MICHAEL WALFORD, PUBLIC WORKS DIRECTOR DATE: APRIL 22, 1997 SUBJECT: AUTHORIZE INITIATION OF AN ANNUAL ASSESSMENT PROCEEDING IN THE BAY POINT COMMUNITY FOR LANDSCAPE ASSESSMENTS PURSUANT TO PROPOSI- TION 218, BAY POINT AREA (WO 5426) Specific Request(s)or Recommendation(s)&Background&Justification I Recommended Action: A. AUTHORIZE a mail-in ballot and related required actions to determine if the voting majority of property owners want to approve continuance of current assessments for park landscaping and maintenance (Countywide Landscape District AD 1973-2, LL-2, Zone 9) Bay Point area and DIRECT the Public Works Director to prepare the engineer's reports and the allocation of special assessments as required under Proposition 218. B. After completion of the report, DIRECT the Public Works Director to prepare and send Proposition 218 hearing notices to all property owners notifying them of a hearing at least forty-five (45) days after the report's completion and mailing of the notices before the Board of Supervisors. Property owner votes may be received at time of the hearing and before it is concluded. II. Financial Impact: The County currently collects an annual assessment of $219,900 for park landscaping and maintenance in Bay Point. Under Proposition 218, these assessments must be approved by the voters through a special tax election or an assessment mail-in property owner ballot procedure. Reasons for Recommendations and Background: At their regular meeting on Thursday, April 3, 1997, the Ambrose Recreation and Park District Board of Directors approved the County conducting a Mail-In Ballot in the Bay Point area to continue the existing assessments for park, median island and road side landscape improve- ments. The Ambrose Recreation and Park District Board had originally considered going to a General Election in November 1997 to seek approval for replacing the assessment revenue lost from the County as a result of Proposition 218. This, however, would cause Ambrose to loose assessment revenue for at least one year before they would have the opportunity to seek voter approval for a new assessment for the Ambrose Recreation and Park District. IV. Consequences of Negative Action: This action is requested by the Ambrose Recreation and Park District and the Bay Point Community. A no vote will direct staff to continue the preparation for a special tax election in June 1997.
