BACKGROUND: Currently, the County Library is supported in part by State funding from what is known as the Public Library Fund. This fund was established in 1982 to provide State assistance to public libraries in the aftermath of Proposition 13. The enabling legislation establishes the intent of the fund and the goal to index it annually to be able to support 10% of the total cost of public library operations within the State. The State has fallen short of this goal. The current allocation formula is based on the statewide average per capita for library funding. Each jurisdiction is allocated revenue based on their percentage of local support in relationship to the statewide average. While this formula encourages local agencies to support their libraries (in order to get more State assistance), in this time when the State has transferred half of the County's property tax revenue to the State, it appears to help those who have the ability to help themselves. Currently the State funding level is at $15.87 million for the 1996-97 fiscal year, having been increased to that level from $8.87 million the prior year. The actual requirement if the Public Library Fund were fully funded at the 10% level is $51.266 million. AB 345 would not go into effect until the Public Library Fund was funded at a level which would at least hold all libraries harmless. This level is calculated at $19,043,000. As long as the funding is below that level, the current formula would be in effect. Once that level of funding is equaled or exceeded, the Public Library Fund would be allocated on a straight per capita basis, thereby favoring relatively underfunded library systems like Contra Costa County, while not actually causing any library to lose money. If the State funding level were at the $19 million level for this fiscal year and the AB 345 formula were in effect, Contra Costa County would receive a nearly 50% increase in funding, from $331,691 to $482,247. San Bernardino County has asked Contra Costa County and several other urban counties which would be advantaged by AB 345 to indicate their support for AB 345. LEGISLATIVE COUNSEL'S DIGEST AB 345, as introduced, Granlund. Libraries. Existing law requires that the state allocation for a library's foundation program be equal to 10% of that program and requires the proportional reduction of the state allocation to a library for its foundation program if local revenues total less than 90% of the cost of the foundation program. This bill would require the method of allocation to be changed to a simple per capita. allocation based on the population served by each public library if in any fiscal year the amount appropriated to the Public Library Fund reaches a certain amount. Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no. The people of the State of California do enact as follows: 1 SECTION 1. Section 18025 of the Education Code is 2 amended to read: 3 18025. If, in any fiscal year, the 11 amount appropriated to the Public Library Fund is 12 nineteen million forty-three thousand dollars 13 ($19,043,000) or more, the method of allocation shall be 14 changed to a simple per capita allocation based on the 15 population served by each public library as certified by 16 the State Librarian. Until the state's budgetary 17 appropriation reaches this level, the allocation' method. 18 used in the 1996-97 fiscal year shall remain in effect. It is 19 the intent of this subdivision to change to a more 20 equitable allocation formula and that no library shall be 21 harmed by this change. 22 (c) If local revenues appropriated for a public library 23 for the 1982-83 fiscal year and each fiscal year thereafter, 24 including tax revenues made available under the 25 provisions of Chapter 282 of the Statutes of 1979, total 26 more than 90 percent of the cost of the foundation 27 program as determined pursuant to Section 18022, the 28 state allocation for that fiscal year shall remain at 10 F; 29 percent of the cost of the foundation program as 30 determined pursuant to Section 18022. 31 (d) In order for a public library to receive state funds 32 under this chapter in the 1983-84 fiscal year and any fiscal 33 year thereafter, the .total amount of local. revenues 34 appropriated for the public library for that fiscal year, 35 including tax revenues made available under Chapter 282 36 of the Statutes of 1979 and other revenues deemed to be 37 local revenues according to Section 18023, shall be equal 38 to at least the total amount of local revenues, as defined,. 39 appropriated for the public library in the previous fiscal 40 year. State funds provided under this chapter shall 99 - 3 — AB 345 1 supplement, but not supplant, local revenues 2. appropriated for the public library. 3 (e) (1) Notwithstanding subdivision (d) , or any other 4 provision of law, in the 1993-94 fiscal year, any city, 5 county, district, or city and county, that reduces local 6 revenues appropriated , for the public library for the 7 1993-94 fiscal year shall continue to receive state funds 8 appropriated under this chapter for the 1993-94 fiscal 9 year only, provided that the amount of the reduction to 10 the appropriation to that public library for the 1993-94 11 fiscal year is no more than 20 percent of the 1992-93 fiscal 12 year appropriation made to that public library as certified 13 by the fiscal officer of the public library and transmitted 14 to the State Librarian pursuant to Section 18023. 15 (2) Commencing with the 1993-94 fiscal year, and 16 each fiscal year thereafter, any city, county, district, or 17 city and county may request from the State Librarian a 18 waiver of the requirements of subdivision (d) or of 19 paragraph (1) by demonstrating that the percentage of 20 the reduction in local revenues appropriated -for the 21 public library is no greater than the percentage of the 22 reduction of local revenues received by the city, county, 23 district, or city and county operating the public library as 24 a result of changes made to Chapter 6 (commencing with 25 Section 95) -of Part 0.5 of the Revenue and Taxation Code 26 by statutes enacted during or after the 1991-92 Regular 27 Session having the effect of shifting property tax revenues 28 from cities, counties, special districts, and redevelopment 29 agencies to school districts and community colleges. 30 Requests for the waiver and the substantiating 31 documentation shall be submitted to the State Librarian 32 along with the annual report of appropriation required by 33 Section 18023 or any other report of appropriations 34 applying to public libraries required by any other 35 provision of law. 36 (f) IR the event theA If the state allocations computed 37 pursuant to this section exceed the total amount of funds 38 appropriated for such purposes in any fiscal year, the 39 State Librarian shall adjust on a pro rata basis public 40 library allocations prescribed by this section so that the 99 AB 345 — 4 — I 4 - 1 total amount in each fiscal year does not exceed this 2 amount. This fund was established in 1982 to provide state assistance to public libraries in the aftermath of Proposition 13. The enabling legislation establishes the intent of the fund and the goal to index it annually to be able to support 10%of the total cost of public library operations within the State. The state has fell short of this goal. The current allocation formula is based on the statewide average per capita for library funding. Each jurisdiction is allocated revenue on their percentage of local support in relationship to the statewide average. While this formula encouraged local agencies to support their libraries(in order to get more state assistance), in this post-ERAF period, it appears to help those who have the ability to help themselves. With ERAF the state took away much of our ability to support our libraries. The California Public Library Association has been looking at this formula for several years, but has mostly focused it's attention on increasing the State's support of the program. As you can see, last year they were able to increase State funding from $8.8 million to $15.8 million. While a bigger pie helps everyone,the equity of the formula is still in question. The San Bernardino County Librarian, Ed Kiecykowski proposed a change to a straight per capita allocation. This proposal would have resulted in some jurisdiction getting less money next year than they did last year. My office assumed this was an unacceptable proposal. As an alternative we have worked out the current provisions of AB 345 which would prospectively change the formula when the state's support of the program reached $19,043,000. t This is the amount needed to keep all libraries whole (at the 1996/97 funding level) and switch to the per capita formula. Our intent is that no jurisdiction loses current dollars(future funding of course is another matter). While no jurisdiction loses, others win. I am specifically contacting you because your county stands to be a big winner in this proposal. I have outlined below the projected state allocation under the $19,043,000 funding as it relates to your current year state assistance under the current formula with a$15.8 million fund. Please work with your counties to support this measure. I am working with the California Libraries Association through our librarian to possibly get their support. But I am expecting some opposition from libraries that lose future.funding(mostly city libraries). The next step of course is to work to get the funding for the program increased to the necessary level to trigger the formula change. Thank you for your assistance. As the state's assistance to the program increases the formula change continues to be beneficial to these counties. However, if state funding falls below$19,043,000 the formula reverts back to the old formula. Please refer to the attached spreadsheets for additional information.
