SUBJECT: BIRD CONSERVATION FROM THE KELLER CANYON LANDFILL
MITIGATION FUND

RECOMMENDATION:
AMEND the report of the Internal Operations Committee on the funding request from
Advocates for Bird Conservation approved by the Board of Supervisors on May 14,
1996 to include authorization for a second year grant in the amount of $10,000 for
the 1996-97 fiscal year.
BACKGROUND:
On May 14, 1996, the Board of Supervisors approved a report from the 1996 Internal
Operations Committee dated May 6, 1996 which recommended that Advocates for
Bird Conservation be approved for a grant in the amount of $10,000 for the 1995-96
fiscal year for the purposes outlined in their grant application which was attached to
the Committee report.
It had been the intent to approve the grant for an additional $10,000 for the 1996-97
fiscal year. Unfortunately, this recommendation was not included in the Committee's
report. It is, therefore, recommended that the Board at this time clarify that it was
intended that a second year grant be approved for the 1996-97 fiscal year. The
funds are appropriated for this purpose, but the Auditor-Controller needs Board
authorization to issue the funds since the Committee report did not include the
second year of funding.

1. APPROVE the request from Advocates for Bird Conservation for a grant in the

attached grant applicatien:-

BACKGROUND:
On December 19, 1995, the Board of Supervisors referred to our Committee the
request from Advocates for Bird Conservation for $10,000 from the Keller Canyon
Landfill Mitigation fund to further their avian sciences education program in the
schools in East County and to assist in preparing other funding applications.
Our Committee met with Al McNabney and Laurella Desborough from Advocates for
Bird Conservation on May 6, 1996, and reviewed their application with them. A copy
of their application is attached to our Committee report.
We are advised that funding is available for this purpose. The project seems a
worthy and needed one and is consistent with the purposes for which the Keller
Canyon Landfill Mitigation funds can be spent.
We are, therefore, recommending that the Board allocate $10,000 for this purpose
for the 1995-96 fiscal year.

Pat Monas As pointed out in the grant request, forwarded herewith ABC
ABird Attaire acted to make available an environmental/education program in
San Francisco eastern Contra Costa County. The program, involving 29 specific

Aviculturist estimates the program will involve as many as 1500 children.
Additionally ABC has worked out an arrangement with the
Ironhouse Sanitation District which will make land available for
aviaries and headquarters.
Advisory As indicated in the attached Grant request, ABC is finalizing
Board negotiations so curricula for a comprehensive Avian Sciences
education and training program can be developed. The
Luis Baptista,Ph.D, arrangements are essentially complete. They should be finalized
Dept.of Ornithology shortly after the first of next year.

BIOGRAPHICAL SKETCH:
Brian Speer is partner and owner of two private practices in the eastern
part of Contra Costa County, where he has limited his personal case load
exclusively to birds since 1989. Dr. Speer is active in the Association of Avian
Veterinarians (AAV), where he chairs the Aviculture Committee and serves on
the board of scientific editors for the Journal of the Association of Avian
Veterinarians. He is an active member of the American Ostrich Association, where
he has spoken at their annual, midyear and regional meetings in past years.
Dr. Speer currently serves as a sub-chair of the medical research camiitte for
the American Ostrich Association and serves on the board of directors of the
Model Aviculture Program, an inspection and certification program. Dr. Speer
has spoken at both national and international meetings of bird breeders and
avian veterinarians. Dr. Speer has a particular interest and dedication to
aviculture and avicultural medical management. He owns and maintains a breeding
flock of macaws and owns Ratite Incubation and Hatching Services, which provides
incubation and hatching service for ostrich, emu, rhea and cassoway clients.

RECOMMENDATIONS:
1. APPROVE recommendations from the Finance Committee for budgeting Keller Canyon
mitigation monies in fiscal years 1995-96 and 1996-97.
2. REQUEST staff to report back to the Finance Committee expenditure plans for all projects
with prior year unspent mitigation funds no later than February 1, 1996, for allocation to the
Cc ,amunity mitigation category.
3. REFER the funding request from the Advocates for Bird Conservation to the Internal
Operations Committee.
4. EXPAND the purpose of the Agriculture Trust Fund to Agriculture Soils and Open Space
Trust to allow for expenditures other than the purchase of land.
BACKGROUND:
On October 17, the Board designated the Finance Committee with overall responsibility for
preparing budget recommendations for Keller Canyon and Acme Transfer Station revenues. The
planning committees who were assigned the responsibility of formulating plans for mitigation funds
have completed their work and their recommendations appear in Attachment A.

The task before the Finance Committee on December 18 was to review each plan and adopt an
overall priority strudture for this and next fiscal year. Attachment B presents a list of programs and
revenue estimates for Committee reference.
The Committee heard testimony from staff and applicants and made the following modifications to
the planning committee's recommendations:
1) transfer$64,000 from the Transportation Category to the Community Mitigation category;
2) delete $15,000 from the Wetlands mitigation program in the Open Space. Category in 1995-
96 and 1996-97 and request the Internal Operations Committee consider a $10,000 program
from the advocates for Bird Conservation; and
3) transfer any funds available in the Open Space category, after considering the Advocates for
Bird Conservation, to the Community Mitigation category.
Additionally,,staff has identified some unspent monies from fiscal year 1994-95 and prior years. For
example, a total of $52,600 in unspent monies currently resides with contracts in the Host
Community mitigation category. The Committee recommended that staff develop an expenditure
plan for such contracts by February. The Committee determined that all unspent monies should be
allocated to the Community Mitigation category.

BACKGROUND/REASON(S) FOR RECOMMENDATION(S),
On July 16, the Board of Supervisors referred to the Finance Committee, the issue of recommending
program reductions caused by the transfer of$426,000 in Keller Canyon Landfill revenue to the City
of Pittsburg in 1997-98. The Finance Committee and the East Bay Regional Park Liaison Committee
met jointly on August 5 to discuss future program funding and service delivery issues.; Also,
representatives from the seven projects in the "Open Space" category were present to answer
questions about their projects. The Committee made initial recommendations on the program
prioritizing procep and recommended further meetings to discuss programs in the "Transportation"
and "Community" categories. The Committee directed staff to plan and organize a September
meeting in Pittsburg with City and School District officials to advise them of County efforts and to
discuss potential program partnerships.

RECOMMENDATIONS:
1. ACKNOWLEDGE that City of Pittsburg officials are aware of the County's intent to
eliminate funding for those programs receiving Keller Canyon Revenues which
serve Pittsburg residents only beginning in fiscal year 1997-98.
2. ACKNOWLEDGE that City of Pittsburg officials are aware of the County's intent to
reduce or eliminate funding for those Keller financed programs which serve both
Pittsburg and Bay Point residents beginning in fiscal year 1997-98.
3. ADOPT a new planning process for allocating 1997-98 Keller Canyon Funds which
combines activities with the allocation of Community Development Block Grant
Funds and which will be conducted in April and May of 1997.
4. REQUEST the General Services Department to contact the Pittsburg Unified School
District to determine if the District wishes to participate in the litter clean-up program.
5. REQUEST the staff of the Building Inspection Department to increase
communication with the City of Pittsburg's Building Inspection officials and
exchange information on code enforcement problems and activities.

BACKGROUND:

On September 16, the Finance Committee met in Pittsburg to discuss County and City
issues involving Keller Canyon Landfill revenues. Representatives from the City included
the Mayor, City Manager and a Building Inspection official. Representatives from the
County included officials from the General Services, Building Inspection, Community
Development and County Administrator Departments. The Committee reviewed the written
materials and solicited information from City and County officials and formulated
recommendations. The Committee encouraged the City and County staff to work closer
together in the future.
The Committee agreed that future meetings were needed to complete the overall Keller
Canyon program reduction plan for 1997-98.

BACKGROUND/REASON(S) FOR RECOMMENDATION($):
On October 2, 1995, the Finance Committee directed the Community Development Department to
solicit proposals for Host Community Mitigation funds for fiscal years 1995-96 and 1996-97. On
February 5, the Finance Committee conducted a first screening of the proposals. On February 26,
the Committee reviewed the projects for a second time and took 1'/s hours of testimony from
applicants.

Applicants requested a total of$1,256,474, while staff advised that a total of$340,000 was available
over the two fiscal years, The available funding is composed of$80,000 in appropriations for fiscal
year 1995-96, $160,000 for 1996-97 and an estimated $100,000 in carry forward monies.
The attached list presents the Committee recommendations relating to allocations for both fiscal
years. Also, their are specific recommendations for reprogramming prior year monies and contingent
allocation of monies. Finally, attached is a letter from the Ambrose Recreation and Park District
outlining a joint venture with the Mt. Diablo Unified School District using Keller Canyon Open Space
mitigation monies.

ADDENDUM
Supervisors Torlakson and DeSaulnier delivered the Finance Committee report
and recommendations to the Board regarding the allocation of Keller Canyon
Revenues for Host Community Mitigation Programs for Fiscal Years 1995-96
and 1996-97.
Supervisors Torlakson and DeSaulnier moved and seconded the Finance
Committee report and recommendations.
Supervisor 7irlakson advised that on Line No. 22, in the Contingency Recomm.
Column of the Project Allocation Chart (Attached), that there was an amount
of $4,000 missing and requested that the Clerk of the Board take note of the
correction.
Regarding the funds allocated to American Legion Post #151 , Row No. 19 on
the Project Allocation Chart (Attached), Supervisor Torlakson further moved
that the Board of Supervisors write a letter to the City of Pittsburg formally
indicating that the County is committing $70,000 to the veterans building
repair project; and that the letter should communicate that the Board of
Supervisors urges the City of Pittsburg to join the County in giving financial
support to the veterans in East County for the repair of the veterans building
and ultimately to support the funding of a decent and deserving war memorial;
and that the letter should indicate that the Board of Supervisors suggests that
the City, of Pittsburg explore securing funds for the veterans building project
through redevelopment and a Community Housing Development Block Grant.
Supervisor Smith.then opened the floor for public comment on the matter and
the following persons addressed the Board:
1 . Ben Johnson, American Legion Veterans Administration Group,
1120 Laurel Street, Pittsburg, CA, 94565.
2. Patti Lambert, Ambrose Recreation and Park District, 3105 Willow
Pass Road, Bay Point, CA, 94565.
3. Rich Clarke, Mt. Diablo Unified School District, 215 Pacifica, Bay
Point, CA 94565.
Public Comment was concluded after all persons desiring to address the Board
on this matter were heard.
Supervisor Bishop acknowledged the difficult decisions that the Finance
Committee made when they received $ 1 ,200,540 in requests and only had
$ 180,000 at their disposal to allocate and praised the Finance Committee for
their efforts. However, Supervisor Bishop advised the Board that her office
had received a substantial amount of mail with respect to the Lions Blind
Center requesting an additional $5,000 from the Keller Canyon Revenues for
Host Community Mitigation Programs. Supervisor Bishop expressed concern
that there may need to be more equitable distribution of funds to seniors and
made a recommendation to the Finance Committee members that they allocate
an additional $5,000 to the Lions Blind Center.
Supervisor Bishop also commented on the importance of funding prevention
programs because they stress education and making people, especially
youngsters, aware of alternative lifestyles and alternative conflict resolution.
Supervisor Rogers thanked the Finance Committee for its work and well
thought out recommendations. Supervisor Rogers stated that he thought
Supervisor Bishop's comments were on target and pointed out the tough
choices that the Finance Committee had to make.
Supervisor Smith called for any other amendments or comments from Board
members.
Supervisor Torl akson amended his motion to include allocating $5,000 to the
Lions Blind Center contingent upon additional monies that may be generated
for allocation through tonnage and revenue (Line #2, in the Contingency
Recomm. Column of the Project Allocation Chart - Attached) .
Supervisor Aorlakson further amended his motion by adding a fourth
recommendation to formally refer the Veterans Building issue in Pittsburg to
the Finance Committee and authorize the Finance Committee to send letters
to the City of Pittsburg indicating the County's support for the veterans'
efforts and asking the city to consider joining the County in supporting the
veterans' efforts through redevelopment, community block grant and other
funds that the city has access to.
Supervisor Torlakson further amended his motion by correcting
recommendation number 2 by stating that the joint program referenced is the
Outdoor Environmental and Recreational Program for Youth.
Supervisor DeSaulnier accepted the amendments made to the motion.
IT IS BY THE BOARD ORDERED that the Finance Committee report on the
Allocation of Keller Canyon Revenues for Host Community Mitigation Programs
for Fiscal Years 1995-96 and 1996-97 is ACCEPTED with the following
amendments: ADD $4,000 on Line #22 of the Contingency Recomm. Column
on the Project Allocation Chart (Attached); ALLOCATE $5,000 to the Lions
Blind Center contingent upon additional monies that may be generated and add
the $5,000 to Line #2 of the Contingency Recomm. Column of the Project
Allocation Chart (Attached) .
IT IS FURTHER ORDERED BY THE BOARD that a fourth Recommendation is
added to REFER the Veterans Building issue in Pittsburg to the Finance
Committee and AUTHORIZE the Finance Committee to send letters to the City
of Pittsburg indicating the County's support for the veterans' efforts and
asking the city to consider joining the County in supporting the veterans'
efforts through redevelopment, community block grants and other funds that
the City of Pittsburg may have available.
IT IS FURTHER ORDERED BY THE BOARD that the joint program referenced in
Recommendation Number 2 is CORRECTED to by called the Outdoor
