ACKNOWLEDGE receipt of the Monthly Progress Report#43 prepared by O'Brien-Krietzberg
& Associates, Construction Manager, on the status of the Merrithew Memorial Hospital
Replacement Project, including Contract Compliance Services prepared by Technical Data
Corporation.
BACKGROUND
The contract for construction management with O'Brien-Krietzberg& Associates for the
Merrithew Memorial Hospital Replacement Project requires a monthly status report, including
the contractors' compliance with the MBE/WBE and affirmative action contract requirements, to
be filed with the Project Director in the Office of the County Administrator. A copy of the
monthly progress reports are provided to the Clerk of the Board and the Board of Supervisors for
information purposes.

EXECUTIVE REPORT
PROJECT STATUS
With summer arriving a few weeks early, the pace of construction is proceeding quite
rapidly. Now that all floor decks have been poured, the interior walls and exterior skin are
beginning to reveal the shape of things to come.
Currently, the exterior wall anchors are being installed which will support the EIFS
(Exterior Insulation Finish System). EIFS is best described as a waterproof, insulating,
synthetic"stucco" system. Concurrent with this exterior work, the interior shell is
beginning to develop quickly. The first sheets of drywall are being hung upon framing that
is progressing on the lower three floors. Through these walls, plumbers are starting to
rough in drain, waste and vent pipes. The fire sprinkler main and its numerous branch
lines are making their way across the first and second floors. Large shipments of duct
work are being dispersed and installed on the first three floors. Elevator rails have arrived
and they are being tweaked into alignment and welded off within the shafts. The
Electricians have completed the in-slab rough in and have focused on the overhead
raceways which will distribute the power and low voltage systems throughout the hospital.
The Architect has completed the construction drawing changes for the 4th and 5th floor
and the plans were submitted to OSHPD earlier this month. Although a 90 day
turnaround is expected from OSHPD, work around activities were authorized for work in
progress to mitigate impacts.
BUDGET
The total project budget is $81,841,000. The attached project cost report shows the
updated current expenditures and forecast amounts. The construction forecast includes
the estimate for the 4th and 5th floor changes. A preliminary cost proposal is expected in
early May.
SCHEDULE
The contractor has submitted a schedule update for April which includes the 4th and 5th
floor changes. The contractor's revised schedule shows a contract completion date of
September 30th. This represents a 37 work day extension, or, a 53 calendar day extension
as a result of the 4th and 5th floor changes. Once the final review is complete, an
extension, if justified, will be approved. Based on the April schedule submission, the
critical path runs through the 4th floor rework and exterior skin.

TASK 1 No activity.
TASK 2 A. On April 11, 1996, TDC staff, Doug Crosby, the General
Contractor staff, Jose Garcia, reviewed the monitoring of
M/WBE and the workforce utilization charts for possible
improvements in methods of monitoring and improvements in
reporting. See Attachment 2 for more details.
B. Most of the sub-contractors are exceeding the overall project
goals for minority and female workforce participation. Those
contractors who are not meeting the goals have been put on
notice to either get in compliance immediately or prepare an '
outreach plan as to how they are going to improve their
compliance posture.
C. The fifth floor change order was discussed in detail and,
definitive strategies were developed to involve more M/WBE.
sub contractors on the project. As a result of that change order
the cut off date for reviewing prices was extended and as final
drawings are developed a list of M/WBEs who are already
identified will visit the site and be given an opportunity to meet
and talk with the General Contractor's staff and the permanent
1st tier sub-contractor to discuss their possible involvement.
Several other M/WBE sub-contractors have completed
negotiations with the General Contractor, given an acceptable
quote and are waiting for a resolution/clarification of the project
agreement letter from the craft unions before signing the
contract. The value of these procurements are over
$225,000.00.
TASK 3 A. TDC continuously increases its data base of available M/WBE
contractors and resource lisping of craft unions, JACs,
community training resources, e:c., to provide assistance to the
contractors/sub-contractors in locating M/WBE sub contractors

and women and minority workers. When an M/WBE contractor
is identified, TDC first checks their certifications. If the
certification is not current TDC staff immediately assists them
with completing their certification.
TASK 4 A. No activity.
B. No activity.
C. DC staff attended permanent AA/EEO Affirmative Action
meetings, appropriate for monitoring AA/EEO progress. (See
Attachment 2.)
TDC was present as directed at the Board of Supervisors
meeting 4-26-96 for a presentation to be made by the
CM/Contractor on the M/WBE participation and manpower
utilization on the project. We were at the Board chambers from
1:00 p.m. to 5:00 p.m.; however, the item was rescheduled for i
another date.
TASK 5 A. TDC has an ongoing creditability/working relationship with the
Construction Manager, the General Contractor and the Sub-
contractors, suppliers, etc. The coordination/relationship is
producing the proper atmosphere for the project.
TASK 6 A. No. activity.
B. No activity.
C. No activity.
TASK 7 A. The monitoring activities on the project site are being achieved.
Contractors who are meeting the goals by total company and by
trade have increased. Those Contractors who are not meeting j
goals have been put on notice by the General Contractor to
provide a work plan to demonstrate a more aggressive outreach
effort to achieve the.goals. .
B. Payrolls and Minority Utilization Reports are being monitored at
least two times -- in most cases 3 times -- weekly to insure that
the Contractor is submitting the documents in a timely manner
and that proper compliance statements are being signed by the
appropriate contractor attesting to the fact that the information
is correct per section E of the Contract Specification. (See
Attachment 2.) Charts are t,eing prepared to depict the
monitoring by sub-contractor and by trade craft.

C. No activity. TDC staff is not privy tocontract progress
payments as they are prepared by the appropriate sub-
contractor or a review of checks received by sub-contractors for
work performed.
D. TDC is preparing monthly progress reports, charts and graphs
that truly reflect the project activity. This report covers activities
for the month of April and summarizes statistical data captured
during the month of March.
E. A special report prepared by the County Compliance Officer was .
reviewed and commented on verbally to the County M/WBE
Compliance Officer. The report entailed a random extract of
information from the weekly payrolls by Social Security numbers
and surnames and scrutinized by the Compliance Officer for
verified race and gender. TDC advised that all inquiries not in
compliance with information shown on the payrolls should be
directed to the appropriate contractor/sub-contractor for
response/validation.

MEETING SUMMARY
4-04-96 AA/EEO Review: Doug Crosby and Jerry Hutton met with Ms. E.
Kuevor to review activities and reporting for the prior month. The
discussion centered around the statistical reporting and verification of
M/WBE procurements. The bar graph was dropped in favor of the
reporting format used by the Construction Manager. TDCs role would'
be verification of certification and the issuance of a Letter of Intent, a
signed contract, purchase order or a paid invoice.
4-11-96 Doug Crosby attended the weekly Construction Manager's meeting,
where the entire job is discussed. The General Contractor's ,
superintendent and project manager were also present. AA/EEO,
change orders and the major changes on the 5th floor were fully
discussed. At the end of the construction meeting, Doug Crosby,
Gerry MacClelland and Jose Garcia met to review the 5th floor change
order and continue our development of a strategy to maximize
additional M/WBE participation on the project.
4-16-96 Jerry Hutton met with Centex Golden project staff to clarify the chart
of M/WBE participation prepared by the General.Contractor and the
Construction Manager. A review of signed contracts, purchase orders,
Letters of Intent and .paid invoices were made. A tracking of this
activity was made from bid date through April 16, 1996.
4-25-96 Doug Crosby and Jerry Hutton met with Ms. E. Kuevor to review the
monthly report and other documentation prepared for the monthly
Advisory Council Meeting.
4-25-96 Doug Crosby and Jerry Hutton attended the monthly Advisory Council
Meeting. A presentation was made by Doug Crosby and Jerry Hutton
recapping activities of the prior month and answering questions raised
by the Council. Staff from the General . Contractor and the
Construction Manager's office were in attendance.

ATTACHMENT 2
LABOR COMPLIANCE
Labor Compliance Monitor, Frank Crosby, attended the monthly sub-contractors
meeting to meet the new sub-contractors coming on the job and to introduce the
Labor Compliance Monitoring Program to them and to discuss the on-site j
interviewing procedures with them. The new sub-contractors were appreciative for
this information and none of them seemed to have a problem with the process. I
stressed to them the necessity of proper completion of the payrolls and the
minority utilization reports and reminded them of the Compliance Statement that
they must sign and attach to the payroll reports. The Contractor's signature to the
Compliance Statement clearly holds the Contractor responsible for the truth and
accuracy of the payroll information given.
I
Worked with the General Contractor's staff on a spot audit of payrolls for the month
of April to verify that Centex Golden's count of female and minority hours and
percentages was an accurate count.
Did a spot check using field interviewsS payroll reports and Inspector's Daily
Reports to insure that the Contractors are in compliance with all prevailing wage
rate provisions consistent with the State Department of Industrial Relation's
guidelines.
Conducted unannounced on-site interviews of workforce focusing on female and
minority workers to provide a check system when the payrolls were received.

met with a representative from the F. W. Spencer Company to notify them of an i
upcoming visit I was scheduling to their off-site fabrication shop to interview female
workers.
