FISCAL IMPACT No impact on the General Fund. The .$50,000 is provided by tax increment funds from the Oakley Redevelopment Project Area as shown on the adopted Fiscal Year 1995-96 budget. BACKGROUND/REASONS FOR RECOMMENDATIONS The Oakley Municipal Advisory Council (MAC) and Oakley community have been strong advocates for developing a new library, recreation center and East Bay Regional Parks trailhead on the Moira parcel located due south of O'Hara School on O'Hara Avenue. The parcel is one block outside the Oakley Redevelopment Project Area boundaries. Site considerations and unanswered questions on the site and type of construction for the buildings necessitated that a master planning process be commissioned. On November 13, 1995, OMAC requested using $50,000 in tax increment funds for the master planning process. OMAC also requested Agency staff prepare the necessary findings by the Board of Supervisors to allow expenditures of tax increment funds outside the Redevelopment Project Area. A Steering Committee comprised of community representatives, Agency staff, County Library staff, and a YMCA staff reviewed eight proposals and interviewed the four top candidates. The Steering Committee chose the George Miers & Associates consultant group for this project. The total proposal amount was about $60,000. The Agency will provide $50,000, the YMCA will contribute $3,000, and on April 8, 1996, OMAC voted to use Zone 16 funds (Oakley area landscaping fund) to cover the remaining financial gap. SDI SUMMARY OF FINDINGS PURSUANT TO SECTION 33679 OF THE STATE OF CALIFORNIA HEALTH AND SAFETY CODE I. Summ a1y Of The Program. The Contra Costa County Redevelopment Agency (the "Agency") is proposing to finance a Master Plan (the "Plan") for a Library and Recreational Facility (the "Facility") in the Oakley Redevelopment Project Area(the "Project Area"). The Facility is proposed to be located on a parcel on the east side of O'Hara Avenue and south of West Cypress Road, a half-block south of the Project Area boundary, as more particularly described in Exhibit A attached to this report (the "Site"). The Facility will be owned and operated by the County of Contra Costa (the "County"). Under this Agreement, the Agency would provide $50,000 Dollars ($50,000) for the master planning of the Facility by the County. Pursuant to Health and Safety Code Section 33445, the Agency is authorized, with the consent of the County, to pay part or all of the value of master planning the facilities which are to be publicly owned and are of benefit to the Project Area. The County must determine (a)that the public improvements are of benefit to the Project Area or to the immediate neighborhood in which the improvements are located, and (b)that assisting the development of the improvements will assist in the elimination of one or more blighting conditions inside the Project Area. The County must determine that there are no other reasonable means of financing the public improvements available to the community. Pursuant to Health and Safety Code Section 33679, the County is required to hold a noticed public hearing on the proposed funding of the public improvements, and to make available to the public a summary of the,proposed transaction containing the following information. II. Estimate Of The Amount Of Tax Increment To Be Used By The Agency For The Construction Of The Facility. Under the Agreement, the Agency would pay $50,000 Dollars ($50,000) of tax increment funds to prepare a Plan for the Facility. IIL. Facts Supporting The Findings To Be Made Pursuant To Health And Safety Code Section 33445. A. Facts Supporting The Finding That The Facility Is Of Benefit To The Project Area Or The Immediate Neighborhood In Which The Project Is Located. The Site on which the Facility will be constructed is vacant and is located on O'Hara Avenue, south of West Cypress Road, a half-block south of the Project Area boundary. The County intends to develop a Plan for the Site which will include a new library, recreation and park facilities. Development of the Site is of benefit to the Project Area because it will do following: I. The redevelopment of the Property will eliminate a serious blighting influence in the Project Area. As described in the documents set forth in Exhibit B (which documents are incorporated in this Summary by this reference), the Project Area is characterized by the existence of inadequate public improvements, open space and recreation facilities that have a detrimental physical and economic impact on surrounding parcels. 2. The implementation of the Plan will serve goals and objectives set forth in Part IV of the Redevelopment Plan, including goals and objectives related to the construction and rehabilitation of public facilities (Objective 2). 3. The implementation of the Plan will serve goals and objectives set forth in Part VII of the AB 1290 Implementation Plan, including goals and objectives related to the expansion of the type and quality of community facilities (Objective 5). 4. Improve the Site with public and recreation improvements that are safe for Project Area residents, which will contribute to the community's supply of public, park and recreational facilities. 5. Enhance the Site with improvements that do not impair the economic development of nearby parcels and portions of the Project Area. B. Facts Supporting The Finding That There Are No Other Reasonable Means Of Financing The Facility Available To The County. The County has determined that there is a financing gap between the overall development costs of the Facility and the resources available to the County for the development of the Facility. The County intends to secure customary state resources for development of the Facility, but these resources are inadequate to finance the predevelopment costs for developing the Facility. The County has determined that it cannot provide funds without reducing funding of essential County activities, as evidenced in Exhibit C attached to this report. The County has approached the Agency to finance the necessary predevelopment cost gap by appropriating money that would have otherwise funded non-essential County activities. Thus the Agency's participation is the only reasonable means of financing the Facility available to the County. C. Facts Supporting The Finding That Assisting The Development Of The Facility Will Assist In The Elimination Of One Or More Blighting_Conditions Inside The Pro-ject Area. The Site is vacant and is located about a half-block south of the Project Area boundary. The Project Area is characterized by the existence of inadequate public improvements, open space and recreation facilities that have a detrimental physical and economic impact on surrounding parcels. Assisting the development of the Facility will assist in the elimination of blighting conditions inside the Project Area because it will do the following: 1. The redevelopment of the Property will eliminate a serious blighting influence in the Project Area. 2. The implementation of the Plan will serve goals and objectives set forth in Part IV of the Redevelopment Plan, including goals and objectives related to the construction and rehabilitation of public facilities (Objective 2). 3. The implementation of the Plan will serve goals and objectives set forth in Part VII of the AB 1290 Implementation Plan, including goals and objectives related to the expansion of the type and quality of community facilities (Objective 5). 4. Improve the Site with public and recreation improvements that are safe for Project Area residents, which will contribute to the community's supply of public, park and recreational facilities. 5. Redevelopment Purpose For Which Tax Increment Revenues Are Being Used To Pay For the Facility. The Site is vacant and is located a half-block south of the Project Area boundary. The Project Area is characterized by the existence of inadequate public improvements, open space and recreation facilities that have a detrimental physical and economic impact on surrounding parcels. The redevelopment purpose for which tax increment revenues are being used to pay for the Facility is the elimination of blighting conditions inside the Project Area by doing the following: 1. The redevelopment of the Property will eliminate a serious blighting influence in the Project Area. 2. The implementation of the Plan will serve goals and objectives of the Redevelopment Plan related to the construction and rehabilitation of public facilities. 3. The implementation of the Plan will serve goals and objectives set forth in Part VII of the AB 1290 Implementation Plan, including goals and objectives related to the expansion of the type and quality of community facilities (Objective 5). 4.
