RECOMMENDATIONS
Approve and authorize the Chair of the Board of Supervisors to hold harmless and indemnify the Livermore
Area Recreation & Park District from liability for use of the premises known as the Recreation Center,
Room 4, 2466 Eighth Street, Livermore, by the Community Development Department for a public meeting
on July 8, 1996.
FINANCIAL IMPACT
None.
REASON FOR RECOMMENDATION/BACKGROUND
The Community Development Department, together with the other five agencies which sponsor the
Alameda-Contra Costa Biodiversity Working Group, is sponsoring a series of two workshops to introduce
land owners and developers to the pilot study conducted by the Alameda-Contra Costa Biodiversity
Working Group. The first has already taken place and was held in Brentwood. The Livermore Area
Recreation & Park District has agreed to allow the Community Development Department complimentary
use of Room 4 of the Recreation Center at 2466 Eighth Street in Livermore on July 8 for the second
workshop. In exchange for complimentary use of the room, the Livermore Area Recreation & Park District
requires that Contra Costa County hold harmless and indemnify them for use of the premises. The
Community Development Department has worked with County Administrator's Office of Risk Management
to develop this recommendation.

Re: Use of Premises at Livermore Area Recreation & Park
District by Community Development for the Alameda-Contra
Costa Biodiversity Working Group Public Meeting on 7/8/96
The County of Contra Costa has been self-insured for all liability
risks including medical malpractice and workers ' compensation
arising from its operations, owned property, equipment and leased
property and equipment since 1976 . The County's self-insurance
program provides for the legal defense of officials and employees
pursuant to Government Code Sec. 825 and payment of all sums which
it is obligated to pay by reason of liability imposed by law and
arising from their acts or failure to act, excepting exemplary or
punitive damages. This protection covers services performed by
officers or employees within the scope of their official duties in
accordance with the conditions of their employment or services .
With respect to workers ' compensation benefits, the County provides
workers ' compensation to all of its employees as required by
California State Compensation laws.
The self-insurance programs are prefunded to provide funds for
payment of claims .
Indemnification. The County shall defend, indemnify, save and hold
harmless Livermore Area Recreation & Park District and its officers
and employees from any and all claims, costs and liability for any
damages, sickness, death, or injury to person(s) or property
arising directly or indirectly from or connected with the
operations or services of the County or its officers and employees,
save and except claims or litigation arising through the sole
negligence or sole willful misconduct of Livermore Area Recreation
& Park District or its officers or employees .
County will make good to and reimburse Livermore Area Recreation &
Park District for any expenditures, including reasonable attorneys '
fees the District may make by reason of such matters and, if
requested by the Livermore Area Recreation & Park District, will
defend any such suits at the sole cost and expe se f the County.
