In addition, the joint powers agreements may include private entity participants. BACKGROUND: Current law provides for joint powers agreements between public agencies. Current law also requires counties to provide or secure certain public health care services. Current law also authorizes the formation of local health care districts and the establishment of municipal hospitals for the purpose of providing needed public health care services. Assemblyman Campbell has introduced AB 3097 which, as introduced, would do the following: Expressly permit, but not require, one or more local public agencies (including cities, counties and health care districts) to enter into joint powers agreements for the performance of their public health duties. It is felt that enactment of AB 3097 might facilitate cooperation between the County and one or more of the district hospitals in carrying out the health care responsibilities of the County and one or more of the district hospitals. Assemblyman Campbell has specifically asked that the Board of Supervisors support AB 3097. LEGISLATIVE COUNSEL'S DIGEST AB 3097, as introduced, Campbell. Health: local agency joint powers agreement. Existing law requires counties to provide or secure certain public health care services, and authorizes the formation of local health care districts and the establishment of municipal hospitals for the purpose of providing needed public health care services. Existing law, the Joint Exercise of Powers Act, permits 2 or more public agencies to enter an agreement to jointly exercise any power common to the contracting parties. This bill would permit one or more local public agencies, including, but not limited to, cities, counties, cities and counties, and local health care districts to enter into joint powers agreements for the performance of their public health duties. This bill would permit these joint powers agreements to also include private entity participants, and would authorize the agreement to establish an insurance pooling arrangement for the payment of unemployment compensation, tort, or other liability, if one or more of the participating agencies is not a governmental agency. 1 99 AB 3097 — 2 — Vote: 2 — Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no. The people of the State of California do enact as follows- 1 SECTION 1. Section 6516.4 is added to the 2 Government Code, to read: 3 6516.4. (a) One or more local public agencies,- 4 gencies,4 including, but not limited to, cities, counties, cities and 5 counties, and local health care districts may enter into 6 joint powers agreements for the performance of their 7 public health duties. 8 (b). These joint powers agreements may also include 9 private entity participants. In many instances,-private 10 facilities or providers are an integral part of the 11 performance of the local public .health duties of local 12 public agencies interested in forming related joint 13 powers entities. In those instances, formation of the joint 14 powers entity would be incomplete without inclusion of 15 the private agency component. 16 (c) If one or more of the participating agencies is not 17 a governmental agency, the joint powers agreement may 18 establish an insurance pooling arrangement for the 19 payment of unemployment compensation, tort, or other 20 liability incurred by the joint powers agency.
