RECOMMENDATIONS:
1. ACCEPT the report of the Growth Management and Economic Development
Agency.
2. DIRECT GMEDA not to expend funds to contour"Hill 410" at this time.
3. MAINTAIN this item as a referral to the Finance Committee for reconsideration in
one year.
BACKGROUND:
On March 3, the Finance Committee considered a written and oral report from Growth
Management staff. The Committee determined that contouring "Hill 410" for $10,000 was
more cosmetic than a functional necessity and therefore of relatively low priority.
The Committee requested that this matter be brought back for consideration in one year.

SUBJECT: "Hill 410" in Bay Point
One of the Board requirements to the Seabreeze subdivision was contouring of
"Hill 410". Since the area was open space and not attached to a permit, the
developer was able to stall off staff by promises, then do minor work and skip
town.
Staff was asked to research current ownership of the property. It is the County.
The Board adopted a condition to have the property deeded over to a public
agency. Ambrose Park District and EBRPD summarily rejected title to hillside
open space. The property went up for taxes. Since the County was also obligated
to provide landscaping in the open space and the developer reasoned that there
was no need for a homeowners' association, the County was forced to pick up the
property for taxes, rather than allow a third party to control access. This placed
the County in a responsible position for Hill 410 and, more important, for the Hill
310 landslide area for which we have spent $4.5 million to repair.
Staff was asked to review whether Caltrans landscape funds could be used on site.
Caltrans cannot use funds outside their right of way. They cannot spruce up
adjacent parcels even if they may be eyesores. All the work will be done on the
County's finances. The Public Works Department estimated the cost of earth
moving to be $10,000. Since the area has already been subject to devastating slide
repair, staff is wary of unnecessary earth moving on an adjacent site. Should the
Finance Committee wish to recommend funds for such a project, staff will see
that the work is performed for under $10,000.

RECOMMENDATION:
1. DIRECT staff of the Growth Management and Economic Development Agency to
estimate the cost of Contouring "Hill 410" in Bay Point and report back to the
Finance Committee.
BACKGROUND:
The Committee reviewed the attached information prepared by Supervisor Torlakson and
heard a presentation by the GMEDA Director. It was determined that more information
was needed before action can be taken on this issue. The GMEDA Director indicated that
Public Works staff will evaluate the grading issue. The Committee suggested that General
Services Department crews could provide landscaping services as needed. A report will
be prepared at a future Finance Committee meeting.

SUBJECT: Hill 310 (Garrett Development)
I am once again attempting to followup on the "rounding off' of Hill 310. As you will
remember, the rounding of this hill was a condition of approval for Garrett Development
who promised to complete this aspect of the project in 9992.
Before leaving the County last May my aide, Sharon Haynes-Creswell sent a memo to
your department requesting the status of this issue. To the best of my knowledge, we
have not received a reply and my visual observation of this hill indicates that`the proper
rounding off has not been accomplished.
Who Is now the caretaker for this portion of the development - is it now under the
jurisdiction of a special district(landscape and lighting) of the County? Please follow-up
on this issue at your earliest opportunity. I would like to bring this issue to conclusion
within the next two weeks.
If you have any comments or questions regarding this Issue, please contact Kathi
Gilmore of my staff.

I have briefly contacted the Senior Grading Inspector about the grading on the site about any
inspections that were done.in 1990- 1992 on the site. He is on vacation so when he returns,and I
return from three days off next week, I will try to find out if the site was graded per the plans
attached.
When I visited the site this week,I found the mounds covered with grass, and some of the planted
trees alive and some dead. The monument on top of the northern mound had been heavily
vandalized.
As you know,the developer(Garrett Development)appears to be out of business. This fact is being
investigated by risk management in regards the problem with slope stability at the east end of the
Seabreeze development. At this time all of our files are with the lawyer involved in that matter on
the County's behalf.

SUBJECT: Hill 310 Rounding(Hill 428?)
I have been asked by Harvey Bragdon to research the question of the rounding of the mounds to the
south and east of the water tanks at the top of the hill west of the Mata Road and Evora Road
intersection in the Bay.Point area.
I have obtained a copy of the grading plan from the Building Inspection Department records(copy
attached),
The Condition of Approval for SUB.7152,DP883032,and RZ2812 that involved the portion of the
site west ofMota Road, reads as follows:
"Ia. This portion of the site lying west of Mata Drive shalt not be developed. This
property (known now as "Hill 428") shall become permanent open space and shall
be. disturbed to the minimum extent feasible by construction associated with the
Seabreeze development, allowing for the installation of water lines and a water tank:
necessary to serve the project site. The open space shall be deeded over to a public
agency subject to review and approval of the County Zoning Administrator.
Applicant shall berm and landscape existing water tank to conceal to the maximum
extent feasible. The applicant shall conceal the future water tank to the greatest
extent or bury if necessary. Applicant shall have created and installed (subject to
Zoning Administrator review and approval) a historic marker to be.permanently
placed on "Hill 428" commemorating both the Spanish and Native American
populations."
The property is now owned by the County and the County would be the caretaker of the site. The
site contains approximately 7.56 acres (Parcel 0098-220-013). The Southern California Water
Company own a.954 acre parcel where the two water tanks are located (Parcel #098-220-009).
