C.47 LETTER, dated April 4, 1997, from Margit Arambum, Executive Director, Delta
Protection Commission, 14215 River Road, Walnut Grove, CA 96590, advising of a new
regulation now a part of the Commission's Plan requiring new sewage treatment facilities
(including storage ponds) and area for disposal of sewage effluent and sewage sludge not
be located within the Delta Primary Zone; and of the need for all local governments to
submit to the Commission by August 26, 1997, proposed amendments to their general
plans to be consistent with the Commission's Plan.

Re: Redwood Trees Planted on Iron Horse Trail Behind Balha Property
Attached is a letter to Mrs. Linda Balha of 140 Wayland Way in Alamo regarding the
redwood trees she recently planted in the right-of-way along the Iron Horse Trail.
In December, 1996, Mrs. Balha and I had two phone conversations regarding the existence
of a pipeline belonging to Santa Fe Pacific Pipelines (SFPP) located in the right-of-way behind her
home. Mrs. Balha was concerned and upset that she had not been notified of the pipeline when she
purchased her home along the Iron Horse Trail. I answered her questions about the products being
transported in the pipeline and the safety measures that were in place to protect the pipe. Mrs.
Balha then informed me that the County was asking her to remove some trees she had planted
because they were endangering SFPP's pipeline. I agreed to have SFPP personnel inspect the trees
and they determined that the trees were not endangering the pipeline. Mrs. Balha requested a letter
from me confirming this determination. During our phone conversation, I told Mrs. Balha that I
could do nothing more than make a statement on whether or not the pipeline was endangered, and
that my letter would not address any other issues she may have with the County regarding the trees.
As I stated in my letter to Mrs. Balha, I apologize for any misconceptions my earlier letter
may have caused. Ms. Nancy Wenninger and the rest of the folks at the Public Works Department
have always been extremely helpful in our efforts to keep our pipelines operating safely, and we
want to continue that relationship. Please feel free to call me if you have any questions.

Dear Mrs. Balha:
Please refer to the letter I wrote to you on December 9, 1996 concerning redwood trees you
planted behind your property. The reason for writing this letter is to clarify Santa Fe Pacific
Pipelines' (SFPP) position regarding the trees.
As I stated in my letter, the trees are not in SFPP's easement area and are not presently
endangering the safety of the pipeline. As we discussed on the phone, however, my letter should
not have been construed to mean that SFPP was giving you permission to plant the trees. SFPP
must support Contra Costa County in its efforts to keep the right of way clear. As there are other
utilities in the County's right of way, it is important that the County keep the right of way clear of
obstacles that would obstruct access to the utilities' facilities. Also, the County may have plans for
using the right of way itself, and trees could interfere with that use.
I apologize for any misconceptions my earlier letter may have caused, but in this matter
SFPP must support the County's right to control its property. Please feel free to call me if you
have any questions.

Subject: Amendment to the Land Use and Resource Management Plan for the Primary Zone of the Delta
Honorable Members of the Board :
On January 28, 1997, the Office of Administrative Law approved the new regulation adopted by
the Delta Protection Commission and which is now a part of the Commission's Plan. That regulation has
the same language as Utilities and Infrastructure Policy P-3 on page I 1 of the Plan. The regulation states:
New sewage treatment facilities (including storage ponds) and areas for disposal of sewage effluent and
sewage sludge shall not be located within the Delta Primary Zone.
[Note: The Rio Vista project, as described in the adopted Final Environmental Impact Report for
such project, and the Ironhouse Sanitary District use of Jersey Island for disposal of treated
wastewater and biosolids are exempt from this policy.]
Under Section 29763, the Delta Protection Act requires that Within 180 days of the effective date
of any amendment to the Plan, all local governments shall submit to the Commission proposed
amendments which will cause their general plans to be consistent with the Commission's Plan. The
effective date of the regulation was February 27, 1997. The submittals are due to the Commission on
Tuesday, August 26, 1997.

SUBJECT: Indicate Agreement with Concept for Securing Land Rights for a Detention Basin at the Old
Pleasant Hill High School Site, Pleasant Hill
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)& BACKGROUND AND JUSTIFICATION
I. Recommended Action:
A INDICATE agreement with concepts outlined in attached letter by City of Pleasant Hill
dated March 21, 1997, for the Flood Control District to secure an easement over Mt. Diablo
School District property for a detention basin on Grayson Creek, east fork, east branch;
B AUTHORIZE the Chief Engineer to arrange with County Counsel for the preparation of a
right of way contract for formalizing said concepts for securing said basin site and to
complete the negotiation process with the School District.
C AUTHORIZE the Chair of the Board of Supervisors to sign the attached letter signifying
the Board's concurrence with the concepts presented therein.
Il. Financial Impact:
The easement acquisition cost of $1,200,000 for approximately twelve acres will be funded by
Flood Control Zone 3B and Drainage Area 46. An additional expenditure of $750,000 will occur
at the time of basin construction to install a subdrain to permit an active recreation use on the
basin floor of the old football field.

III. Reasons for Recommendations and Background:
Representatives of the Mt. Diablo School District, City of Pleasant Hill, Pleasant Hill Parks and
Recreation District, Flood Control District and Supervisor Mark DeSaulnier have been meeting
for several months to reach agreement on use concepts for the proposed basin site at Pleasant
Hill and to reach agreement on the purchase price for granting an easement to the Flood Control
District for the basin.
Due to the significant cost of the flood control project ($20,000,000) and the desired sports
stadium ($3,500,000), the group proposes to seek voter approval for a bond issue and an
assessment to retire the bond. The City of Pleasant Hill will take the lead role in reviewing the
feasibility of the bond issue.
IV. Consequences of Negative Action:

Dear Milt and Dennis:
Much has happened since our last formal meeting where little was accomplished. In
order to keep everyone up-to-date,listed below is the "deal" we have on the table that
has been structured through many telephone calls.
1) Mt. Diablo Unified School District to sell an easement to the Contra Costa
County Flood Control District for $1,200,000 cash, with the following
stipulations:
a) Flood Control District agrees to put in the necessary drainage facilities
for active play fields when the retention basin is built. Active play fields
to be defined. The estimated cost is $750,000.

c) Mt. Diablo School District agrees to notify the Flood Control District two
to three years in advance prior to spending any money on the subject
property or making major capital expenditures and/or improvements.
2) The City of Pleasant Hill agrees to loan the Contra Costa County Flood Control
District up to $1,200,000 for no more than one year at zero interest. Flood
Control District to repay City with its revenue sources no later than one year,
and will pay part of the monies owed as cash flow permits.

3) All parties agree to study a voter approved ballot measure that will build the
retention basin with appropriate pipelines ($20,000,000) and construct a first-
class stadium with appropriate seating, lighting, etc. The estimate cost is
$3,500,000.
The total bond issue could be for$23,500,000, or whatever sum the politicians
and various parties agree is feasible. Perhaps a lesser amount may be more
appropriate. Pleasant Hill will take the lead role in reviewing the feasibility
of the bond issue.

5) All parties will discuss with their respective City Council,Board of Supervisors
