HomeMy WebLinkAboutMINUTES - 04221997 - C19 BOARD OF SUPERVISORS r Contra FROM: PHIL BATCHELOR, COUNTY ADMINISTRATOR Costa DATE: APRIL 22, 1997 County SUBJECT: INTRODUCTION OF ORDINANCE MAKING GOVERNMENT CODE SECTION 68456 EFFECTIVE IN CONTRA COSTA COUNTY SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I RECOMMENDATION: INTRODUCE an Ordinance making Government Code Section 68546 effective in Contra Costa County to provide for additional pay for Clerks of Municipal Courts while acting as Courtroom Clerks of the Superior Court. BACKGROUND: Government Code Section 68546 provides that a Municipal Court Judge in a County assigned to sit on the Superior Court of the same County may assign the Deputy Clerk of the Municipal Court from which that Judge is assigned to act as a Deputy Clerk for the Superior Court during the same period. During the period assigned, the Deputy Clerk shall receive the same salary as a Deputy Clerk of the Superior Court. The past practice ,has been to pay Municipal Court Clerks a per diem for days in which they actually sat as Superior Courtroom Clerks. The adoption of the Ordinance will allow Municipal Court Clerks who serve as Superior Court Clerks when a Judge from the same Municipal Court is assigned to the Superior Court to be paid the same salary as Superior Court Clerks for the entire time they are assigned to the Superior Court. CC: 0_1\0 ATTESTED Phil MAW, Clerk of th Board of Scoervisorsand County Administrator M382/7-83 BY DEPUTY ORDINANCE N0. 97- (Making Government Code section 68546 Effective in Contra Costa County) The Contra Costa County Board of Supervisors ordains as follows(omitting the parenthetical footnotes from the official text of the enacted or amended provisions of the County Ordinance Code): SECTION I: Division 36,Compensation,Chapter 36-2, Section 36-2.002 is added to the County Ordinance Code to make Government Code section 68546 effective in Contra Costa County to provide for additional pay for clerks of the municipal courts while acting as courtroom clerks of the superior court to read: Division 36, Compensation. Chapter 36-2. Courtroom Clerks 36-2.002 The provisions of section 68546 of the Government Code are made effective in this county. (Ord. 97-_, § 1.) SECTION II: EFFECTIVE DATE. This ordinance becomes effective 30 days after passage, and within 15 days of passage shall be published once with the names of the supervisors voting for and against it in the a newspaper published in this County.
