SUBJECT: Adoption of Ordinance to' Implement AB 337 (Bates Bill :
Gov. Code S 51179(a) , Identifying Very High Fire Hazard
Severity Zones in Orinda, Lafayette and E1 Sobrante
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AAD JUSTIFICATION
Recommendation:
Introduce an ordinance on behalf of the Contra Costa County Fire Protection District
and the Orinda Fire Protection-District designating "Very High Fire Severity Zones"
as identified by the California Department of Forestry (AB 337 (Bates)) in Orinda,
Lafayette and EI Sobrante; waive reading; and fix May 14, 1996 for adoption.
Reason for Recommendation/Background:
After the Oakland Hills Fire and other devastating fires throughout the state, the State
passed legislation of a fire prevention nature in areas with an intermix of residential
occupancies and highly flammable natural and landscape vegetation.
AB 337, commonly known as the Bates Bill (Government Code § 51179(a)), provides
for the designation of areas meeting specific criteria as "Very High Fire Severity
Zones."
As required by legislation the California Department of Forestry and Fire Protection,
has determined that three areas in Board Governed Fire Districts meet the criteria of
"Very High Fire Severity Zones." The zone in Orinda Fire Protection District
encompasses most of the City of Orinda. The zones in Contra Costa County Fire
Protection District include the west portion of the City of Lafayette and the East
Richmond Heights area of EI Sobrante.
The impact of the ordinance will be in the areas of vegetation management, and
building code requirements. Property owners will be required to remove and/or cut
back flammable vegetation or other combustible growth. Fire resistive roof covering
will be required for newly constructed buildings and existing buildings being re-roofed
by more than 50%.
