Note: In Vogel v.Los Angeles County (1967),since 1968,the State has interpreted the court's decision that it held that
the oath was an unconstitutional violation of the federal Constitution's guarantee of free expression by removing the second
paragraph from all oaths. This is a misinterpretation of the court's opinion. The court actually held that the person taking and
subscribing the oath was not obligated to swear or affirm to the second paragraph and may refuse to do so. However,if that person
fails to"take and subscribe"this oath,that person could not serve in that office. This was affirmed nine years later by the California
State Legislature in Elections Code §70.
ELECTIONS CODE § 70 Oath or affirmation set forth in nomination papers
Notwithstanding any provision of law to the contrary, there shall be set forth in full in nomination papers
required for any primary or final election the oath or affirmation set forth in Section 3 of Article XX of the Constituion
and,such requirement shall satisfy the provisions of Section of Article XX of the Constitution with respect to any office
or public trust. (Added by Stats.1976,c. 1191, § 1.)
GOVERNMENT CODE § 1.026. Felony Violation of Provisions
Every person«rho exerrises the duties of any office in violation of the provisions of this article relative to oaths,and
every person«Iao kno-,vingly aap'pZq nts to office a person ineligible by reason of the provisions of this article relative to oaths,
is guilty of a FELONY.
GOVERNMENT CODE § 18150 Required oath
The oath required by this chapter is the oath set forth in Section 3 of Article XX of the Constitution of
California.
GOVERNMENT CODE § 18151 Persons required to take oath; time of filing
The oath required by this chapter shall be taken and subscribed by:
(a)Every person who is appointed to a State position not in the State civil service and not otherwise so required
by law,within 30 days of the date of appointment; and
(b)Every person who has not previously taken and subscribed the oath and who is employed in a permanent
position in the State civil service where the employment continues for 30 days or more,within the first 30 days of his
employment.
GOVERNMENT CODE § 18152 Manner of taking and filing; nonmember of civil service
The method and mariner of taking,subscribing,and filing the oath by a person appointed to a State position
not in the State civil service shall be as provided in Article 4,Chapter 2,division 4,Title 1 (Government Code§ 1360
et seq.).
GOVERNMENT CODE § 18153 Manner of taking and filing by civil service employees; printed forms
The oath shall be taken by a state civil service employee before his appointing power or before any person
authorized in writing by his appointing power or before any person authorized by law to administer oaths.
The oath shall be filed as prescribed by the State Personnel Board rule within 30 days of the date on which
it is taken and subscribed. The board shall prepare and furnish printed forms of the oath.
GOVERNMENT CODE § 18154 Failure to take oath; nonmember of civil service
ANY PERSON WHO IS APPOINTED TO A STATE POSITION NOT IN THE STATE CIVIL SERVICE
AND WHO FAILS TO TAKE THE OATH REQUIRED BY THIS CHAPTER WITHIN THE TIME PROVIDED
FORTHWITH FORFEITS HIS RIGHT TO HIS POSITION,AND THE POSITION SHALL BE CONSIDERED
VACANT.
GOVERNMENT CODE § 18155 Failure to take oath; civil service employee
The failure of any person who is appointed to a permanent position in the State civil service to take and
subscribe the oath within the time provided in this chapter,is a cause for dismissal by the State Personnel Board.

WHO OWNS REFEREE JOSANNA BERKOW?
REFEREE JOSANNA BERKOW of Department 41, the Superior Court of Contra Costa County,
uses her office as a Superior Court judge to ENRICH HER FRIENDS AND ASSOCIATES in the amount
of MILLIONS OF DOLLARS A YEAR.
In the 4 years Referee Josanna Berkow has been employed by Contra Costa County and the
Superior Court as a Family Support Referee, she has spawned a multi-million dollar industry of
patronage, favoritism and corruption. As a result of her"pork barrel" approach to dissolution and custody
resolution, significant harm is done to children involvE;d in custody disputes by court appointed experts,
therapists and attorneys who are, as a result of their allegiance to Referee Berkow, ill prepared to advise
the court in a fair, impartial and professional manner. Her system of favors compromises the integrity
of the court and the integrity of the psychotherapeutic community.
The most frequently heard complaint about Referee Berkow from unbiased attorneys is that she
delays making decisions by endlessly sending the parties for evaluation and testing. Once that lengthy
and costly procedure is complete, 'the litigants are then subjected to the capricious rule of Special
Masters or other unqualified "experts" appointed by Referee Berkow. The fees for these court ordered
"services"are determined by the appointees themselves and the litigants or the County pay the bill. This
results in hundreds of thousands of dollars in personal income for individual psychologists, psychiatrists,
MFCC therapists, mediators, evaluators, social workers, Family Court Services personnel, visitation
supervisors and attorneys.
Ken Breslin, Ph.D., proprietor of A Child's Point Of View, a group of child psychologists and
therapists in Lafayette, CA, claims that 100%of the business his company receives comes from Referee
Berkow. With six therapists, their income can exceed$ 00,000 a year. On the other hand, Turning Point
Counselling Center, headed by Patricia Mackay, MFCC, receives no-referrals from Referee Berkow.
Ms. Mackay is a highly respected professional who has over fifteen years experience as a child and
family therapist and she is a licensed supervisor of MFCC interns. She has had disagreements with
Referee Berkow. Turning Point is blackballed.
Referee Berkow only patronizes experts and attorneys who have her prejudices and her point
of view. These "professionals" learn how to provide what she likes to hear in order to keep their
livelihoods and maintain their lifestyles - AT YOUR EXPENSE.
"Josanna", as these people freely call her, gives her experts and professionals the immunity of
the court that comes with her appointment. Under State law, her friends are immune from prosecution
or lawsuits. They are accountable to no one but "Josanna", the only person who can decide if they are
competent or not and the only person who has no incentive to admit she made a mistake. Hangers-
on like Dr. Ken Breslin, a self styled children's therapist, and hack atttorneys like Paula A. Lorentzen,
twice convicted of fraud and suspended by the State Bar, enjoy the supposed protection of immunity
granted to them by "Josanna".
Ask your attorney how your child can expect a competent, unbiased psychological and family
placement evaluation or report from an "expert" appointed by "Josanna" if that "expert" is completely
dependent on her for maintaining their lifestyle and guaranteeing their paycheck. Ask your attorney
about Berkow's Battered Women's Alternatives used,to hand out BWA business cards in her courtroom
until she was caught red-handed committing this misdemeanor.
No therapist or lawyer works for free. Referee Josanna Berkow directly or indirectly controls
more than $10,000000 a year in patronage jobs and patronage income. Wouldn't you like to know what
"Josanna" gets in return for the millions of dollars in YOUR MONEY she gives to HER friends?
