I. RECOMMENDED ACTION:
DETERMINE that the project is a California Environmental Quality Act Class 12
Categorical Exemption.
DIRECT the Director of Community Development to file a Notice of Exemption
with the County Clerk.
DIRECT the Public Works Director to arrange for payment of the $25.00
handling fee to the County Clerk for filing of the Notice of Exemption.

II. FINANCIAL IMPACT:
None
III. REASONS FOR RECOMMENDATION/BACKGROUND:
The project involves the sale of excess property. The Resolution of Intention to
sell the property will occur at a later date.
The project has been determined to be in compliance witht the General Plan and
is exempt from CEQA because it consists of the sale of surplus property in
accordance with Section 15312 of the CEQA Guidelines. The property is not
located in an area of statewide, regional, or areawide concern as described in
Section 15206 (b) (4).
IV. CONSEQUENCES OF NEGATIVE ACTION:
Delay in approving the exemption may delay the sale of the property.

The project will not have a significant effect on the environment. The recommendation is
based on the following:
The surplus property is not in an area of statewide, regional, or areawide concern identified
in Section 15207 (b)(4) of the County CEQA Guidelines. The Transportation Engineering
Division of the Public Works Department has determined that this portion of the roadway
is unnecessary for present or prospective public use.
What changes to the project would mitigate the identified impacts (list mitigation measures
for any significant impacts and conditional negative declaration).

GENERAL CONSIDERATIONS:
1. Location: The property is located in an unincorporated area of Bay Point in central
Contra Costa County (Figure 1).
2. Project Description: The project consists of the sale of a 2.8 acre parcel of surplus
government property. The Transportation Engineering Division of the Public Works
Department has determined that this portion of the roadway is no longer needed for
the road widening project for which the County originally acquired it (Figures 2 &
3).

parcel of surplus government property. The Transportation Engineering Division of the Public Works
Department has determined that this portion of the roadway is no longer needed for the road widening for
which the County originally acquired it. Subject project is located as follows: The property is located in an
