WHEREAS plans and specifications for Building Improvements at Fire Station No. 15,
3338 Mt. Diablo Boulevard, Lafayette, have been filed with the Board this day by the Director of
General Services; and
WHEREAS plans and specifications were prepared by Facilities Design Group; and
WHEREAS the cost estimate for the initial construction contract is $60,000.00, base bid;
and
WHEREAS the Board has obtained the general prevailing rates of wages, which shall be
the minimum rates paid on this project; and
WHEREAS the Board having previously found that the project is exempt from
Environmental Impact Report requirements as a Class la Categorical Exemption under County
Guidelines and the Director of Community Development has filed a Notice of Exemption with
the County Clerk;
IT IS BY THE BOARD RESOLVED that said plans and specifications are hereby
APPROVED. Bids for this work will be received on May 15, 1997 at 2:00 p.m., and the Clerk
of this Board is directed to publish a Notice to Contractors in accordance with Section 22037 of
the Public Contract Code, inviting bids for said work, said Notice to be published
in Confrn Costa Times The Director of General Services is
directed to mail notices to the construction trade journals specified in Section 22036 of the Public
Contract Code at least 30 days before the date of opening the bids.
IT IS FURTHER RESOLVED that the Director of General Services, or his designee, is
AUTHORIZED to issue bid Addenda, as needed, for clarification of the contract bid documents,
provided the involved changes do not significantly increase the cost estimate for the initial
construction contract.

I. Recommended Action:
DETERMINE that there is a need to continue the emergency action taken by the Board of
Supervisors on June 4, 1996, pursuant to Public Contract Code Sections 22035 and 22050, to
repair the "Hill 310" Land Creep, Bay Point.
II. Financial Impact:
Total cost of repairs cannot be fully determined at this time, but staff is developing an estimate
for completion of the repair.
111. Reasons for Recommendations and Back-
ground:
A. On February 26, 1996, Public Works and Building Inspection were notified that cracks
were occurring in Beaulieu Court. The County hired a geotechnical firm to identify the
cause of the slide, and recommend and direct remedial actions to mitigate land movement.
B. On March 19, 1996, the Board of Supervisors concurred in the County Administrator's
proclamation of a local emergency.
C. On June 4, 1996, the Board of Supervisors declared an emergency and authorized the
Public Works Director to proceed in the most expeditious manner to repair the area subject
to creep.

D. Repair status:
California Cities Water Company is replacing damaged water main and services in the Beaulieu
Place area. This is the beginning of a process that should allow the removal of the temporary
water main by mid-April.
The estimate of completion for the drainage gallery contract is changed to May.
IV. Consequences of Negative Action:
This project is part of a series of sequential construction projects that will stabilize the landslide
and restore the streets and sidewalks of the affected neighborhood.
A negative action would stop this process.

SUBJECT: AUTHORIZE INITIATION OF AN ANNUAL ASSESSMENT PROCEEDING IN THE RODEO
COMMUNITY FOR LANDSCAPE ASSESSMENTS PURSUANT TO PROPOSITION 218,
RODEO AREA (WO 5523)

I Recommended Action:
A. RESCIND the March 4, 1997 Board action which authorized a special tax election,
approved the ballot measure and directed the County Clerk (Election Division) to conduct
the special tax election in Rodeo to determine if the residents want to continue the current
assessments for park and landscaping maintenance;
B. AUTHORIZE a mail-in ballot and related required actions to determine if the voting
majority of property owners want to approve continuance of current assessments for park
landscaping and maintenance (Countywide Land scape District AD 1973-2, LL-2, Zone
38) Rodeo area and DIRECT the Public Works Director to prepare the engineer's reports
and the allocation of special assessments as required under Proposition 218.
C. After completion of the report, DIRECT the Public Works Director to prepare and send
Proposition 218 hearing notices to all property owners notifying them of a hearing at least
forty-five (45) days after the report's completion and mailing of the notices before the
Board of Supervisors. Property owner votes may be received at time of the hearing and
before it is concluded.
II. Financial Impact:
The County currently collects an annual assessment of $81 ,600 for park landscaping and
maintenance in Rodeo. Under Proposition 218, these assessments must be approved by the
voters through a special tax election or an assessment mail-in property owner ballot procedure.
Without voter or property owner approval, the County will have to cease Ilecting the

III. Reasons for Recommendations and Background:
At their regular meeting on Tuesday, February 18, 1997, County Staff met with the County
Service Area R-10 Citizens Advisory Committee to review the impacts of Proposition 218. Staff
described the various options available to the community for continuing the landscape
assessments. Briefly, the options discussed were either a special election requiring a 2/9 majority
approval or a mail-in ballot procedure requiring a simple weighted majority of the property owner
ballots returned. The Committee voted to request the special election procedure on February
18, 1997. The Board of Supervisors subsequently approved a special tax election on March 4,
1997.
On March 18, 1997 the Citizens Advisory Committee for County Service Area R-10 voted
unanimously to request a mail-in Proposition 218 property owner ballot procedure instead of a
special election previously approved by the Board of Supervisors on March 4, 1997. The
Advisory Committee had previously felt that a special walk-in election would be preferable over
a mail-in ballot. After further deliberation and discussion with County Staff, the Committee
reconsidered their position on the matter and now feels that a mail-in ballot is more suitable for
the Rodeo community. It should be noted that all of the other communities in the County (Oakley,
Clyde and Bay Point) are using a mail- in ballot to determine if the community wants to continue
with the landscaping assessment.
IV. Consequences of Negative Action:
This change is requested by the Citizens Advisory Committee for County Service Area R-10. A
no vote will direct staff to continue the preparation for a special tax election in June 1997.

Costa County be approved to enact a special tax to continue annual funding of$32.04 per single family
residence ($16.02 for seniors), $16.02 per mobile home space (and higher amounts for specified
commercial properties)to provide for on-going developments, maintenance and operation of park, trail,
recreational and landscaping facilities and services, including the Rodeo Creek Trail and Lefty Gomez
Ballfield complex in Rodeo?"
IV. Conseauences of Neeative Action:
This change is requested by the Citizens Advisory Committee for County Service Area R-10. Ano vote

I. RECOMMENDED ACTION:
APPROVE one year lease renewal for the Neighborhood House of North Richmond and AUTHORIZE the Executive
Director of the Housing Authority of the County of Contra Costa to enter into a one year Lease Renewal with the Neighborhood
House of North Richmond located in Las Deltas,North Richmond,as stated in the attached Lease Renewal.
IL FINANCIAL IMPACT:
None.
III. REASONS FOR RECOMMENDATION/BACKGROUND
Unit No.429, 116 West Grove Street, located in Las Deltas Development,North Richmond is used by the
Neighborhood House of North Richmond for the residents of Las Deltas, as well as the surrounding community. The Center
provides counselling and drug treatment for their clients enabling them to become drug free and put them on the road to self-
sufficiency. This lease has been in effect since July, 1995.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Should the Board of Commissioners elect not to authorize the Executive Director to enter into a one year Lease
Renewal with the Neighborhood House of North Richmond,the on-going would no longer function and this would be a
detriment to the development,as well as the community.

1. PARTIES: Effective on MAY 1, 1997, THE HOUSING AUTHORITY OF THE
COUNTY OF CONTRA COSTA, hereinafter called "AUTHORITY" and the
LAS DELTAS PROJECT PRIDE, a non-profit corporation, hereafter called
"AGENCY," mutually agree and promise as follows:
2. LEASE OF PREMISES: AUTHORITY, for and in consideration of the covenants and
conditions expressed herein, hereby leases to AGENCY, and AGENCY accepts and takes
those certain premises described as follows:
A single story unit located at 116 West Grove Street, Unit #429,
Richmond, California 94801
3. TERMS: This lease shall commence on May 1, 1997 and end on
April 30, 1998.
4. RENTAL: No cost to Agency.
S. USE OF PREMISES: The premises shall be used during the term for purpose of
conducting Project Pride functions including community meetings, and other community
held functions deemed to be in the best interest of the development and the Las Deltas
community at large.
AGENCY further agrees to provide AUTHORITY with monthly activity reports.
Reports are due by the end of each month, reporting on previous month activities.
6. MAINTENANCE AND REPAIRS•
A. AGENCY may, at its option, terminate this lease in lieu of performing any
maintenance required under this Paragraph 6, unless said maintenance is required
because of AGENCY'S abusive use of the premises.
B. AUTHORITY shall keep the roof and exterior of the building in good order,
condition and repair and shall maintain the major structural integrity of the building.
C. AGENCY shall keep and maintain the interior of the premises in as good order,
condition and repair as when accepted, including doors and their fixtures, closures and
hinges, glass and glazing and locks and keys systems used in the demised premises. But

AUTHORITY shall repair damage to the interior caused by failure to maintain the
exterior in good repair, including damages to the interior caused by roof leaks and/or
interior and exterior wall leaks, and AUTHORITY shall initially provide the space with
no broken windows, and light bulbs, electrical, plumbing and heating systems in good
working order.

RECOMMENDATIONS
ADOPT position opposing AB 923 (McClintock) and AUTHORIZE the Chair to execute letters
to the County's legislative delegation regarding said bill.
FISCAL IMPACT
No direct impact as a result of this action. The proposed bill would substantially impair the
County's use of the redevelopment tool to facilitate reinvestment in its unincorporated
communities.
BACKGROUND/REASONS FOR RECOMMENDATIONS
AB 923 is a bill that calls for the dissolution of California's redevelopment agencies by
repealing California Redevelopment Law and requiring a city or county with a redevelopment
agency to dissolve the redevelopment agency by January 1, 1998. The State Controller's
Office would supervise the process and manage any loose ends. This bill represents a
hatchet approach to concerns regarding the operation and implementation of the
redevelopment function. Redevelopment represents the primary source of revenue for local
government to address local investment requirements for community infrastructure, affordable
housing, and economic development. To the extent concerns exist the Legislature has, in the
past, approached reforms on a surgical basis to cure the patient, not kill it. The approach
embodied in AB 923 is unnecessary.

Redevelopment is a valuable tool to localities attempting to address local economic development,
affordable housing, and infrastructure needs. Refinements to California Redevelopment Law are
always appropriate to address perceived abuses or changing conditions, while leaving the basic
program to work very effectively. AB 923 would do irreparable harm to the viability of urban
California by eliminating redevelopment. If the author feels there are issues needing to be addressed,
a discussion of appropriate reforms is in order. Killing the patient is not an appropriate cure.
We ask your support in opposing AB 923.
