation of Mike Cheney's and Del Smith's contracts. Mike Cheney's involvement is becoming increasingly important as a necessary engineering component for the County, thus necessitating funds by the Water Agency to cover Mike's additional time on this project. I u JJJ1G77 r.Wr- ' SCOPE OF CONSULTANT SERVICCEES„FOR JFB CHANNEL DEEPENING PROJECT The purpose of the John F.Baldwin(JFB)aba=mel deepening project is to provide improved access to the refries of Contra Costa and Solano Counties by vessels requiring s channel depth of-45 it.(mllw).Determination of project feasibility(including compliance with Federal and State laws,regalations and permit requirentaftX preparation of pre-consRriaction engineering and design(PID)and construction of the project are being carried out primarily by the U. S.Army Corps of FASInem(Corps). The project was authorized by Congress,which directed that the project be carried out by the Corps in conjunction with a local non-Federal authority or Local Sponsor,in this case,Contra Costa County(County).By agreement,the Corps and the County each have responsibilities in . . emeuting the project.Generally,the County's responsibilities include overall project coordination and administration,attendance at and participation in periodic milestone conferences,reviewing all Corps project work,snaking any allowable project change's that would increase project benefits to the County,providing rcicvant project data required by the Carps,providing and administering agreed upon portions of the work("iniad services")and project liaison and advocacy. Because this is a Federal project,it is subject to and dependent upon the Congressional authorization W annual appropriation process.In practical terms.this means that the Corps cannot work on the various phases of the project without specific authorization from the House Transportation and InSastruet m Committee(with concurrence firm the Senate)and an annual appropriation of the necessary funds from the House Energy and Water Appropriations Subcommittee(again,with concurra=ftom the Semite). Since there are many Federal projects with many Local Sponsors and available fimds are insufficient to service all the proposed and on-going projects,project advocacy in Washington,DC by the County is vital to the successful conduct and completion of the project.(the Corps is forbidden from specific project advocacy).' The County has met its project respos&Rdities by assigning a County Project Coordinator (Roberta Goulart)and retaining an experi meed local Consulting Engineer(Mike Cheney)and an wgxnienced Washington lobbyist(Del Smith).The services provided by Smith and Cheney for the project are listed below. 0=PBQVPED BY CHENEY: Generally,Cheney works with Goulart and the San Francisco District office of the Corps (where the project work is actually done),the Corps Division office(which provides project review and oversight)and the Corps Headquarters staff(which approves the project).Cheriey also works directly with Smith and the project beneficiaries(oil companies).
