Introduce an ordinance of the County of Contra Costa, repealing Ordinance 94- 27 and adopting new policies, purposes, goals and objectives for Transportation Systems Management (Exhibit A), waive first reading, and set May 6, 1997 for adoption. 2. Accept annual report on County Employee TSM Program FISCAL IMPACT None to County General Fund. The costs of administering the transportation systems management (TSM) program are funded by Measure C return-to-source funds. Until 1995, these programs consisted of trip reduction ordinances, which required employers of 100 or more employees to conduct annual surveys of their employees and to implement programs to promote the use of alternative modes of transportation by their employees. These local ordinances were also used to implement the Bay Area Air Quality Management District's Trip Reduction Regulation, which was intended to improve air quality. Senate Bill 437, which became effective on January 1 , 1996, prohibits mandatory employer-based trip reduction programs. As a result, the Air District suspended its program. In order to comply with Measure C and the Congestion Management Program without violating SB 437, the Contra Costa Transportation Authority developed a new model TSM ordinance which expresses the jurisdictions' committment to reducing vehicle trips and traffic congestion, and establishes goals and objectives for voluntary TSM efforts. Adoption of the ordinance will be a condition for receiving Measure C return to source funds in the future. The County Counsel's office has reviewed the ordinance and has modified it slightly to be applicable to the County. ANNUAL REPORT ON COUNTY EMPLOYEE TSM PROGRAM G Each year the Community Development Department submits a report to the Board of Supervisors on the status of the County Employee TSM Program. As one of the largest employers in Contra Costa, the County had previously been required by the Bay Area Air Quality Management District (BAAQMD), Measure C (1988) and the state-mandated Congestion Management Program to participate in programs to help its employees find alternatives to driving alone to work. As indicated above, these requirements were voided in 1996 by the passage of state legislation. However, the Board of Supervisors in 1996 reiterated its support for continuing to offer these programs to County employees on a voluntary basis. During 1996, the County launched the GO BIKE!program, which is funded by grants and is directed at expanding the opportunities for bicycle transportation in the County. The program is staffed by two contract employees housed in County offices. While the program is directed at increasing bicycle use among all residents and employees in the County, it also benefits County employees. Among the activities of this program which benefit County employees are the provision of bicycle parking facilities at County offices, the placement of destination signs on bikeway routes, and the acquisition of funding to develop a comprehensive bicycle circulation system in the County. In previous years, the Board has taken a number of actions which together comprise the County Employee TSM Program. The Board has authorized use of County vehicles as carpools, flexible work schedules, preferred parking for carpools and designation of on-site employee transportation coordinators at County work sites, which serve as a conduit for information on commute alternatives. In 1995, the Board adopted a policy allowing County employees to telecommute, subject to the approval of their departments. The County has obtained grants to fund the purchase of four vans for employee vanpools and for acquisition of equipment for the pilot telecommuting program. The Community Development Department manages the Employee TSM program. Staff will continue these programs during 1997, subject to the Board's concurrence. The effectiveness of these programs is reflected on Exhibit B, which summarizes the results of the 1995 employee transportation survey at work sites of 100 or more employees. The total number of employees at these 14 work sites was 2325. The percentage of employees using alternatives to driving alone in that survey ranged from 37% to 11 %. As indicated in the table, carpooling was the most popular alternative mode of transportation to work. Q ! • EXHIBIT A ORDINANCE NO. 97- (AN ORDINANCE OF THE COUNTY OF CONTRA COSTA REPEALING ORDINANCE NUMBER 94-27, AND ADOPTING NEW POLICIES, PURPOSES, GOALS AND OBJECTIVES FOR TRANSPORTATION SYSTEMS MANAGEMENT) The Board of Supervisors of the County of Contra Costa ordains as follows: SECTION I. BACKGROUND. Pursuant to the requirements of Contra Costa County Measure C on the 1988 General Ballot, each jurisdiction within Contra Costa County was required, as a condition of receiving Local Street Maintenance and Improvement funds from the one-half cent sales tax imposed by Measure C, to adopt a Transportation Systems Management ("TSM") Ordinance or other mitigation measures to promote the use of carpools, vanpools, and park and ride lots. Pursuant to the Measure C requirement, the Contra Costa Transportation Authority (the "Authority") drafted and adopted a model TSM Ordinance for use by local jurisdictions in developing local ordinances for adoption and implementation. In 1989 the California Legislature enacted amendments to the California Government Code imposing separate requirements under the Congestion Management Programs for local jurisdictions to adopt trip reduction and travel demand ordinances. Pursuant to such requirements, the Authority revised its model TSM Ordinance to incorporate trip reduction and travel demand requirements. The County of Contra Costa adopted Ordinance No. 94-27 on April 19, 1994 (the Transportation Demand Management ("TDM") Ordinance), which required participation by employers in trip reduction programs. In 1994 the County of Contra Costa assigned the implementation of the ordinance to the Regional Transportation Planning Committees in order to more consistently comply with multiple legislative mandates requiring trip reduction ordinances and programs. The California Legislature in 1995 passed legislation prohibiting local jurisdictions from enforcing mandatory employer trip reduction programs. o i s 1 ' The jurisdictions of Contra Costa County, working through the Contra Costa Transportation Authority, have decided to continue voluntary trip reduction programs, and to formalize these arrangements in an ordinance. The County of Contra Costa intends to continue its participation in the TSM Programs managed by the Regional Transportation Planning Committees. SECTION II. FINDINGS. A. Transportation Systems Management has the potential to reduce vehicle trips and vehicle emissions more efficiently and cost-effectively than major roadway improvements. B. Since 1992, the Authority has committed both Measure C and Transportation Fund for Clean Air ("TFCA") funds to the four Regional Transportation Planning Committees for the attainment of Measure C and Clean Air Plan goals. C. In compliance with the requirements of the TDM Ordinance, large employers were required to develop and implement trip reduction programs at work sites and, implementation of the TDM Ordinance was delegated to the four Regional Transportation Planning Committees. D. The Countywide Comprehensive Transportation Plan adopted by the Contra Costa Transportation Authority incorporates each Regional Transportation Planning Committee's Action Plan for Routes of Regional Significance, which includes specific TSM/TDM goals and objectives. E. Over the past four years, the County has worked with the four regional TDM programs to reduce vehicular trips and emissions at employment sites as required by the TDM Ordinance, as well as in school and residential areas where programs have been implemented. F. Since 1994, TDM efforts have been expanded to include programs covering aspects of the transportation system in addition to employer programs, including enhancement of transit and bicycle facilities, residential and commuter transit incentive promotions, incorporation of new technologies such as Intelligent Transportation Systems (ITS) and strategies such as Early Deployment Program (EDP), expanded school ridematching outreach to include all schools and community colleges in Contra Costa, and land use policy coordination and related enhancements. G. The County acknowledges that cooperation with other local jurisdictions and regions has the potential to enhance the efficiency and cost-effectiveness of these Ord. No. 97- - 2 - n s efforts; accordingly, the Board of Supervisors directs staff to take steps to implement TSM measures in accordance with the policies, goals and objectives set forth herein, and in cooperation with the Regional Transportation Planning Committees. SECTION III. REPEAL OF TDM ORDINANCE. Ordinance No. 94-27 is hereby repealed. SECTION IV. ADOPTION OF A NEW TSM PURPOSES, GOALS AND OBJECTIVES. A. The following purposes, goals and objectives are adopted in order to assist staff in the implementation of TSM programs: L To promote maximum efficiency in the existing transportation system and to further the transportation goals of the Measure C Growth Management Program, Contra Costa's Congestion Management Program and the Bay Area Clean Air Plan by: (a) Promoting and encouraging the use of transit, ridesharing, bicycling, walking, flexible work hours, compressed work week schedules, and telecommuting as alternatives to driving alone to work; (b) Incorporating these goals and objectives into the land use review and planning process; (c) Developing proactive programs and/or projects either alone or in conjunction with other jurisdictions aimed at achieving these goals; (d) Considering the incorporation of appropriate technology designed to facilitate traffic flow, provide transit and highway information, provide transportation alternatives, and related technology into the transportation system; (e) Educating County employees, employers, residents and students regarding the benefits and availability of commute alternatives; (f) Working with transit agencies to better serve Contra Costa County residents; Ord. No. 97- - 3 - (g) Encouraging the most cost-effective, broad-based and wide range of transportation improvement projects aimed at achieving congestion relief; and (h) Cooperating with other jurisdictions, the private sector, and transit operators in planning and implementing transportation programs. 2. To reflect an ongoing commitment to expand TSM efforts beyond employer-based trip reduction programs, in order to achieve traffic congestion management and air quality goals; and 3. To comply with applicable state and federal laws as well as with Measure C Growth Management Program requirements pertaining to TSM. B. The goal of this ordinance is to ensure the continuation of a proactive TSM program effort aimed at reducing vehicle trips, vehicle emissions and traffic congestion in the most efficient and cost-effective manner possible. C. The objective of this ordinance is to establish the following policies: 1. To participate, in conjunction with other jurisdictions and in a proactive effort to support and develop projects which will achieve the Measure C TSM/TDM goals as described in the Action Plans of the Regional Transportation Planning Committees, the Countywide Comprehensive Transportation Plan, the Measure C Strategic Plan, the Congestion Management Plan and/or the Bay Area Clean Air Plan. Such participation may include, but need not be limited to: (a) Promotion and encouragement of the use of transit, ridesharing, bicycling, walking, flexible work hours, compressed work week schedules, telecommuting and other alternatives to driving alone to work; and (b) Adoption of projects incorporating appropriate technology designed to facilitate traffic flow, provide transit and highway information and related technology; and 2. To incorporate these goals, objectives and policies as appropriate, into the land use review and planning process. Ord. No. 97- - 4 - d / • . I SECTION V. EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and within 15 days after passage shall be published once with the names of the Supervisors voting for and against it in the Contra Costa Times, a newspaper published in this County.
