SUBJECT: AMENDMENT TO CONTRACT WITH GC SERVICES

SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
AUTHORIZE the County Administrator or his designee to execute an amendment to the contract
with GC Services Limited Partnership on behalf of the County and the Coordinated Courts for
collection services on accounts for unpaid traffic-related fines and civil assessments for the period
from February 1, 1996 through January 31, 1998.
BACKGROUND:
The timely collection of delinquent court fines and forfeitures has been an important issue
confronting the Courts and the County for several years. When defendants fail to comply with
their obligations to the court, the courts have issued DMV holds and warrants, as appropriate.
The Municipal Courts have attempted to collect these delinquent fines through traffic amnesty
programs and recovered over a million dollars. Despite those efforts. However, there remain
about 70,000 outstanding traffic cases that have been delinquent for at least one year. These
and other delinquent traffic fines represent a significant amount of potential revenue to the County
and the Municipal Courts.
Prior to contracting with GC Services, the Courts have had little ability to actively collect on past
due accounts. As a result, the backlog has increased and a vital element of the justice system--
enforcing court-imposed penalties--has been seriously hampered. However, amendments to the
Penal Code over the past few years authorized courts to impose a civil assessments in lieu of
issuing arrest warrants for those defendants who fail to appear.

The Contra Costa County Municipal Courts, in 1996, authorized a civil assessment penalty of up
to $135 on cases in which a defendant fails to appear as required. Under the original contract,
traffic fines that are delinquent for at least one year are assigned to GC Services, a third-party
collections agency with vast experience in government and, specifically, court collections. New
cases are currently processed by the Municipal Courts' Collections and Compliance Unit (CCU),
which handles all other Municipal Courts collections. The proposed contract amendment will
allow the courts to assign to GC Services any unpaid traffic fines deemed uncollectable by the
CCU. The courts earned approximately$378,000 during the first half of FY 1996-97, after paying
a 30% commission to GC Services.

amend the Collections Services Contract as follows:

The Agency (GC Services) shall.accept for collection accounts for unpaid minor offense
fines and civil assessments,in accordance with the provisions of section 26220, 26221 and 26222
of the California Government Code and Sections 1205 and 1214.1 of California Penal Code,
which are assigned to it for collections hereunder.
STATEMENT OF WORK
Amend to read--
Item-I The Courts shall assign,at their discretion, delinquent accounts for collection.
All other terms and conditions of the Contract, Service Plan and Statement of Work remain
the same.
