SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Staff recommends that the Board of Supervisors find the environmental documentation prepared for this project as adequate. 2 . Deny the appeal of the applicant, Dale Bridges, and uphold the San Ramon Valley Regional Planning Commissions decision. 3 . Adopt the findings contained in Resolution No. 8-1996 as the basis for the Board's action. 4 . Direct the Director of Community Development Department to post a Notice of Determination with the County Clerk for this project reflecting the Board's action. ALTERNATIVE Due to the lack of specificity of the appeal, staff is unable to provide meaningful analysis for alternative recommendations. The Commission on April 24, 1996 took testimony and continued the matter to May 15, 1996 at the applicant's request. Further testimony was taken on May 15, 1996 and the Commission approved the extension of the used car lot to expire on July 18, 1997 for a maximum of seventeen (17) display cars and denied the installation of the ancient Indian head sign because it violated the S-2 Sign Combining Ordinance. Due to the recent enforcement issue, as noted in Staff's presentation to the Commission and testimony by the Alamo Improvement Association, the Commission added a condition which requires the applicant to submit quarterly reports demonstrating compliance with the Conditions of Approval. (See Condition of Approval #11, "Conditions of Approval for Land Use Permit #LP952061, as approved by the San Ramon Valley Regional Planning Commission) . APPEAL LETTER DATED MAY 24 , 1996, DALE BRIDGES The applicant's appeal letter filed with the Department dated May 24, 1996 does not specify the grounds for the appeal as required by County Code Section 26-2.2406. The applicant has not provided any new information that was not available to the Commission at the time of their decision. ADDENDUM TO ITEM D. 18 JUNE 25, 1996 This is the time noticed by the Clerk of the Board of Supervisors for hearing on the appeal of Dale A. Bridges, Bridges Motors of Alamo, (appellant) from the decision of the San Ramon Valley Regional Planning Commission on the application (LP 95-2061) of Dale Bridges (applicant) and Peter Ostrosky (owner) for approval to establish a used car dealership for 25 vehicles . This is a three year temporary permit . Variances are requested for parking to back-up standards 9 feet where 28 feet is required and 100% compact parking stalls in the Alamo area. Dennis Barry, Community Development Department, presented the staff report on the appeal . Steve Wright, Public Works Department, commented on permanent use, the location of the deck and the parking problem on Danville Boulevard. Mr. Barry commented that the northern deck is excluded from approval and that a revised parking site plan showing where the parking is located is needed. The public hearing was opened and the following persons presented testimony: Dale Bridges, Bridges Motors of Alamo, 3132 Danville Boulevard, Alamo; Peter Ostrosky, 26 Ostrosky Court, Alamo; Bob Hill, 140 Austin Lane, Alamo, in support of the appeal; Richard Gower, 163 Rubicon Circle, Danville, in support of the appeal; Tony Carnemolla, 2665 Lunada Lane, Alamo. The Chair read comments from the following persons : John Henderson, 24445 Southview Drive, Alamo, representing the Alamo Improvement Association, endorsed the staff ' s proposed conditions with a car limit; Preston Taylor, 1070 Quartermaster Canyon, San Ramon, that no modification to existing land use limitations is warranted; Don Copland, 2350 Heritage Oaks Drive, Alamo, in opposition to the appeal . Supervisor Bishop moved approval of the San Ramon Valley Regional Planning Commission' s recommendations with a limit of 17 cars, along with all of the conditions approved by the Planning Commission. Supervisor Rogers seconded the motion. Supervisor Torlakson urged consideration that the motion be for 21 cars . Supervisor Bishop urged strongly that the limit be for 17 cars . Supervisor Torlakson moved a substitute motion for 21 cars . There was no second for the substitute motion. IT IS BY THE BOARD ORDERED that the recommendations 1, 2 , 3 , and 4 are APPROVED.
