The Board of Supervisors of Contra Costa County RESOLVES THAT; The Public Works Director,Engineer of Work for Countywide Landscape District AD 1979-3 (LL-2), filed an annual report for Fiscal Year 1996-97, and the Board adopted its Resolution of Intention to levy and collect assessments within the Assessment District Zones 1, 2, 3, 4, 5, 7, 8, 9, 10, 11, 13, 14, 16, 17, 18, 19, 20, 21, 22, 23, 24, 26, 27, 28, 32, 33, 34, 36, 37, 38, 39, 40, 42, 44, 45, 46, 47, 48, 49, 54, 57, 58, 60, 62, 64, and 66, for Fiscal Year 1996-97, the public hearing held at 11:00 a.m. on Tuesday, June 11, 1996, in the Chambers of the Board of Supervisors of the County of Contra Costa, Administration Building, 651 Pine Street, Martinez, California 94553. Notice of the hearing was given in the time and manner required by law. At the public hearings,the Board afforded to every interested person an opportunity to make a protest to the annual report either in writing or orally, and the Board has considered each protest. The Board hereby over rules each of these protests and finds that the protest against the proposed improvements in each zone, including all written protests not withdrawn in writing before the conclusion of the protest hearing, is made by the owners of less than one-half of the area of the land to be assessed. The Board hereby confirms the Final Engineer's Report diagram and assessments as set forth in the annual report of the Assessment Engineer of Work and hereby levies the assessment to be placed on the tax rolls set forth therein for Fiscal Year 1996-97. I put my name in to speak but, unfortunately, was not called to speak. I 'm unable to attend today ' s hearing and would like my statement lodgettin the record. My husband and I are seven-year residents of Pacheco and live in a subdivision with an existing Landscape District Assess- ment . The only one currently in the Town of Pacheco. We have seen what a good job the County has done with our area and support this new District 100 percent. Also, I have attended the Town Council meetings addressing this topic and never heard anyone object to the proposed District, including the mobile home residents. The Town of Pacheco has attempted volunteer programs for land- scaping in the Town ' s general areas, but to no avail . That is why so many homeowners that I have spoken with are in favor of this new District. It is a nominal annual charge with a huge benefit to the entire community. It will improve the aesthetics, safety, property values and enjoyment of all residents in Pacheco. I would like to address one other issue as well . It seemed from last Tuesday ' s hearing that many of you have your minds made up on the issue of "taking this to a vote. " While I agree that voting is a fair and democratic process and should be utilized; I don' t feel, however, that you should "change the rules" on this proposed District more than half-way through the process . ' � J TO: CONTRA COSTA COUNTY BOARD OF SUPERVISORS Page 2 June 11 , 1996 I have been working with the Town Council and County since the beginning of this year to, hopefully, have an implementa- tion by August . It ' s June and if the rules are changed now, who knows how long it would take to implement and at more cost and manpower to the County. With regards to this proposed Pacheco District, every parcel owner has had the required notice and opportunity to voice their protest or consent by writing and verbally by these hearings . The opposition has been by written protest only of less than 10 percent. I urge you to reconsider the changing of the rules more than half-way through the process because it would not be fair to the County Public Works and parcel owners who have worked hard on its implementation. Zone 58 (Oakley Area) - Subdivision 7837 Landscaping withing public right of way along Almondtree Lane, Highway 4 and Cypress Road, fronting Subdivision 7837, totaling 1,200 linear feet and varying in width from five feet to 21 feet. Zone 60 (Oakley Area) - Subdivisions 6935 and 7809 Landscaping improvements are located within the public right of way, fronting Laurel Road and Highway 4, along the frontage of Subdivisions 6935 and 7809 to their point of intersection. Landscape improvements also include the Laurel Road median islands and Parcel B (play lot). The Public Works Director, has filed with the Clerk of the Board the Annual Report required by the Landscape and Lighting Act of 1972. . This report contains a full and detailed description of the improvements, the boundaries of the assessment district and the proposed assessments upon assessable lots and parcels of land within the assessment district. The report has been approved by the board of Supervisors and is open to public inspection..
