SUBJECT: Approval of Facility Use Agreement Letters with Site Owners Participating 1
in the County's Household Hazardous Waste Collection Program
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
I. RECOMMENDED ACTION:
Approve and authorize the County's Health Officer, William B. Walker, M.D. to sign
on behalf of the County, facility use agreement letters with site owners of the
sites at which Rollins Chempak, Inc. (Standard Contract #22-447) will conduct
household hazardous waste collection events for the County.
II. FINANCIAL IMPACT:
These are non-financial agreements.
III. REASONS FOR RECOMMENDATIONS/BACKGROUND:
On April 28, 1992, the Board of Supervisors approved implementation of a
countywide mobile household hazardous waste collection program to prevent toxic
contamination of solid waste landfills, storm drains, and sewage treatment
systems. The Board's final approval of the program was contingent upon receiving
approval from a majority of the cities, representing a majority of the
incorporated population of the County. On November 17, 1992, the Board gave their
final approval of the program and of funding the program from solid waste tipping
fees.
Subsequently, the Environmental Health Division of the Health Services Department
issued a Request for Proposals for a hazardous waste management firm to manage
collection events and to transport and recycle/dispose of the hazardous wastes
collected from County households, and Rollins Chempak, Inc. was awarded the
Contract (Standard Contract #22-447) which the Board of Supervisors is approving
concurrently.
Under the terms of their Contract with Contra Costa County, the Company will
conduct a series of weekend household hazardous waste collection events at various
sites throughout the County where residents may bring household hazardous wastes
which the Contractor will then transport and recycle or dispose of as appropriate.
The Department is issuing a facility use agreement letter, which has been approved
by County Counsel and Risk Management, to the owner of each site, setting forth
the terms under which the County and the site owner will participate in the waste
collection program.

Dear (Site Owner Representative) :
The Contra Costa County Health Services Department is sponsoring a
program in which County residents may, at no charge and by
appointment only, properly dispose of their household toxic
products. The purpose of this letter is to provide the terms under
which Contra Costa County (County) and (site owner) will
participate in this household hazardous waste collection program on
(collection event dates) at the (property site location) .
♦ (Site owner) agrees to allow the County to use the (property
site location) for this event and agrees to cooperate with the
County in the development of a traffic pattern that will
ensure public safety and clear access to the collection area
and which minimizes any inconveniences to (site owner) patrons
and staff.
♦ Rollins CHEMPAK, Inc. a hazardous waste management firm, has
been retained by the County to inventory, package, transport
and dispose of the collected nonrecyclable hazardous wastes.
The County and Rollins CHEMPAK will provide all of the
necessary staff, supplies and equipment to manage the wastes
received.
♦ The County and Rollins CHEMPAK will be jointly responsible for
the complete clean-up of the area used, restoring it to its
pre-event condition upon termination of the collection on
(last day of collection event) .
♦ Wastes will not be left unattended or unsecured at the site.
♦ Prior to the event on (first day of collection event) , Rollins
CHEMPAK will provide you with a signed Certificate of
Insurance naming (site owner) as an .additional insured under
the policies Rollins CHEMPAK is required in its contract with
the County to maintain for these collection events. No event
shall be held without receipt of this Certificate.
