Supervisor Mark DeSaulnier Contra Costa County Board of Supervisors 651 Pine Street Martinez, CA 94553 RE: Kensington Garbage Contract Dear Supervisor DeSaulnier, We are writing to express to you our strong disapproval of the County's entering into a contract for garbage collection with Bay View Refuse Service, usurping the home rule and contracting rights of the Kensington Police Protection and Community Services District. We would appreciate your response to the following questions: 1. Was the County's contract for garbage collection in Kensington put out to bid? If not, why not? 2. On what basis was the garbage collection fee negotiated, and what due diligence steps were taken by the County to verify the costs and profit margin figures provided by Bay View? 3. Why is Bay View being permitted to provide a wholly impractical green waste pickup and dramatically reduced general refuse curbside pickup service to its customers (refer to the attached letter to Mary Fleming of the Community Development Department)? We trust that you will do all that you can to void the county contract, return the negotiations to the Kensington Community Services District where it belongs and, in the interim, require Bay View to provide a reasonable service for the fee it charges. Very truy yours, Sally Fraser 41leneacham Sally Fraser & Allen Meacham 45 Avon road Kensington, CA 94707 (510) 528-8353 March 6, 1997 Mary Fleming Contra Costa County Community Development Department 651 Pine Street Martinez, CA 94553 RE: Kensington Garbage Service Dear Ms. Fleming, It is our understanding from articles in the Kensington Outlook that you are responsible for managing the service provided by Bay View Refuse Service under the contract entered into by the County. Without getting into the merits or wisdom of the County's action, we are writing to call to your attention the impracticalities of the green waste program instituted by Bay View, with little or no notice to its customers. Prior to the first of this year, Bay View collected curbside refuse four times a year. Green and non-green waste was picked up, regardless of the type of container. Bay View's new program of collecting green waste only four times a year is totally impractical. The Company requires that the customer provide the containers to hold the green waste, and will not take the containers. This means that the customer has to (1) stockpile the green waste for three months at a time, and (2) stockpile enough containers to hold three months worth of green waste. It is impractical for most homeowners to store a number of garbage cans, large cardboard cartons or other containers to hold green waste which is largely generated only in the spring and summer. What will most likely happen if these rules are not changed is that people will stockpile as much green waste as they can live with in plastic garbage bags and put it out in the once-a=year general pickup. Thus, customers will be greatly inconvenienced, and large amounts of green waste will end up in the dump anyway. We fail to see why a program similar to'those employed in either El Cerrito or Albany cannot be implemented here. In Albany a customer can buy bags to put out green waste on any regular pick-up day, and in El Cerrito a customer is provided a green waste container,just as separate containers are now used for glass and plastic/aluminum. We trust that the County's contract with Bay View is not so inflexible that the current illogical, unacceptable program cannot be corrected.
