SUBJECT: Determine the EI Toyonal Bridge Replacement Project, Orinda area, is exempt from CEQA.
Project No. 0662-6P4016-96, CDD-CP # 96 -44.
Specific Request(s) or Recommendation(s) & Background & Justification
I. RECOMMENDED ACTION:
DETERMINE that the project is a California Environmental Quality Act Class 1c Categorical
Exemption.
DIRECT the Director of Community Development to file a Notice of Exemption with the County
Clerk.
DIRECT the Public Works Director to arrange for the payment of the $25.00 handling fee to the
County Clerk.
II. FINANCIAL IMPACT:
The estimated project cost is $75,000, funded by Road Funds (100%).
III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project replaces the existing deteriorated timber bridge with a new one lane prefabricated
steel bridge. The project is the County's portion of a cooperative project with the City of Orinda
and East Bay Municipal Utility District to re-establish EI Toyonal as an emergency route.

It is needed because the existing roadway and bridge are currently impassable due to earth slides
and the condition of the existing timber bridge. This situation leaves only one avenue of egress
for the residents in the upper reaches of EI Toyonal.
The project has been determined to be in compliance with the General Plan and is exempt from
CEQA because it consists of minor alterations of existing public facilities involving no expansion
of use per Section 15301 of the CEQA Guidelines.
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the project will result in a delay of construction and will stall the reopening of
the emergency route along EI Toyonal.

#96-44:The project involves removing the existing deteriorated bridge and installing a "Bailey" (simple span) bridge.
Use of the replacement bridge will be limited to pedestrians, equestrians, bicyclists,and emergency vehicles.
Removal of the deteriorated bridge was approved by the Board of Supervisors, per Section 15269(c) of the CEQA
Guidelines,(CDD-CP# 95-65), on December 5, 1995.
Location:The bridge is located in the Orinda area of Central Contra Costa County approximately 3/10 mile south
of Wildcat Canyon Road.

SUBJECT: MANDATORY REFERRAL FOR GENERAL PLAN CONFORMANCE
Community Development staff has reviewed the attached project, CP .96- 1 :1 to
determine if mandatory referral for General Plan Conformance, as required by Section
65402 of the Government Code, is necessary. -
The project needs no further mandatory referral clearance from County staff subject
to the following actions:
This project has been determined to be exempt from 65402 review.
( ) This project has been determined to be exempt from 65402 review in
accordance with the Board of Supervisors Resolution 81/522 because
the project involves a road alignment project of a minor nature.
( 1 The project site is located within the City of and
should be referred to the City for 65402 review.
( ) Community Development staff makes the following attached
recommendation which should be incorporated into the staff report on
this matter.
The project needs mandatory referral and County staff will process this project in the
following manner:
( ) 65402 review is required. Community Development staff will carry this
matter, before the appropriate Planning Commission.
( 1 65402 review must be withheld until completion of an Environmental
Impact Report on this project.
