z THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA ` Adopted this Order on June 4, 1996 by the following vote: AYES: Supervisors Rogers, Bishop, DeSaulnier, Torlakson, Smith NOES: None Resolution Establishing Underground Utility ABSENT: None District No. 29 RESOLUTION NO. 96/257 SUBJECT: Establishment of Underground Utility District No. 29 - Stone Valley Road, Alamo Area. Project No. 0676-6P1083, CDD CP #95-67 The Board of Supervisors of Contra Costa County RESOLVES that: This Board's Resolution No. 96/ 216 fixed 9:45 a.m. on June 4, 1996 as the time for a public hearing to ascertain whether the undergrounding of overhead utilities along a section of Stone Valley Road in the Alamo area is in the interest of the public health, safety, or welfare. The section of Stone Valley Road is as more particularly described and delineated on Exhibit "A" attached to said Resolution No. 96/ 216 on file in the Office of the Clerk of this Board, County Administration Building, Martinez, California, and available for inspection. Notice of such hearing was given to all affected property owners as shown on the last equalized assessment roll, and utilities concerned, in the manner and for the time required by law. Said hearing of JuneA, 1996 was duly and regularly held and all persons interested were given an opportunity to be heard. This Board hereby finds that the undergrounding of utilities along a section of Stone Valley Road is in the interest of the public health, safety, or welfare. This Board further finds that the street in said area is extensively used by the general public and carries a heavy volume of vehicular traffic. The Board also finds that the project, creation of the Underground Utility District, will not have a significant effect on the environment, and that it has been determined to be a Categorical Exemption Class 1B, 15301, of the CEQA Guidelines and directs the Community Development Director to file a Notice of Exemption. The Board hereby directs the Public Works Director to arrange for payment of the $25.00 handling fee for filing the Notice of Exemption. Pursuant to Chapter 1008-2 of the Contra Costa County Ordinance Code (Ord. No. 68-10), the above-described area is hereby declared an Underground Utility District, and is designated as Underground Utility District No. 29 of the County of Contra Costa. This Board hereby fixes June 1,1997 as the date on which affected property owners must be ready to receive underground service, and hereby orders the removal of all poles, overhead wires and associated overhead structures (including without limitation removal to at least the roof line of weatherheads, risers and other overhead service entrance facilities) and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within Underground Utility District No. 29 on or before February 1, 1998. RESOLUTION NO. 96/ 257 Resolution Establishing Underground Utility District No. 29 g�• June 4, 1996 Page 2 The Clerk of this Board is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 29 of the adoption of this Resolution within ten (10) days. Said Clerk shall further notify said property owners of the necessity that, if they or any person occupying such other property desire to continue to receive electric, communication or other similar or associated service, they or such occupant shall, by the date fixed in this Resolution, provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this Resolution together with a copy of said Chapter 1008-2 (Ord. No. 68-10) to affected property owners within said District No. 29 as such are shown on the last equalized assessment roll and to the affected utilities. Project Description: The proposed project consists of forming an underground utility district, removing and replacing overhead utility lines with underground facilities. All street lights and poles will be replaced with new light standards as close to the original locations as possible. Formation of the district will preclude the future installation of overhead lines within the boundaries of the district. The trench for the utilities will be located within the right-of-way beneath the existing sidewalk along the north'side of Stone Valley Road. An arborist has determined the trees along Stone Valley Road have been exposed to years of heavy traffic, auto emissions, drought, and neglect. These circumstances have contributed to the poor conditions of the majority of the trees. Recommendations of the arborist such as trenching at least 4-6 feet from the trunks of trees shall be required as part of the lir ject conditions. Under Rule 20-A for utility conversions, the proposed district will pay for all costs related to the installation of the underground system. The underground district will also provide 30.5 meters (100 feet) of lateral trenching and conduits, if needed, from the underground district's main service trench to the foot fo the building wall where the utility service box is attached, at no cost to the property owner. The property owner, however, will be responsible for the conversion of his utility service box to receive underground service, and any lateral trenching and conduit in excess of 30.5 meters (100 feet). If the property owner already receive underground service no further action is necessary. At the public hearing, the Board will ascertain whether the public health, safety, or welfare requires the removal of utility poles, overhead wires and associated overhead structures within the designated district area. If the Board approves the creation of the district you will be notified of the time schedules for the conversion of your overhead service to underground service. Under Rule 20-A for utility conversions, the proposed district will pay for all costs related to the installation of the underground system. The underground district will also provide 30.5 meters (100 feet) of lateral trenching and conduits, if needed, from the underground district's main service trench to the foot of the building wall where the utility service box is attached, at no cost to the property owner. The property owner, however, will be responsible for the conversion of his utility service box to receive underground service, and any lateral trenching and conduit in excess of 30.5 meters (100 feet) . If the property owner already receives underground service no further action is necessary. At the public hearing, the Board of Supervisors will ascertain whether the public health, safety, or welfare requires the removal of utility poles, overhead wires and associated overhead structures within the designated district area. If the Board of Supervisors approves the creation of the district you will be notified of the time schedules for the conversion of your overhead service to underground service.
