CONSIDER independent consultant evaluation, either in conjunction with, or without EBMUD involvement, on basis of EBMUD rates east versus west of the hills. 2. CONSIDER position on AB 2203, EBMUD rate issues, sponsored by Assemblyman Rainey. 3. CONSIDER position on AB 2346, Local Government Organization, sponsored by Assemblyman Rainey. 4. ACCEPT oral report on EBMUD rate issues. FINANCIAL IMPACT Should the Board elect to move forward with independent consultant evaluation of EBMUD rates, a relatively substantial cost would be incurred, particularly if EBMUD did not elect to cooperate, or co-fund this study. Some funding is available through the County Water Agency, should this action be approved by the Board. The cost of a study of this type is unknown at this time, but should the Board elect to move forward, efforts to assess cost would be forthcoming. REASON FOR RECOMMENDATION/BACKGROUND On April 23, 1996, both support and support-in-principle positions were considered by the County Board of Supervisors for AB 2203. During this discussion, EBMUD requested that the County delay any decision on this legislation until after the two Boards met on this issue on April 24, 1996. The Board of Supervisors agreed to delay action on these items.. At the meeting of the two Boards, this issue was discussed, as was the potential for independent consultant review of these troublesome, reoccurring rate issues. Each respective Board will consider the potential for independent consultant evaluation. On April 23, 1996, the;Board requested staff to prepare a report on rate issues, and to bring the above- mentioned issues back before the Board. (via CAOhy EBMUD (via GMEDA) VA:RG:rw RRG4:5-7ebmud.6bd D.5 ADDENDUM Item D. 5 May 7, 1996 Roberta Goulart, Community Development Department, delivered an oral report regarding the East Bay Municipal Utilities District (EBMUD) water rate equity issues for customers living on the East versus the West side of the Oakland Hills/Caldecott Tunnel. Following an overview of the written report presented by Val Alexeeff, Director Growth Management and Economic Development Agency (GMEDA), Chairman Smith invited the public to comment on this issue and the following persons addressed the Board: John A. Nejedly, 400 Montecello Drive, Walnut Creek, addressed the Board on this issue and presented the Board members with a written report for their consideration. (Mr. Nejedly did not provide the Clerk of the Board with a copy of the materials he distributed to Board members); Greg Chan and Gary Breaux, EBMUD, 375 1 1th Street, Oakland; and Bill Highfield, WATER, 1053 Hillmeadow Place, Danville. All persons desiring to address the Board having been heard, Chairman Smith ended the public comment on this matter. Following discussion by Board members, Supervisor DeSaulnier moved that the Board act on recommendation number one by authorizing the Chair, Board of Supervisors, to send a letter to the President, Board of Directors of EBMUD, to inquire whether the EBMUD Board would be willing to pay for an independent evaluator, selected by both EBMUD and Contra Costa County, to verify EBMUD's rate figures. Supervisor Torlakson seconded the motion and requested that the i ndependent study i ncl ude an exami nati on of the fundamental pri nci pl es of the EBMUD cost of service figures and that the City-County Relations Committee be invited to help monitor the independent evaluation process. Supervisor Rogers requested that the independent evaluation also examine the impact of tiered rates on water conservation in order to determine whether tiered rates actually promote conservation. Existing law provides that the rates and charges for commodities or service shall be fixed by the board of directors of a municipal utility district . This bill would provide that, notwithstanding any other provision of law, the Board of Directors of the East Bay Municipal Utility District may impose rates on a tiered or differential basis within specified parameters . Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS : SECTION 1. Section 12809 . 1 is added to the Public Utilities Code, to read: 12809 . 1 . [A> (a) <A] Notwithstanding any other provision of law, the Board of Directors of the East Bay Municipal Utility District may impose rates on a tiered or differential basis . [D> However, in no instance shall the district charge a rate that is less than the cost of service, nor shall the maximum rate charged exceed the minimum rate by .more than 50 percent. <D] [A> However, in any tiered or differential rate plan, there shall be no fewer than three tiers . In no instance, except as provided in paragraphs (1) and (2) , shall the district set a rate on waterflow consumption or any other fee relating to water consumption, involving single-family residential rate payers that is less than 95 percent of the average cost of service, for all customers in that class , or greater than 105 percent of the average cost of service. <A] ZA AB 2203 04/16/96 Page 2 IA> (1) The district may set a rate on waterflow consumption that is less than 95 percent of the average cost of service for low-income customers . <A] [A> (2) The district may set a rate on waterflow consumption that is less than 95 percent of the average cost of service for recycled or reclaimed water, pursuant to Chapter 7 (commencing with Section 13500) and Chapter 7 . 5 (commencing with Section 13575) of Division 7 of the Water Code. <A] [A> (b) For purposes of this section, "cost of service" means costs directly related to the utility district ' s operation, support, maintenance, debt service, water reclamation and conservation projects , and low- income rate subsidy programs, as determined by the standard operating procedures of the district . <A] [A> (c) This section shall not be interpreted so as to impair the district ' s ability to implement water conservation, reclamation, or recycling projects . <A] SEC. 2 . Due to the unique circumstances concerning the equalization of reasonable rates for water service in the East Bay Municipal Utility District, the Legislature finds and declares that a general statute cannot be made applicable within the meaning of Section 16 of Article IV of the California Constitution. The date on which the number of registered voters is determined is the date of the adoption of a resolution of application by the legislative body pursuant to Section 56800 , if the legislative body has complied with subdivision (b) of that section, or the date a petition or other resolution of application is accepted for filing and a certificate of filing is issued by the executive officer. "Legal representative" means any officer of a corporation duly authorized, by the bylaws or a resolution of the board of directors of the corporation, to sign for, and on behalf of, the corporation.
