DEPARTMENT HEADS TO AUTHORIZED POSITIONS

RECOMMENDATION:
ADOPT the attached Resolution setting forth a general policy statement on conflicts
of interest in filling positions.
BACKGROUND: ,
Last year, the Board of Supervisors directed County Counsel to prepare and return
to the Board of Supervisors a general policy statement on conflicts of interest in
filling positions. County Counsel has prepared such a policy statement which is
contained in the attached Resolution.
If the policy statement is acceptable to the Board of Supervisors, we would
recommend that the Board adopt it as Board policy.

The Board' s order on "Criteria For Granting Exemptions To The
Hiring Freeze and Criteria For Creating And Filling "Project" and
"Exempt" Positions"tdirected the County. Counsel to prepare and return
to the Board of Supervisors a general policy statement on conflicts
of interest in filling positions . A proposed Resolution is returned
herewith for your consideration and possible adoption.

It is the policy of the Board of Supervisors that when appointing
persons to authorized positions , department heads appointed by the Board of
Supervisors are directed, and department heads not appointed by the Board
of Supervisors are encouraged, to avoid situations which may create the
appearance of a conflict of interest, even though no legal conflict exists .
