SUBJECT: Approval of the project contingency fund increase and Contract Change Order No. 3 for
the San Pablo Avenue Pathway and Shamrock Drive Signal Modification, Project Nos.
0662-6R4187-95 and 0662-6U4169-92, San Pablo-Pinole area.
Specific Request(s)or Recommendation(s)&Background&Justification
I. Recommended Action:
APPROVE the project contingency fund increase of$12,000.00 and Contract Change Orders No.
3 in the approximate amount of$18,000.00 and AUTHORIZE the Public Works Director to execute
it in order to compensate the contractor, Richard A. Heaps, Inc., for increases in contract items.
II. Financial Impact:
The increase in the contingency will be fromTransportation Development Act (TDA) Funds (20%)
and Road Funds (80%).
III. Reasons for Recommendations and Background:
Additional item increases were required to complete the project. Because this Change Order
exceeds 10% of the original contract price and exceeds the project contingency fund, Board
APPROVAL of the change order and the increase in the project contingency fund is required.
IV. Consequences of Negative Action:
Without APPROVAL the contractor will not receive payment for work done.
