LEGISLATION: SPONSORSHIP OF AB 487 (LEACH) SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: ACKNOWLEDGE that the Board of Supervisors is the SPONSOR of AB 487 by Assemblywoman Leach. BACKGROUND: The Board sponsored legislation in 1993, (SB 222, Boatwright [Chapter 751, Statutes of 1993]) to permit the telephone company to release unlisted telephone numbers and addresses to the County for purposes of maximizing the effectiveness of the CAN (Community Alert Network) system. We have concluded negotiations with Pacific Bell to acquire this information and the information has been installed in the CAN system. However, we are concerned that someone might try to gain access to these tapes for unrelated purposes through the Public Records Act. We believe it is essential that the confidentiality of this information be protected in order to maintain the credibility and integrity of the CAN system. We therefore recommended that the Board of Supervisors seek legislation which will allow the County or its agents to maintain the confidentiality of this information by exempting its release pursuant to the Public Records Act. We asked Assemblywoman Leach to author legislation along these lines, which she agreed to do. The result is AB 487. As introduced, AB 487 does the following: 4 The unlisted or unpublished telephone numbers and addresses are exempted from disclosure pursuant to the Public Records Act. 4 An individual is still afforded the right to withhold his or her telephone number. The Health Services Director, Dr. William B. Walker, recommends that the Board of Supervisors acknowledge that AB 487 is the appropriate vehicle for accomplishing the objectives set forth by the Board of Supervisors in its 1997 Legislative Program.
