HomeMy WebLinkAboutMINUTES - 06041996 - D7 D- 7 Contra To: BOARD OF SUPERVISORS To: County FROM: Supervisor Tom Torlakson DATE: June 4, 1996 SUBJECT: CITY OF PITTSBURG AND THE KELLER CANYON LANDFILL SPECIFIC REQUEST(S)OR RECOMMENDATION(S)AND JUSTIFICATION RECOMMENDED ACTION: 1. Support and encourage legislation which would forbid landfills approved by the electorate from accepting additional types of materials formerly classified as hazardous materials that are now potentially acceptable in Class II landfills under the broadened definition recently adopted by the Department of Toxic Substance Control. 2. Direct the County Local Enforcement Agency to work with the City of Pittsburg in an effort to establish an air quality monitoring program at the Keller Canyon Landfill. 3. Reaffirm the county's policy and condition of approval that Contra Costa County is committed to resolve the property valuation issues with neighbors to the Keller Canyon Landfill and consider a precise timetable for public hearing and resolutions of propertyowner mitigation issues. 4. Consider host mitigation fees, the City of Pittsburg, and a good neighbor agreement between BFI and the City of Pittsburg. BACKGROUND INFORMATION: The City of Pittsburg will be addressing on June 3, 1996, issues at their council meeting relative to matters concerning the Keller Canyon Landfill. The City of Pittsburg would like the Board of Supervisors to reaffirm.and give assurances on matters that relate to the landfill that it has addressed in the past. Some of the matters were addressed in the Keller Canyon Landfill Land Use Permit and the Keller Canyon Property Valuation Study. Others have been discussed, by the Board and are in reports from county staff(Opposition to Keller Canyon Landfill taking new categories of waste and air monitoring). We have attempted to resolve differences between the Board and the City of Pittsburg over the Keller Canyon Landfill. Endorsing the above four recommendations will go a long way toward settling these differences and improving the relationship between the Board of Supervisors and the City of Pittsburg. ATTESTED June 4, 1996 PHIL BATCHELOR,CLERK OF THE BOARD OF SUPE C SORS D COU NUMINISTRATOR BY DEPU P7 ADDENDUM TO ITEM D. 7 June 4, 1997 On this date, the Board of Supervisors considered actions to be taken with regard to the City of Pittsburg and the Keller Canyon Landfill accepting materials, air quality monitoring, property valuation and host mitigation fees, as recommended by Supervisor Torlakson. Supervisor Torlakson commented on each of the recommendations . The following person presented testimony: Joe Canciamilla, 2020 Railroad Avenue, Pittsburg, representing the City of Pittsburg. Supervisor Torlakson moved to direct staff to bring back information on recommendation one in two weeks . Supervisor Rogers clarified that motion would be to strongly encourage Browning Ferris Industries to agree to make this legislation unnecessary and direct staff to communicate with BFI about that . The vote on the motion was as follows : AYES : Supervisors Rogers, Bishop, DeSaulnier, Torlakson and Smith NOES : None ABSENT: None ABSTAIN: None IT IS BY THE BOARD ORDERED that staff is DIRECTED to report to the Board of Supervisors on June 18 , 1996, on the issues of legislation which would forbid landfills approved by the electorate from accepting additional types of materials formerly classified as hazardous materials that are now potentially acceptable in Class II landfills under the broadened definition recently adopted by the Department of Toxic Substance Control and also to ENCOURAGE Browning Ferris Industries (BFI) to voluntarily agree to limit acceptance of such materials . Supervisor Torlakson moved on recommendations 2 , 3 , and 4 to direct that staff come back with reports in appropriate timeframe on the air monitoring and to ask the different departments involved, mainly the Growth Management Agency, to come back with reports on recommendations 3 and 4 and set a public hearing no later than June 25, 1996 on items 3 and 4 . Val Alexeeff, Growth Management and Economic Agency Director, suggested that the issue of the mitigation measures go first to the Finance Committee . Supervisor Torlakson concurred. The vote on the motion was as follows : AYES : Supervisors Rogers, Bishop, DeSaulnier, Torlakson and Smith NOES: None ABSENT: None ABSTAIN: None IT IS BY THE BOARD ORDERED that the Health Services staff are DIRECTED to report to the Board of Supervisors as soon as possible on the establishment of an air quality monitoring D,7 program at the Keller Canyon Landfill; the Growth Management and Economic Development Agency (GMEDA) is DIRECTED to report to the Board of Supervisors on the issues of property valuation and host mitigation fees and a good neighbor agreement between BFI and the City of Pittsburg; and that hearings are DIRECTED to be held on the issues of property valuation and host mitigation fees on June 25, 1996 ; and those issues are REFERRED to the Finance Committee for review and report to the Board of Supervisors . i I i i Request to Speak Form P 7 ( THREE (3) MINUTE LIMIT) Complete this form and place it in the box near the speakers' rostrum before addressing the Board.
